Darn thing is, Peg, you're both right and wrong. The FDCPA makes two demands of third party collectors which are sometimes in conflict. A collector must make ''meaningful disclosure'' of its identity yet respect the privacy of whoever is named on a debt account. Voice messaging puts agencies in a bind and gets them sued about the same no matter which rule they favor. The famous ''Foti v. NCO'' case led to the wide adoption of those clumsy canned messages which try to make a person self-authenticate. Hence the absurd commands to ''stop listening if you're not the droid we're after''.

My own vote is to drop the idea that the mini-Miranda alone, with no detail about the account, creates shame or violates privacy. Really now, consumer debt is as common as dryer lint. If you don't have it, you know someone who does. Not exactly hot gossip there. I as a recipient would rather know who is calling and why than have to scrounge around these blasted forums trying to guess, and I've long argued the lack of disclosure only helps the collectors drape in mystery and seem more frightening.

Collection industry lobby ACA has been crying for months about ''communication'' prior to Liz Warren's new CFPB opening for business several days ago. What they want is to pester people freely via all the gizmos which weren't invented when the Act was first drafted. The big problem is that communications via fax, email, social sites, and whatever is next are hard to admit to court proceedings. Clearly it's not about consumer convenience but leverage for the lawbreaking collectors.

Bianca won't be coming back after three years to defend her remarks, but they are of a type which comes up a lot in debt collector threads. The kneejerk response of ''just call them back'' to make corrections makes a faulty assumption that debt collection agencies are like customer service centers, and actually care about details. You are not their customer, you are a funding source to be trapped and bled dry. Whether or not the correct person pays doesn't nuch affect their commissions and/or backpats from the pit bosses.

''Wondering'' is correct, the calls are very often not placed by a human, and in fact under the usual business model practically all of the account handling is on auto-pilot. Why? They expect you not to defend yourself, just roll over and send that check, just take a nap when the process server knocks. This is easy money for them. The moment you increase their difficulty, even a few degrees, you multiply the chances of not being hosed for fraudulent debt or accounts you cannot repay.

It must then be said, because it's so cheap and easy for ALW and its ilk to keep piling on the calls, that call blocking and avoidance is *not* a strategy, as Tyler indicated a month ago. Hiding out can lead straight to a default judgment, and at best you could miss a golden opportunity to turn the collectors' own dubious tactics against them. I'm not saying you need to *answer* each call, but prepare to act upon each, making careful note of what was said and done in light of all relevant regulations.

Now in March maybe Alan found the one rep within all of ALW willing to follow FDCPA strictly and accept a verbal cease-comm. Maybe the calls quit there. But there is no hard proof that status change was made. It will not be in a collector's interest to fork over any proof, either. Until ALW sells it off there is little to prevent the same account from returnng to its active pile weeks or months later and start generating another series of calls. In Alan's place I'd rather spend the $5.54 on the legal assurance of a cease-comm than play autodialer roulette.

To Bianca, This sounds good; however; it do not work that way I have to disagree with you , these calls are on robo call, and they are coming from out of many different offices around the country, and in a lot of cases they are coming from out of the country. There is something going on. I have tried many time to make contact with these people with no success. Business who want to right off expresses at the end of the year use this kind of practice to hide what they are really spending the money. They really do not have people in an office they just employee the equipment for robo call and that is it there is a computer that records all the calls that they make as if real people made them, in other words this is another way to steal money from people.

I intended to mail a certified cease and desist letter, however the gentleman to whom I spoke noted that I did not wish to be contacted again by phone, but that I am requesting they constrain all correspondence to the written variety. We'll see if they honor that. If not, it's time to send some mail.

They could find it Robin, but skip tracers always begin with whatever is already attached to the account being worked, the 'last known position', if you will. This is on the theory that the elusive party may not actually have gone far, and a person responding is probably lying about it.

Debt collectors get away with repeated skip trace calls until the agency thinks the intel it gathers is reliable. Obviously this is a watery area for the laws and is an often abused tactic. Again, read the Fair Debt rules and make your demands on Certified mail paper if you want them enforced.

They called twice today, with "robocalls". No one answers when i pick up the phone -- just a robocall droning away about being an important message and an attempt to collect a debt. Earlier today i got off the phone with NCO -- who was trying to collect an alleged debt from a previous roommate (who had left my home YEARS ago !!!) NCO had been robocalling also, but finally a live person picked up the phone and talked to me. These companies should have much more recent information on the alleged debtor and thus be able to contact that person, without harassing me.

I am fed up with the robocalls. Are these companies actually allowed to keep harassing like this?

(By the way, I don't owe any debt, always pay my bills on time and in full, and have excellent credit. So it is extra annoying to get these robocalls about attempting to collect a debt....)

Suzanne, one good reason for answering a junk debt buyer call, if only just once, is to verbally establish caller identity, preferably with a recorder rolling. That makes it simpler to build a harassment count if an alleged debtor files suit. Some people who ask the right questions prompt collectors to commit yet more damning violations for the pile.

So Rich, you're almost eight years into B/K and you sound aware some of those calls were at the wrong times. You may have enough to crush ALW in court.

calling everyday for weeks at various times. never answer these dirtballs. They are a zombie debt collection company which buys outdated debts for pennies on the dollar, sometimes even beyond the legal validaty limits and tries to browbeat people into paying debts even if it's not valid or expired. If you do answer, they add your name to a good number list and then if they sell the debt to some other zombie debt collector, they report your name and number to them as a valid number. Don't answer them the first time. If you don't know them don't answer. use caller ID, block calls, and post here and elsewhere when you get these calls

Receive calls 3-4 times a day no message hangs up after 3rd ring. this place has called between 9-10 pm at night as well as before 8am in the morning. I filed chapter 10 and was granted it in March of 2003.

I have been receiving a call about every month and now they have increased it to once a week or more. Mine is just a recording saying what company it is, call the number and ask for Ron Jackson. Can't even say anything to them. I usually just hang up before they are finished. I don't and never had any debts. I have been afraid to call the number not knowing what I might get envolved in. How do we stop these calls. They call all hours of the day and night. I'm sick of tired of picking up the phone and hearing who it is.

JeanGrace and Shimholl: It is your choice to answer or ignore the calls, but do not ignore collection activity completely. Watch your credit reports for suspect trade lines and document calls for signs your rights have been violated.

According to the law, once a debt collection agency places a call to you, they are then bound to send you copies of the past due bills you owe to prove your liability of owing the debt. This is supposedly a DEBT COLLECTION AGENCY out of Baltimore, MD. They call and claim that you owe money but they never send anything in writing, which they are required to do by law within 5 days of initiating contact. For all anyone knows, these could be a bunch of SCAM ARTISTS or IDENTITY THIEVES. They have a website, but so what? ANYONE can create a website!! They are persistent, too. They call 2 and 3 times a day. Just ignore them or hang up on them.

Hey, Ex, I admire your conscientious objection. I get so weary of defensive posts from call center drones who know they are in the wrong but keep justifying their paychecks with selfish excuses. Given the volume of complaints in this thread, I doubt I'd have lasted three weeks in your old job. There are several consumer forums on the debt industry that would love to hear from you.

Disgraceful but true, a collector can work an account until the end of human time, but once past your state's SoL cannot get a judge to help. Hence all the traps they set to re-age old debt, a strategy which the next revisions of law really need to address.

If you are receiving misdirected or abusive calls from a third party debt collector, you may find relief in the provisions of the FDCPA, which regulates collector behavior and provides you simple tools for your own defense. It grants you control of how you are contacted, and collectors can be sued for their crimes. Learn your rights and first response tactics at FTC-dot-gov.

I am a former employee of ALW and I can say first hand that they r scam artist! I worked for them for three months and I hated lying to people about 20 yr old debt. I quit because I couldn't face myself in the mirror everyday knowing i was a being dishonest. They're protected by the law because companies write off the debt and sell ur info to ALW, read ur fine print for these credit and store cards. That's why it's legal for them to call u.
That doesn't mean u should pay them, don't! The collectors get a commision and the companies gets more debt to buy! This is a scam flat out! They can not call u once u tell them to remove ur number. That's the law, if they continue, contact a lawyer!

I got two calls from this number today and each time I answered and said "Hello", an automated voice replied "Good bye". WTF is that about? Luckily I have a phone to where I can BLOCK their number. Then the call will NOT come through. I will be doing this, since everyone here seems to be stating that they are scam artists! Thank God, I am not alone in my feelings of complete frustration and utter Rage. Prior Exs with Debt Collection. This company continues to call. Now my 10 year old is receiving the calls. He is very anxious about this. Afraid his father will be locked up. This debt collectors are victimizing families as a result of the debtors they are seeking. I want to file a complaint with ABA and BBB. Could use some help here. This man has not lived in my house since 2002.

Call your local phone company to see if they have a service called "Call Intercept".. there is a monthly charge to have this service. With "Call Intercept", you can block any number in the United States. I have "Call Intercept" on my home phone thru Verizon and I am able to block 25 numbers. The person calling your number will get a recording saying "THE PERSON YOU ARE CALLING DOES NOT ACCEPT CALLS FROM THIS NUMBER, GOOD BYE." It's GREAT blocking Portfolio Recovery Associates from calling all day from different numbers. I am hoping that Verizon will extend call count from 25 to 50 numbers.

I started getting these calls from Alw Sourcing and then Ron Jackson about three weeks ago. The call is always a recording asking me to call back and ask for Ron Jackson in regards to a debt collection. It seems odd that these calls started about three weeks after I purchased a new car. My credit is very strong and any debt I have would have been charged off more than 9 years ago. If it is old debt they are calling about they want you to admit to it and then they will start new collection proceedings. This is a scam!

i have received Numerous telephone calls from the above number 888-379-4884 instructing me to call me "RON JACKSON" at another number...then i am read some creditors rights informing me i owe Capital One ...WHICH BY THE WAY IS FRAUDULENT!!!!!!!!!!! to date by the caller id i have receive 17 calls in 4 days!! I informed them each and every time to cease and desist calling me..so i am getting ready to file a formal complaint each offense towards me is at least $1,000 or greater ... please these people need to leave innocent people alone...trust me i will get paid by this outfit!!!

They started calling 3 weeks ago and to call back and talk to Ron Jackson with a control # they left on the phone. I have tried 2 times to call them back and can't get thru. Now i know why. Glad I googled this name and found this stuff out. now i will work at stopping them. they have been calling everyday or sometimes twice a day. weekend ,late and early as 7:15 am till 9:30 pm . lots of scamming going on and now this group here, turning it over to local since they are hot on this stuff. Doubt anything will happen, but will try.

They call everyday, recording tells you to Ron Jackson. Called back today, female voice on line asked me my name and said that she would be recording my call. I informed her I was also recording, she said "I do not allow you to record this call", I repeated that I was going to record the call as was instructed by my state attorney generals office and she hung up. Tried to ask when this debt, that does not exist, was incurred. That was about the same time she hung up, no response. Most states have 5 year statute of limitation and if you tell them that without admitting to any bogus debt, they are required to cease calling.

I work at home (on the phone solid, all day) and receive at least 3-4 calls from this company daily. Late at night, early on the weekends. I have minimal debt...Very minimal. Have never been late on a payment and have excellent credit. I don't have anything past due or overdue. Yet they call here constantly. Most of the time when I answer, there is no one there. I've tried telling them they don't have the right phone number, and they continue to call anyway. I am trying to conduct business here. Their time would be better served collecting the proper data, calling the right people and perhaps leaving innocent people alone. To ALW Sourcing any anyone affiliated with this company: EAT SHIT AND DIE.

Gotten several calls from this number about some debt collection. I've never owed anyone anything in my life and I've never failed to pay a bill. Every time they call it is a machine on the phone instead of a live representative, which is annoying. Will be blocking their number shortly since they don't have the decency to have a live person call and figure out they have the wrong number/person.

Call them back regarding a collection. We are on National Do Not Call List, so should not be getting these calls. We do not have any overdue bills, so don't know why they would call.

2nd call today from ALW Sourcing. This time I answered the phone on the 3rd ring. At firt I thought there was a human on the other end talking to me but as soon as I said, "I have been wanting to... (going to finish saying, "talk with you", but in hindsight it sounded like a recording because as soon as I started talking I heard 4 introductory related sound/words and then they hung up. I believe now they have proof someone is here with that number. I know very well that I owe some bills and my credit score is not the best in the world and the same goes for my wife. We don't answer unavailable, out of area (unless of course I recognize certain phone number like family), not provided or any 800, 866 or 888 calls since my family and friends do not have these numbers.

These idiots constantly call. The one and only time I answered the call they claimed my husband owed thousands on an old Amoco account. When pressed for more info, they claimed it was from 1982! My husband had an active Amoco acct for years that we finally canceled due to LACK OF USE. It NEVER carried a balance and fell off his credit report a few years ago. We can't figure out where the heck they are coming up with this faulty info.

BEWARE - they are clearly zombie debt dealers and who knows how many other false accounts they are harassing people about. Keep a close eye on your credit reports!!

Reading about who ALW Sourcing reprsents (Lane Bryant), I know exactly who they are after - my ex husband's dead wife, well, they are both dead now.

They call constantly.

I just blocked their number (had to order the service from the telephone company of course). When they say they are trying to collect on an old debt, I know darn well I do not have any. I have a 795 on my credit and plan on keeping it that way and trust me, a bad debt would not allow me to have that kind of a score.

I never answer 800 numbers. I get calls several times a day, every day, day and night, including weekends from these people. The calls come so often I finally changed my recording to say:
If you are a relative or a friend, leave a message... you know who you are... But if you are a telemarketer, a solicitor for any so called non-profit agency, or a bill collector trying to collect a debt or locate anyone at this number, don't bother! I consider your call as harassment and will report you!

This company has been calling about a account that was charged off in 1997, I have sent cease letter I have filed complaints yet, about once a year they start the calling using a different company name, a different phone number and to add to our unemployment they now use machines to call. When you do talk to someone they are either hungover or suffering from PMS the bottom of the barrel

ALW Sourcing, LLC is part of the chain from Lane Bryant, World
Financial, NCO Portfolio Management, and AssetCare, Inc. Others,
under the NCO aegis, also seem involved. In essense, they trying to
collect on a old bill that Lane Bryant has sold to them that dates to
the year 2000. Repeated requests as to what was purchased, where
it was shipped, and why didn't I/we hear of this before 2008 are
never answered. Also, why our credit card wasn’t charged or a
personal check returned. After all, retailers usually have payment
in hand before any shipments make it out of their warehouse.
Amazingly, I have discovered that my family did move to Missouri
& then returned because 1 of their agents was quite surprised that
we would move back to the exact same address in Michigan. A
formal complaint was filed with our city police, but that's only
something 'to have on record'. Identity theft is suspected or a huge
record keeping problem at Lane Bryant had occurred. That will
never be discovered until someone on their end actually renounces
the doctrine of Lane Bryant infallibility. As to what you can do to
bring focus to this situation is a bit complex, but bear with me. 5
women were MURDERED at a Lane Bryant store in Tinley Park,
Illinois. A $100k reward was announced on Fox News in May of
last year. I am of the opinion that the killer is someone NCO &
Company pushed over the edge trying to collect a bogus bill.
His name is almost certain to appear in one of their Chicago area
‘deadbeat’ accounts. Tinley Park Police # 708-444-5394. If you
agree, give them a call. I have twice now. This may catch a killer
and if so, shine a great light on this entire situation. I have no
trouble sharing this reward or establishing a trust fund for the
children of the victims. To get them to cease & desist requires
court action on your end. Your local Consumers Protection
Agency can accept your complaint, but NCO’s apparent tactic
of selling your ‘paper’ amongst themselves sidesteps the legal
restraints Congress (Fed & State) has put upon them. Good Luck.
