Basically, the call NEVER connects to your phone, or on their end of the phone.....they hear NOTHING, it just HANGS UP, like they never called you. It just (like I said) POOF drops the call w/out ever ringing, but will STILL show in your call log. GOD I LOVE THIS FEATURE. Blocked a crazy ex boyfriend. lol.

If you have a newer phone, find out if you have "Call Reject List" -- add them to the list. When they call your number, the person calling you won't even hear the phone ring, the call just "poof" drops and won't ring. AND you won't hear them calling, it NEVER makes it to your phone ringer. BUT, the good thing is: You can opt to "see when they call" as in, it logs into your call logs. OR you can NOT see that they call. I choose to see when the person I "Call Rejected" their number calls, so I know how much their stalking me. lmao. GOOD LUCK.

Cheryl, your callers do not maintain this site or this web page. Your callers cannot magically determine which numbers should not be called based on anonymous comments. To halt the collection calls you must give notice *directly*.

My husband keeps getting calls on his cell, asking for Anthony Peschke. Which is not his name and never has been, Peschke is MY maiden name, and we got married 2 years ago. Why would someone have My husbands last name as my Maiden name?
It calls all times of day even way early in the morning and wakes us up. It's just some recording that you can't get through to tell them that you aren't who they're looking for, and doesn't tell you who it is. Collection for what, what company would we ever have started an account with the name Anthony Peschke?
I first answered it because it was early in the morning and I thought it was the work security center that will call him, as a Manager, to give information about the store's security. That number is 612, this one is 617, so he got woken up for nothing, so I saved the Security number under his contacts, so as not to mistake 617 for 612 again.
If I could ever get someone on the line, I'd tell them that name doesn't exist. You can't get the name right, then I don't need to talk to you or call you back.

Sorry, Linda. I was responding to Densha just before you. I didn't see your entry at posting time. Requesting call cessation is not a problem, but demands to "take me off the list" are unrealistic. Collectors don't keep a master list in the telemarketer sense. Calls are made per the contact data on each account and to others thought to be of possible assistance in skip tracing. I can imagine your "common name" is like a magnet to those agency drones.

You're right, one verbal cease-comm request should suffice, but it usually won't because it's harder to prove. Courts vary a lot on how you can use recordings in Fair Debt cases, while paper demands are more easily recognized. It still doesn't hurt to create recordings to catch offenses, and it may help you to know that the "two party consent" crap no longer matters.

In August 2010 the U.S. Second Circuit Court of Appeals ruled that single party consent is just peachy for recording the phone person-to-person, so long as your intent is not in some way criminal or malicious. Sure, you could hedge your bets and announce recording, but this often causes the rep to either refuse to continue, or grudgingly switch to Very Best Behavior. I say let the collector decide how far to stray from FTC regs, and let a judge or arbitrator decide what's admissable. Roll those recorders quietly and with confidence.

Asking to be taken off the list is a legitimate request.

I record the conversation so that I'll have proof that I asked. Legally, I only need to ask once.

The state that I live in is a "two-party" state, so I have to tell them I'm recording for the tape to be legal.

I also photograph the caller ID and keep a complete written record of each call.

I have a very common name and am listed in the phone book under my first and middle initials, so I receive these calls on a regular basis.

So far, I haven't sued anyone but I have the records that would enable me to do so if I so choose.

Yes, how not very original. Blasting whistles and horns, prank return calls, rickrolls and other obnoxious behavior are not valid countermeasures. They may in fact draw special attention to your case and accelerate the path to a lawsuit. Collectors work under stress all day. Do you want to be the one standing under the blast fallout? They are recording every word and sound you make. Would you like to explain to a judge your childish lies and rude cursing?

Oh, look, you kept them talking for a half hour with no results. Great job, Sparky, that must have cost them six whole dollars in rep and phone time at least! The rep failed to meet the earnings targets on the agency's whiteboard? No problem, he will be replaced by someone with no patience for your juvenile antics.

You want to raise their costs so badly? Document everything CCS does, look for violations, which a junk debt buyer sooner or later commits, and file Federal suit. Expenses are paid by the opposition when it loses. Don't just "settle up for around 33%", not if your damages meet or exceed their claim. You want revenge so much? Make them look desperate while you were calm. Make them pay _you_ to walk away peaceably.

Maybe if more than 0.5% of alleged debtors took the fight to the offensive collectors' own bank accounts as the FDCPA and FCRA allow, their chronic lawbreaking would cease to be a cheap business expense, and we might at last enjoy answering phones again. Else you can stoop to their level and encourage more of the same abuse.

I've always found that telling them that you are "recording the call for quality purposes," asking the caller to restate his or her name, and them asking to be taken off their list works very well.

They'll think you're planning to sue them whether you are or not.

It has been my personal experience that people tend to stop calling phone numbers where the party answers in Japanese or Korean. I have also found that the use of a Freon Boat Horn also tends to discourage unwanted callers. This is not to be construed as advice, just an observation. Feigning a death in the family also works well...as does a stream of obscenities...avoid hate speech...just stick to the usual f-bombs, etc. Failing at that, just say..."I have no intention of honoring this debt." That one really blows them away. Another good one is to keep them on the phone for as long as possible with circular reasoning...like, after talking with them for 10 minutes, say you have been recording them. If they say, "You can't do that!!"...simply respond with, "Oh, yes I can...and I just did...and I still am." This will usually result in a long conversation consisting of "no, you can't" and "Oh, yes I can." This will waste tons of their time and keep them from bothering others for awhile, which cuts into their commission. You might also tell them you are "judgment proof." Then refuse to answer any questions why. These people do not want to go to court; they want you to send them some money over and above the 3-cents on the dollar that they paid for the debt, which is often a zombie debt...and therefore, uncollectable legally. They will then seel the "debt" to an even sleazier company, at which time, you repeat the above steps. In short, waste their time and have some fun. Then, if they do file in SC court...settle up for around 33%...or, tell them you are going to the media. They really don't like that.

The DNC registry is for telemarketers, meaning sales. Charities, debt collectors, political speech, and surveyors are all exempt. This was made known to you when you registered your numbers.

Kimmie: Repeated calls with intent to annoy are a common collector tactic. It's illegal but somewhat harder to use as a defense compared to other common abuses. Document each call and look for an abusive pattern. Federal law does not ban calls on any day, but maybe your state law does.

I keep receiving repeated calls from this number, including holidays & today (SUNDAY) from this number. My caller ID doesn't identify the caller, so I won't answer it. I pay for phone service for my benefit & I will not answer unless I know who is calling & I'm interested in talking to them. They never leave a message either. You'd think that if it's sooooo important that they need to call you repeatedly, they'd at least leave a message for you to return their call.

The only people we owe money to is our mortgage and we pay that. Don't know why they call and hang up, but it does sound like a scam to me.

These people call me up to 6 times a day on my cell. The debt they are calling about is one that I have proven is NOT MINE.

This number is not a scam! I just answered the phone a few minutes ago, after checking on here earlier today. In fact the man I spoke to was polite and said that he was calling due to a (very) past due insurance bill. I don't give my cc info over the phone and told him to mail me a bill. He said they only mail one out if you commit to a date. I told him I'm broke (like all of us who dodge the dept collector calls and check this site to see who wants their funds before even considering answering) and he said they'd take a minimum of a $25 payment a month until paid off. So go ahead and answer the phone.... It wasn't scary and they will stop calling. :)

If you are receiving misdirected or abusive calls from a third party debt collector, you may find relief in the provisions of the FDCPA, which regulates bad collector behavior and provides a private right of action. It grants you control of how you are contacted, and collectors can be sued for their crimes. You may however soon find that your verbal demands to limit or cease communication, as allowed by the FDCPA, are often ignored. You will have to place the discussion on a paper trail to enforce regulatory compliance. Learn your rights and first response tactics at FTC-dot-gov.

As to these unhelpful calls some of you report, the FTC makes two demands of third party collectors which are sometimes in conflict. A collector must make "meaningful disclosure" of its identity yet respect the privacy of whoever is named on a debt account. Out of caution many collectors are gun shy with message recorders.

The name is blocked. As of today alone, they have called me twice. I won't pick up if the name is blocked. For the past three or four days I've been getting a call from them once or twice a day. They never leave a message. Whoever they are, they need to GET A LIFE!!!

Got a call while I was out from this bunch. I have a letter ready to go off to them disputing the debt. I canceled my auto insurance policy in January. Geico says March and that I still owe $22.25. In that letter is a cease and desist order, if they do what I read and ignore that request I won't hesitate to sue them for the violation of the FDCPA.

Also I am trying to rectify this with Geico themselves.

All debtors that transact with a collection agency for a debt they owe; should do everything in writing, the collection agency has a responsibility to request and acquire signature and provide you a copy of everything you sign but copy your own stuff because you should anyways! Debtors have the right to set up payment arrangements, pay by money order instead of banking info if they choose, mail in payments you are not required by law to provide your bank info and use the auto pay systems these collection agencies have, as a matter of fact... I did that and they shorted my account over $1,000.00 and submitted multiple dollar amts. I do not and never have owed.. I guarantee you, reimbursement will be made including fees! If you can't afford to pay a debt in collection, the agency is required to provide you with a financial statement document called "inability to pay debt" all you do is fill out your income and your expenses for a month so the agency can determine whether or not you are able to pay a debt by payments and/or at all... use and take advantage of what's available to you under the FDCPA and all laws of this country... if you are victimized by a collection agency, it will probably be because you "did nothing" to stop them and "use your rights under the FDCPA" it is written for debtors and creditors, use it to your advantage!

FYI, in regards to the following post about whether or not it will hurt you if you pay a debt in collection, in my opinion that is not exactly true...
Depending on who the creditor is, your wages and assets can be attached/garnished if it's the Feds, etc.
The advantage of Paying a Debt in Collection;
If you pay it 100% then it will be taken off your credit report in time, though it may stay on your report for awhile, it will show PIF and many creditors are good with that because they know you paid your debt.
If you accept a Settlement; sometimes we just have to and that's ok if it's the only way to repay a debt, however if you do a Settlement (SIF) then it will reflect that you paid a settlement and not the debt in full. That is not always a bad thing but it does reflect that you owed money and only repaid a portion of it.
Best case scenario to rebuild your credit; do not do a bankruptcy, pay your debts in full...
IF YOU CANNOT PAY IN FULL AT ONE TIME; YOu have the RIGHT to set up payment arrangements, most agencies will set up payments for a number of months, then ask you to pay the balance in full or if they are smart they will schedule out payments for you until the cows come home if that's what you need and it will look good for you because you are building a positive payment history and paying your debt in full!!!!
If you cannot pay and have to do a bankruptcy; Chapter 7 or 11 and wipe the debts out 100% many debtors have stated that by doing a Chapter 13 which allows you to only pay off a percentage of your debts not in full.. debtors sometimes will run up more debt during that 5 yr. period and... a Chapter 13 reflects to creditors that you owed money and didn't pay it back in full and .... Chapter 13 will stay on your credit report for 12 yrs.
Chapter 7 will allow you to regain credit cards and other credit in less than a year.
Chapter 7 will allow you to purchase real estate after 2 yrs.
DO NOT TAKE MY POST AS FACT, because the laws may have changed and I have not reviewed them in probably 3-5 yrs.

did u all know that once an account is placed into collection. it cannot hurt you any worse if you dont pay it.. however if you do pay. it can help your credit as showing a paid for collection account woohooo now thats exciting.. ill just wait my 7 years and NOT pay it at all LOL..
