Verizon Wireless has settled a lawsuit filed last month against Feature Films for Families, for illegally calling Verizon Wireless customers and employees to advertise the movie, 'The Velveteen Rabbit.' In addition to a permanent injunction preventing any future calls, the Utah-based telemarketer has agreed to a $25,000 cash settlement, which Verizon Wireless is donating to the National Domestic Violence Hotline (NDVH). The lawsuit alleged Feature Films for Families illegally used an autodialer to call Verizon Wireless customers about the movie. The lawsuit stated that over 10 days in early February, nearly 500,000 calls were made to Verizon Wireless customers and employees from the telephone number 917-210-4609.

Viral marketing gone wrong? Verizon Wireless sued a Utah-based telemarketing company Wednesday after it allegedly used an auto-dialer to call Verizon customers and encourage them to see the upcoming movie The Velveteen Rabbit.

Verizon filed suit against Feature Films for Families in U.S. District Court in New Jersey for making calls on behalf of Los Angeles-based Family 1 Films.

According to the suit, Feature Films made about 500,000 calls in a 10-day period earlier this month to Verizon Wireless customers and employees from the phone number 917-210-4609. People who answered either heard an automated message or an individual encouraging them to see the movie.

Verizon claims the use of an auto-dialer violates the state fraud and privacy laws, as well as the Federal Telephone Consumer Protection Act, which bans the use of an auto-dialer to call wireless phones.

"Telemarketers continue to harass our customers and impinge on their privacy, often using illegal methods including auto-dialers," Steven E. Zipperstein, vice president and general counsel of Verizon Wireless, said in a statement. "Whatever their methods and whatever their product, these unlawful telemarketing calls are an annoyance to our customers and invade their privacy."

Verizon Wireless suspects the use of an auto-dialer since many of these calls came in rapid succession. Between 4 PM and 5 PM on Feb. 13, for example, the same number placed 11,000 calls, Verizon said.

Verizon is seeking a preliminary injunction to stop the defendants from making similar calls.

After reading that Verizon filed siut against this company I call my provider ATT. I encourage everyone that is an ATT customer to call them and file a complaint about this (these) numbers. ATT's stance is that they need to have their customers log complaints against a said number before they can take action. They can't take action until a few of their customers call in and file complaints for harassing phone calls from this number. If you also received calls from the 917-210-4609 you need to mention that as well. They will mark your account and use your call information as examples if they file a suit in court or complaint with the FCC.

...now the calls are coming from 231-732-2067. Same message as before, but from a new #. It had been quite since 2/19 after receiveing about 6 calls from 917-210-4609 about this movie. I immediately filed complaints with the Do Not Call registry and have done so again today listing this "new" number. My wife is getting the calls as well on her cell phone. We both use ATT. This call came in for me at around 8:50 pm. From a different number 231-732-2067. I didn't answer and then called it back, a guy name John picked up and said he needed 40 seconds of my time to ask me a few questions about a movie being produced. Then I didn't hear him anymore so I hung up!

Contacted me on my emergency cell phone at 7:12 AM.

Since this phone only rings for emergencies, and it was relatively early in the AM, I was *very* angry to find out it was a telemarketing call.

decide to go to kidsfirst.org and found big company sponsers for this org. and emailed the companies to complain that kidsfirst were violating no call registers. wonder now if they'll care.

Called our daughter's cell phone - made her very nervous - we found this website and decided to call "John" ad nauseum - we called back repeatedly and left very specific verbage and instructions on how to "follow the white rabbit" - DO NOT say anything affirmative like "YES or OK".

REGARDLESS of whether you're on the DNC or not, companies are not supposed to use autodialers that result in you being charged for the call (I got the call on my cellphone).

Company selling films will pay $70,000 over No Call complaints in agreement obtained by Nixon

St. Louis, Mo. — Two companies that market and sell films will pay $70,000 to the state of Missouri and develop a detailed plan to ensure future compliance with the state's No Call law according to a settlement secured today by Attorney General Jay Nixon.

The assurance of voluntary compliance, filed today in St.Louis City Circuit Court, was the result of a lawsuit Nixon filed in March against Feature Films For Families Inc. of Murray, Utah, and the Dove Foundation of Grand Rapids, Mich., alleging the companies conspired in a scheme to evade state No Call laws. Telemarketers from the Dove Foundation claimed its status as a charitable organization provided them with an exemption to the Missouri No Call law. In reality, the Dove Foundation was using that status to solicit sales for Feature Films For Families, a for-profit organization that sells DVDs and videos. The Attorney General's No Call unit recovered almost 300 complaints about the calls.

“Companies such as these that look for new ways to circumvent our No Call law are another illustration of how effective our Missouri law is,” Nixon said. “We always have been, and will continue to be, vigilant in protecting Missouri's consumers from unwanted telemarketers and will swiftly take action when there is a violation of the law.”

According to the agreement, the Dove Foundation and Feature Films For Families must pay $70,000 to the state Merchandising Practices Revolving Fund and obey all merchandising practices and No Call laws in the future. The respondents must also provide the Attorney General's Office with a detailed plan of practices and procedures they will implement in their businesses to ensure compliance with the state No Call law. They have also agreed to subscribe to, and remain current with, the Missouri No Call database.

Any future violation of the agreement by the respondents could result in contempt of court proceedings and civil penalties of up to $2,000 per violation.

I got this call from John about this crap a few weeks ago but came from a totally different number. They called me again on this number but I didn't answer. Last time, it wouldn't stop calling until I answered it and listened to the recording. If you don't speak along when it asks you questions it hangs up and calls you back another time until you finish the call with it. Very annoying. My b/f also got the same call the same week when it was bugging me a few weeks ago.

Just got the same call today on my cell while I was at work. My mother got a call on her cell minutes before they called me? How can this be a coincidence? My number is so totally different from my mother's number. I would understand if they are randomly dialing numbers and the numbers are similar, but my number and my mother's number are very different. Makes me believe that this person is somehow hacking into telephone records and finding numbers that way. How else could whole families be getting called. I will check with my husband when he gets home from work and my daughter after school. I sent in a complaint to the do not call registry. I didn't give the dude much of a chance to talk. I first asked if this John was a person and he laughed saying did he sound that bad. Once I knew it was a person I screamed at him asking him how the hell he got my number. Oh we're just randomly dialing numbers he says. I tell him to lose mine and hang up on him. I absolutely HATE telemarketers!

I just called 530-6601 and tried to report this. I was told that I had to simply tell them "take me off of your calling list". How many times must we do that? My husband was treated very badly last time they called. He hung up and they called right back asking for me and was very rude. They call and bug us nearly every day. I was once a fan of Family Feature Films. I am now getting a bad taste in my mouth for this company. That's so unfortunate.

OK I got this call today. Didn't answer it. Read the comments on this page did a google check. It is a new movie coming out Feb 20, 2009 and it is put out by Feature Films for Family. They are the fanatical family movies movement people that can hound people mercilessly with phone calls attempting to sell their G movies. Their cause is good, but they tactics are horrible. I own several of their movies. But I hate being solicited on the phone. Luckily I am blessed with caller id and do not answer calls that I don't want to, or do not know who they are.But my curiosity gets the better of me, and I google the number to see who the heck is calling. I am also on the do not call list, which I personally think is a joke. It seems like I get more solicitations now being on the registry than before.

Called my cell number that is listed on the government do not call list. When asked how they got the number, the response was something about calling all number combinations. Some BS advertising gimmick for a movie - go see the movie and get $$ off their DVD's. Wanted to leave me a "voice mail" with a "link". Whatever. Had to swear at the "voice" to get him/it to stop talking and demand never to be called again.

I received a call from John on 02/17/2009 at 1528. Something about the Velveteen Rabbit. I basically told him to f-off. My cell phone is on the Do Not Call registry. I filed a complaint with them and will file one with the FCC and whoever else I can complain to. How did they get my cell number? I don't give it out. Sounds like some kinda scam. However they got my number sounds like they or somebody else is doing something illegal.

My call was basically the same as "Jeff Doc"...When I answered a gentleman informed me that it was NOT a sales call and it was to talk about a new movie coming out called "The Velveteen Rabbit". He asked for 40 seconds of my time. I told him he already used 10. He told me of the new movie coming out that is for family and adults alike and that, instead of spending tons of money advertising, they are making calls asking people to go on opening weekend to keep the movie in theaters longer. They said that if I go and don't like it, I'll get a $20 credit from the movie producers towards a DVD purchase of any of their other movies. Then he went on about calling back, the phone won't ring, but he'll leave a message. I tried to be ncie (in case it was a realy person) and said I didn't want any calls and he kept talking over me. Then I just hung up on him.

some random guy called both our cell phone lines on Feb. 11 at pacific time of 8:13 pm and 13 2:10 pm 2009 saying "this is not a sales call" so we both hung up on him. How do these people get our cell numbers. We are on the no call list. I also got a text saying something about a "John" too. How do these people get our cell phone numbers? It is so annoying. The Government should do something about this, it's wasting our minutes.

They must be ashamed because one doesn't link to the other. There are hunderds of complaints on the internet against these people.

If you know for certain this is from Kids First, If you go to their web site you can find a list of their sponsors, they are mostly national companies. Take down the list search the web for contact information and write these organizations asking that they stop sponsoring Kids First. You can also get copies of their board of directors , most can easily be found with email address on the web. Write the directors, most don't know this is happening. Also direct questions to news media in the city in New Mexico that Kids First is located. If they get a lot of emails, they may investigate also. Don't count on FTC.You need to be proactive and protect your cell numbers.

I was called 2-13-2009 at 8:07pm PST

It was a real person, not a recording. He was fairly polite, but when I was trying to explain that I do not want to receive any more calls or voicemails he hung up on me.

I am now making it my mission in life to utterly destroy this movie!!!

Well, maybe not but I am going to tell people not to see it.

I wonder if this is just a test to see how people will react to this kind of marketing.

They also said that they would leave a non-ringing message on my phone the day before the movie premiers (Feb 20th) to remind me to attend if possible. He was very nice and was not pushy at all...just simply gave me the info. He was very polite and never asked me for any personal info or to actually buy anything...only to attend the movie if I am able to.

It was an annoyance to get a marketing type call like this...especially when my number is registered on the National Do-Not-Call list...but I don't mind if it's VERY infrequent and non-sales related and short like this one was.

Received this call about two hours ago on my personal cell. I told "John" no thanks when asked to do the survey, then proceded to ask to take my number off the list, but phone call had already ended. My husband just received the same call and same response. I called the number back, immediately asked to speak to a real person, talked to a girl, I couldn't understand her name. Asked her to remove my number & my husbands number. I told her I was going to report her to the FCC & my state, she said they were non-profit, so they couldn't get in trouble. I asked how they got our numbers, she said they randomly call phone numbers.

Computer calling every cell number. Advertising a childrens' movie. If you ask the recording questions you get transferred to a real person to complain. File complaints with the FCC and your state. These people have made themselves famous for their illegal marketing activity. Not a good example for your children.

Everyone in my office got this call on our personal alltel cells. This was a live person. No recording. Alltel advised they do not give out cell numbers to anyone...

There is no 'upcoming movie'. The last remake and release for the title they are telling you is 2007 and it was 2 different versions. IMDB is your friend.

I got this call a few minutes after I had called Radio Shack.. I have never been called by spammers, or whatever they are untill I called Radio Shack.. anyone else have this situation... I called Radio Shack and asked if they had sold my number, and they laughed and said no.. but it wasn't but 1 minute after I hung up with them that I started getting this number and some text messages from people I didn't know...

Got the call on my cell at around 1:40 pm on 2/12/09. JERK!! How did he get my number?
Called the number back on 2/13/09 and he went through the same junk about an upcoming movie. Said he was with a group called Kids First, I think it's B.S#I7.

what we need to do is call back, then call back again, then call back again & again & again. if a viral call back campaign takes off, this guys phone will be tied up, not to mention u cant' make outgoing calls when your incoming lines are bogged down. with call block and free LD, make as many as you can, give these people a TASTE OF THEIR OWN MEDICINE!!! get calling...it makes you feel good as well, put it on mute and have some fun!!!

This makes no sense at all, the mofo calls me at 9:43am and I'm like 'huh...Ok.' and he repeats what he says and I say 'Ok.' once more and stay silent. I hung up afterwards. If I get any telemarketing calls on my cellphone I'm going to be pissed, I have no idea how they got the number. It's a prepaid cell phone for crying out loud! I've only given the number to like six fucking people. The last thing I need is for telemarketing calls to come in on my cell phone.
