Received a phone call about a debt that is supposedl in mine and my ex-wifes name. Every debt that was in both of our names are cars that have been paid off or traded in. The bank they named I have never done business with. I asked for copies of so called loan paperwork and date it was opened and Margo told me to calm down and didn't have that info but could get it w/in a week. Funny, they know who the creditor is but no info about it??? too bad I have their numbers blocked from reaching me and only have a p.o. box to send me anything. Any other loans I had when I was married were settled in bankruptcy after I got severely ill and was hospitallized. This "company" has over 51 Better Business Bureau complaints against them. Oh and all these people who have been leaving comments about good people pay debts, debt collectors call only lowlifes, etc., all work for Bourdreau.

i used my cc to pay for my children's funeral....i payed on this card for 3 yrs...lost my job, and had the ins. for the cc to pay until i found another job....well they found a loophole and wouldn't pay it, so in turn i called to make payment arrangements ...would not accept the arrangements....so i couldnt pay, now Boudreau and Assco is calling and calling i have spoken to them but they will not accept the amount i am able to pay,.....so before anyone calls another person a debtor or that we don't want to pay our bills, please take into account why some of us r unable to pay.......i am now in debt 8,000....and cant pay

keeps calling asking for someone who does not live here. Cannot speak to a person. They call non-stop. It appears to be a computer generated call and the voice is not (personal) - it appears to be a computer voice. They call non-stop! from early morning to 9 pm at night. They are relentless! I am 68 yrs old - have not debt! pay all my bills on time. Even my house is mine! Cannot get them to stop no matter how many times I tell them. I am going to call the phone company and block all their numbers.

After reading all the other posts I guess that is the only thing I can do.

a debt collector can actually call multiple times a day, but if you speak with them they cannot call you back the same day. not all debt collectors are paid just minimum wage and some have gone to college.

When a debt is unpaid, the creditor has the right to collect within reasonable boundaries. A debt collector cannot call your job, friends, family, or referrences once they have been told to stop. They may not under any circumstances disclose personal information or terms of the debt they are attempting to collect to a third party. A debt collector may not harass you with multiple calls within a 24 hour period. However, they can call once a day. They are required by law to provide you a written statement of the account with all activity.
Remember the debt collecting employee, has at best a high school education and is paid minimum wage. The employee often receives an incentive for a percentage of collected outstanding debts.

If the problems continue record all conversations, so you have a documented record of harassment. During the conversation ask for the callers full name, and job title.

I am a supervisor for a finance company, and yes we preyed upon the weak. The interest rates are excessive due to the fact the borrower is high risk. All loan activity is within state guidelines. If you do not appreciate these standards then do not borrow money or take credit cards from companies targeted to the financial depressed. 89% of our clients do repay their loans. If a client has experienced an unforeseen hardship we will work with them to the best of our ability. As long as they do not lie to us, and maintain a honest open line of communication. We cannot collect on social security, workers compensation, disability, or unemployment wages. However, we can file for a one time lein on their bank accounts. We can also file for an asset hearing. The debtor is then required to present to the courts legal documentation of all their debts, living expenses, wages, and assets. The judge will then determine if they are truly destitute. If the debtor refuses or fails to comply with this court order a bench warrent is issued for their arrest.

An additional point I would like for everyone to consider; a large majority of telemarketers and debt collecting staff members are actually prison inmates. We utilized them because they were cheap labor. If their job performance is unethical, it does not effect them. They are already in trouble and do not consider ethics a priority. Evidence by their their current residence. Reprimends go in one ear and out the other.

Prison inmates are utilized as telemarketers. The person you speak to when calling a state tourism department, vacation reservation 800 number, etc., is most likely an inmate. One company in our states employs inmates as their telephone sales team. This company is private owned. Another company utilizes inmate as thier technical support staff. It is very easy to identify the debt collector that is an inmate. They are the ones who are unprofessional, use abusive language, and illegal threats. However, just because they are inmates does not release the company from responsibility of their actions. They are still liable for that persons misconduct.

If you are truly being harassed without cause contact an attorney; they will be more than happy to take your case. File a complaint with the proper authorities, document all misconduct.

These people keep calling for my son-in-law and this is some sort of scam. I know they just payed off a banckruptcy, so I am wondering if they are getting their name from that.

It doesn't sound like a law office, very noisy in the background. When I looked up a Richard J. Boudreaux Attorney in New Hampshire, nothing came up.

Is there anyone we can report this to.

I'm sorry if you were one of the people who was trying to do the right thing and was given a hard time, but when 80% of debtors are lying weasels sometimes it's difficult to differentiate. I'm not justifying it, personaly if someone tells me they have no $ I continue to be polite unless they are rude to me. The bottom line is judge the debt collector, not the company, and keep in mind that the last person the debt collector (who is human too) spoke to before you was someone like Linny, Anna, or Sara (see posts below).

Called my work place, they stated my full SSN, address for work, and first name, starting stating that I owed Bank of America, last paymnt date May 2006 for $10.00, then asked if I was who they called for. I said that the employee by that name was not in the office and were they calling for her or one of our 400+ clients and explained to the person that we assist people who are dealing with debt collectors. They were very demading and rude, threatened legal action and hung up on me when I could and would not produce the information they demanded, I am looking to legal action. I asked them if there was anything the needed to say to me, they said no. They did not feel they needed to say the debt collectors mini-miranda, because they claimed to be calling from a debt collection law firm. I just laughed, they apparently did not know that debt collection lawyers are considered to on equal planes as a regular debt collector, (Heintz vs. Jenkins 1995 US Supreme Court overturned the prior exemption!).

I guess they don't understand plain english. I do not believe that they have a license to pratice law in my state. There is no requirement under the law to talk with them (even if you owe the debt) You should only talk to the orginal loan people. They are not the orginal loan and probely can not produce the orginal documents (without these there is techenicaly no debt). Make them prove that the statue of limitations have not ran out. They are required to show proof that they have the right to collect the debt and how they figure the penalties and fees. Cruise the web they have many law suites againts them and have lost many due to the way they do business. The BBB rates them as a F. Turn them into the State Atorney's office. File a complain with the Fair Trades Commision.

Yesterday one of my cousins called me and shared his one serious problem with me. He was telling that one lady is giving him a call from this particular number: (866) 890-1644. The number is not at all known to him and the lady is continuously giving him a reminder to pay $250 by this week. She is telling that my cousin had borrowed some money from her company. Then today I have successfully got the details about the number: (866) 890-1644 from http://www.debtconsolidationcare.com/collection-agencies/hiding-name.html and advised my cousin to visit the office of the company immediately.

You are correct...people should pay their bills; however, that does not mean life situations won't happen, bills won't get paid, and those bills won't go into collections. At the end of the day, people should be treated with respect, regardless of whether or not they owe money to a 3rd party collection agency. I am a debtor who DID work to pay off their bills and was still harassed. Many of the people on here probably do owe money, but that doesn't mean they should be disrespected if there is a law to protect them from that.

I have cleared everything from my credit. I have a 760 credit score that I worked hard to clean up. I used to owe and "thought" I paid off everything with a 3rd party collection agency, but it appears all they did was illegally sale my data. I told them to stop calling me, because I do not owe anyone anything, so what do they do....they call my elderly parents home and harass them.

The point that everyone is missing is nothing is ever balck and white. Every case/debtor should be evaluated, collections agents should do their reseach before calling. points:

* If a alledged debtor tells a collector that the party that they are trying to reach is not at the number dialed then the collector should double check the information. It is easy enough to do these days.
* If the debtor is dead, then the collector needs to stop. if the death is recient then contact the probate courts.
* Some people have true hardships.
* People living high on the hog should be collected on, leave people that have the hardships alone, they eventually will come around.
* Elderly are easily scared and most do not know about the laws that protect them like NOT BEING ABLE TO GARNISH SOCIAL SECURITY. They pay out of fear.
* Nasty collections efforts. How would you like to be spoken to and threatened the way you sling it out? Karma is a bitch!
Most claims are correct against this firm. I have several clients that have recorded conversations, i have also experienced several. Boudreau's office should be shut down and the employees banned from the industry forever. Blackballed comes to mind.

This is no Law Firm, I work at a real Law Firm. This is nothing more than a collection agency, using (paying for the use of) the name of a Law Firm to intimidate people who have fallen on hard times.

I love to give them the run around like putting them on hold to go get a phone number for the person they want and then letting them sit on hold, then get back on phone and say.. OH I forgot you were there, who was it again you wanted.. They get so nasty and irate that it will just make you pee your pants laughing. I put one of them on speaker phone while I had some friends over.. I actually look forward to their calls, it's like Happy Hour!

Use the debt validation letter form found on www.creditinfocenter.com's website. That usually gets these collectors to back off, and besides, they DO need to prove that they have been assigned to collect the debt or that they now own it. There is a lot of other useful info on that website for dealing with any attorney or debt collection agency trying to collect a debt. Learn what your rights are and how to deal with people like this!

Question to Richard J Boudreau & Associates, LLC, How come you collect on a dept for a short ammount of time then all of a sudden stop deducting the $$ and then try to sue the so called Debtors for the entire ammount like the person paid nothing to you at all??? Then when the so called Debtors call you and ask for a statement to show what they have paid no return call just silence.... You give no notice of any kind that you are not going to continue deducting the agreed upon amout from the so called Debtors account you just stop then file a law suite against the so called Debtors??? That is why you have well over 400 law suites against your company. Check it out everyone just google Richard J Boudreau and Associates and see all the law suites it is unreal the how low these people sink when talking to the so called debtors I read a few of the cases and could not even believe the lies these people tell and the threats seriously check it out.

Wilson Perez at Ext 154 stated I defaulted on a loan back in 1997 from City Financial and he would settle for a percentage of the loan. I told him I thought this was a scam I never had a loan with City Financial. He then asked if the numbers he was giving me was the last four digits of my social security which I said no. So he said then to forget the call. They must have the wrong person.

Got calls from several different numbers, including one that came up as "unkown". I was told that they were not getting paid by the firm that bought the debt and that none of the money from the setllment amount was going to them when I asked. I was told by "rafael" that they were "helping" me in securing a settlement from me, and that my credit score would improve, which is not the case. He eventually had a "Tiffany" call me and she quickly got off the phone and handed it over to him when I began talking to her. A questionable firm at best - typical collection agency- true "bottom feeders".

I was called by this company more than once after my bankruptcy was dismissed. My attorney confirmed the debts were still valid and that I should make arrangements to resolve them. The collector was NICE and RESPECTFUL to me; he went over the 3 debts that they had with me and put me on a payment plan because I could not pay the balance off or come up with anything to offer to settle. It seems that most of these posts are from debtors that do not want pay their bills and then blame everyone else but themselves. Look in the mirror and ask yourself, do I hate the bill collector for doing his job or am I a scum that refuses to pay my debts. It is amazing how many people work yet claim they don

I get calls from these people all the time with messages like, "I need to make an important decision regarding you and I'd rather do it with your input. You NEED to call me back." Then I call and they ask if I know someone I've never heard of. I have a common name and I think they just call me every time someone on their list knows a person with my name. It has happened about 5 times. I don't call them back any more.

Not everyone who gets these calls actually owes a debt. These collectors continue to call people even though it is a wrong number or they call looking for their neighbor or other family member. For those of you that are being harrassed for a debt that is not yours, go to: www.fair-debt-collection.com or www. budhibbs.com and read about your rights and the laws that govern Collection Agencies. If you do owe a debt, it will not just go away, so you need to contact the original creditor and work through them, they are willing to work with you, and you can avoid the collection agencies all together. Remember to document everything and pay nothing until you have everything in writing!!!

Kosmo Kramer thanks for proving my point....the only posts debtors respond to are the vulgar ones....notice mine above was completely ignored, as the said post predicted it would be. Both Sides as for your posts, I can respect your observations. In many ways you are right, but that still does not excuse the behavior nor the attitudes that debtors portray on the phone. More often then not when you are trying to have a mature conversation with them, they are acting like savage lunatics. As JVD said handle your affairs responsibly. You would at least get some respect from doing so whether you pay your bill or not.

Usually, my clients were very nice scared people who just couldn't take it anymore. By the way, credit card debt is a commodity. It is bundled and sold on the secondary market and it is NOT usually owned by US citizens in general. Most US credit card debt is owned by foreign governments, corporations, and wealthy countries and their royalty (can you say oil). The truth is that "preditory lending" is real. I understand how some people believe debtors are not responsible members of society but the truth is quite the opposite. Bankruptcy is an efficient method by which debtors can begin a new life and once again contribute in a positive manner in not only their own lives but the lives of their family, their community, and their country. The only way to save the US from foreign influence and shady corporations is to stop spending money we don't have, stop importing slave products, and for every American to file bankruptcy on every credit card and later on pay your local debts voluntarily. To all the above critics who believe themselves to be self-righteous, I hope your lives are always fruitful and you never have to face poor health, loss of a child, a husband, a job, etc. I don't usually comment on these sites and I appreciate the time anyone took to read by ramblings. I leave you with some food for thought: If you wanted to create a world-wide system of slavery that was not only legal but disguised as a reward HOW WOULD YOU DO IT? I've filed thousands of BKs for clients and have collected debts for clients. The real issue is the method by which an attorney may collect debts under State and Federal Law. I never sue a debt collector who innocently makes an error in his collection practices. I've had clients who were crippled, dying, disabled, etc. and all day long creditors would call them and threaten them with jail, continued harrassment, calling their friends, neighbors, and family, etc. Most individuals I filed Bks for never planned to lose their job (it went to Mexico or Asia), their health, their primary bread-earner, etc. Very rarely did I see someone who was trying to scam the system.

I pay my bills as you claim you do. Your company calls several times a day looking for a person that had this number before I did. I see comments left here on this site which frankly is very unprofessional. If I owed a debt (WHICH I DO NOT) and you called me with the way you talk on here I can assure you no matter what you threatened I would not pay a dime to your company seeing how you feel about human beings on here. I am glad you have so much money that you state you pay your bills. I also understand that with the economy being the way it is and some people picking up the tab like (ME) there are people that cannot afford to pay a bill back. Now if they have a new cadillac in the front yard or new house or even a new boat I say go for it get the money back those are the people that shuold be targeted. But you have a job to do and I also understand that as well. But if you truely represent a lawyer or one who claims to be a lawyer please do us the ones that are lawyers and quit shaming our lively hood and trashing our names as such.
To those that owe money if you are continuing to purchase items and not paying for them please stop!! It really does hurt the economy. I can't believe that buying up someone's debt for pennies on the dollar and then trying to collect the whole amount is legal. Is this the American way by preying on people who have problems already? When a company writes off the debt, they already get credit on their income tax. That should be the end of it. These debt collectors are scum!

I think what the people here that are complaining about debtors not paying their bills have to remember is that the company that this collection agency works for makes very high risk loans to people with bad credit or even problems with substance abuse in return for very high returns. They get high returns cuz of the risk of default with these types loans. That being said don't feel sorry for the businesses that make these loans they know what they are doing and know the statics of not getting paid, and accept not getting paid sometime that's why they get the 30% plus interest. They prey on people, and so are scums themselves.
