A message to the specialist that works for this company, I get an average of three calls a day for someone named Tabitha. This number started calling me a few weeks ago. They call at odd hours (night, weekends, and once at 5:00 in the morning) so I haven't answered until today. They ask for me, I say "speaking", then they ask for my social security number. I ask who they are and what this is about, all they will tell me is that they are RPM Financial "we're a financial institution" and that is all they can tell me until I give them my social security number to verify who I am. So I ask again what this is about, I'm not going to give my info to someone cause they say I should and the dude gets an attitude and tells me that he needs me to verify who I am and tells me to call him back when I can figure out my social security number.

To Tired: What they are doing is a Federal Law violation (not the DNC list either). Skip tracers (which is what these clowns are) may not call a business more than 1 time for any person. The fines can total $50,000.00 and you have the right to sue them in civil court for up to $100,000.00 plus costs. Step 1: Go online and secure the forms from the Federal Trade Commission and file a formal complaint. Step 2: Trace the call to the company/individual and send a letter stating you now consider "them" a "hostile agent" for whomever their customer is and you will notify said customer of their behavior and sue them along with the skip tracer. The "hostile agent" embedded in a letter tells everyone concerned that an attorney is now involved and usually stops future calls. They also don't want their customer threatened, especially if it turns out you are not the party they are seeking or related to them in any way. This idiot really messed up and you have the upper hand. Good luck.

Tired, you're not helpless as an employer. In fact, you get special mention in the FDCPA. As I discussed here in February, hostile skip tracing is common from this industry. Part of the scthick is to insist you're a liar until you either give yourself up or open the broom closet where the alleged debtor is supposedly hiding.

That sort of hounding with layers of cursing and abuse is illegal. You've a cause of action to spank RPM and the individual reps in court. The next official-type links will start you on your homework.


Verbal demands are totally useless against your attack dogs, so you need to move to a paper trail as I've also discussed before. Save copies of all phone calls if you have a recording system and take copious notes every time you have an encounter. You are gathering evidence which you will need badly.

I am an employer and this company has called so many times for an ex-employee I have almost lost my mind. I have told them to not call. I have explained she no longer works here. I was told that he will quit calling if I tell him the truth and give him her phone #. I have no contact with the former employee & her unpaid debts are not my concern. They call third parties to alleged debtors all the time for permitted skip tracing purposes, or often pretending it's a trace to annoy and shame an intended target whose location is already known. It is not considered a ''bullshit scam'' when collectors are looking for money lawfully.

To a ''not me'' case I always recommend putting the agency on notice, just as you would if you were the target and the debt claim was invalid. Send a ''cease-communication'' notice via USPS Certified with return card. This is the method promoted by the FTC and many consumer watchdogs, and the only way to set a legal landmine, as such a notice is ignored at their risk of a lawsuit from you. You may already be due some payback if you can prove you've endured abusive or misleading treatment in an effort to collect debt.

As I advised here 18 months ago, you can learn how to exercise your FDCPA rights as an alleged debtor at FTC-dot-gov. See also if your state laws are stronger.

Then suddenly he's your pal when you drop your healthy skepticism, handing over his phone extension to secure more commissions. He wants you to ask "How do I pay" before you demand "Prove I owe"! I've received many many calls from "Rachel" offering to get me a lower interest rate on my credit card balances. Several times I dialed "1" and spoke to another individual who attempted to query me about the amount of my credit card balances. Sometimes I went along with their game for a bit trying to find out more about the caller's organization. One of them told me she was calling from Orlando, Florida, but was evasive about what they were about. Eventually, each time I asked them to stop calling me, sometimes politely, sometimes profanely. A couple of days ago I filed a complaint with the Do Not Call website. But I wasn't able to give them a telephone number for the nuisance caller.

Oh yeah, there is a new wave of these toner sales scammers being reported on 800Notes as well. As reported prior, the idea is to gain the confidence of some unsuspecting office drone. Soon afterward your workplace is likely billed some obscene amount for the cheapest and crummiest toner carts they could find on a Chinese boat. Technically no order was placed and the initial caller engages in pretexting to make the ''sale''. Nonetheless the scammers will pound the victims with threatening collection calls.

You're hearing abandoned calls from a predictive dialer, Kim. The FCC likes to see no more than 03% of such calls dropped. You can go with some blocking routine, but you give up your FDCPA rights by not sending AI a cease-comm notice via USPS Certified with card. The FTC and many consumer watchdogs explain how to draft one.

You should, however, be certain you are not the alleged debtor they want. If this is in doubt, wait for a dunning letter or absent that, request validation. If you are the target, you don't want to give the collector an easy excuse to file suit.

George, where has the attention span of consumers gone? ALL of your broad questions have been addressed in this very thread in the past three months. I understand your frustration, but complaining into dead space and waiting for a rescuer is pointless.

To your one specific question, debt accounts are traded in huge bundles. The more they are passed around the more corrupt account data can become. There are too many reasons to list why some total stranger several states away could be linked to you, but this is a fairly common problem in the collections industry, as is the willingness of agencies to accept hush money from anyone who answers.

Upon researching through Google, I found the I C Systems website. ICS is apparently not a part of PayPal. It is a debt collection service. From the comments on this page, PayPal apparently uses their service to attempt to collect money owed to them.

She would not tell me why she was calling unless I gave my number. I said I was on the "DNC" list, and she started playing word games with me. She kept telling she could not do anything unless I gave her my number. Since she obviously already had my number, I gave it to her, and she said she was calling for Dave Berkely. I had never heard of that person, and she said she would take it out of the system, and I should get no more calls from them after today. We'll see.

"Honastly", Megan, you have not actually read anything in this thread, which is typical behavior of collection industry trolls who like to toss their poorly spelled and composed cherry bombs into these forums. Nobody here is complaining because their fiendish ten year plans to cheat the banks were thwarted. These comments are about the number one problem across the debt collection industry, hassling people over accounts with wrong names, wrong amounts, and/or uncollectable dead ends.

But it does not end there, for like the industry as a whole, this Niagra feels no shame in trying to revoke people's Federal and state rights in pursuit of a fast payday. Even if every point of a debt claim can be proven, it does not excuse the hostile behavior reported. Don't preach to alleged debtors about responsibility until the collectors display some.

Debtors did not have a gun to their heads to apply, true, but the lenders were not forced to play their calculated game of teasing and penalizing to keep their customers in constant jeopardy until default is the only option. Most credit debtors are underwater not by choice but circumstance, having been forced to feed children and pump gas and medicate the elderly on borrowed time.

Are all of you serious? I will definatly admit that there are always some exceptions to every situation. Its extremly ignorant for anyone of you to state that the collectors are scum. Brian Adams from Office Support Systems contacted me months ago (roughly sometime in August of 2010). He lead me to believe that he's affiliated with Xerox (we have a Xerox copier) and has toner for a reduced price, and the offer will not last long so I should place an order to save the company money. I unfortunately bought into it ($798 plus shipping and handeling, what a rip off!).I was under the impression that I'd receive one single package of toner, pay the invoice (unfortunately we did) and that would be that so to speak. Months later (Nov. 2010) I received an unexpected second package of toner that another employee signed for (I was out sick. Had I been present, I would have refused to sign for the package). I called and spoke with customer service which lead to eventually getting connected with Brian Adams.I explained to him that I was not expecting a second delivery and would like to return the toner, especially since we already have several that haven't been used just yet. Brian claimed that what I agreed to is a package set up (you receive two toners), that's the way it works;therefore I cannot return the toner. He then acknowledged that someone should have explained this to me and offered to take 25% off the invoice as a result; asked for my fax number so he can fax the invoice. I spoke with him again about the matter and he blamed me since I was the one that placed an order. He also said that "we don't do charity cases." He also claims that he did not speak to me initially. I don't think we should have to pay period. In fact, we should be refunded for the first rip off and the second invoice; we should have no obligation to pay on the basis of deceptive sales practices. I've complained to the attorney general as well as the Better Business Bureau, and Federal Trade Commission may be the next point of contact. What is really sketchy is I can't seem to find a website for them, no email address and the location address I've initially seen is as follows: P.O. Box 93552 Los Angeles, CA 90093. Telephone: 877-333-4320; Fax: 877-333-4319. Another address has popped up for them through research (CA BBB): 1013 Madrid Ave Torrance, CA 90501. On top of that, I noticed a third address (shipping):1618 N. Las Palmas Ave Los Angeles, CA 90028 Also, they are only open 7am to 1pm during the work week. After I filed a complaint with BBB, another scam artist called to ask what the company name is (wouldn't you know in the first place!?). The number popped up as 213-537-1910. I called back to see who it was and got a busy signal. I don't think it would be far fetched to assume those A-holes are associated with OSS and are trying to scam our company once again! I still can't believe I fell for this. Typically I can tell when a call is from a telemarketer trying to rip you off. Please learn from my naitivity! Don't give out your name, better yet, don't give out the company name either if you see a strange number! Hang up on them! And don't accept packages from them if they try to send you toner you did not order anyway!

First of all in the state of NC you must first state that you are a debt collection agency and that you are attempting to collect a debt. Mike: I'm not sure how much you'd be held liable for your Mom's debts in your state, but my reaction would be the same for a living or dead debtor. Get the collector to validate, if it can. It's not your job to verify anything they think is owed.

I've told them all, there is no money...my mother just did not have any money and there is nothing in the estate. Since they got my name, I am now an authorized person to discuss the account. I respond to this sort of call in my usual manner...either in Japanese or Korean. I have also been known to say "Hello" over and over again, pretending I am having trouble hearing. I give this as my telephone number and turn the ringer off. I check it daily to see if there are any real business calls. I have changed all potential nuisance calls to that number. Got this number. I do speak Spanish, but I need a few seconds once I realize I'm hearing Spanish to actually understand it. The first part sounded garbled, The tail was "...to receive your money". They used the familiar you (tu) to address me, instead of the more formal Usted. Most places, that would be considered somewhat rude, but it depends, and that is changing.

It wasn't a recording, but sounded like a voice synthesis system. The inflections didn't sound natural. I tried to talk to it, in case there was some voice recognition, but it hung up on me.
