I keep getting these phone calls from this company. They ask for my husband's brother and I tell them they have the wrong number. They then ask for someone else from that family and again I tell them that they have the wrong number. Then they get rude with me and say it's very important that they talk to one of them and it's like what didn't they understand? YOU HAVE THE WRONG #! Sometimes I just hang up on them. It got so I didn't answer the phone and then they would leave messages. One day a guy called and right away says "Don't hang up on me" and again asks for my husband's brother and so on and I keep telling them that they have the wrong number! I asked the guy if they go down the phone book calling everyone with the same last name. I am still getting calls from them. I don't get why they keep calling if it's a wrong number!
I reveived a message stating it was in regards of my late brother who passed away a few months ago ... if its all about debits or my debits then its just wrong to call and use his name and i wonder how they got my number.. i havent talked to anyone yet
Last Monday, I was very busy in the office and suddenly my secretary informed me that an important call has come for me from this number: (800) 864 6033. So I told my secretary to transfer the call to my extension. The person who called me started talking about my huge existing debts. I was quite surprised. But as I had no time to talk to the person at that moment, I told the person to give me a call few days later. But still no call I have received from that particular number. Yes they did call again twice today.They are a old debt purchaser and they are not allowed to call you after you tell them even over the phone that you do not want to be contacted any more. Then send them a certified letter and they have to stop. Because now they know that your not as stupid as they are. Just keep plugging away and do not take there calls . Tell them that you do not talk take care of any finacial business over the phone and to not contact you or your family on this matter. And tell them about the FDCPA (Fair Debt Collections Practices Act) and that you are being recorded as you speak. They will back off and won't contact you again. Save the recordings. I do and then i play it back to them to let them know that yes they are being recorded. This will back them up. Just what ever you do please do not feel like there is no way out because there is always a way. I found it and I want to share it with all. Good luck
Caller said her name was Janet Smith from Simm Associates and an urgent matter just came across her desk that I needed to respond to before noon today. Gave her extension as 2283 and made it sound like an important legal matter I had to take care of.
These people have started calling me about a HSBC credit card from 4 years ago and i owe 423.00. I stated that I do not recall having a HSBC card but as an act of good faith I would give them 50.00 with a letter asking them to send me what ever information they have on it. That was not good enough and Mrs Simpkins demanded payment in full right now or they would garnish my wages and take my tax return. With in 10 days I have gotten 15 calls from this Mrs Simpkins both at home and work. I sent them a certified letter telling them not to call me at work. She still days it has become a huge issues to me. On Feb 9th I was called at work and another person asked for our companies payroll dept number because they did not get a W-2 form I gave them a payroll number and the next thing I know is this Mrs Simpkins is saying "see we will get the money out of you I told you we will garnish" They sent back my good faith payment. I have pulled my credit report and HSBC is no where on it I pay my bills and will pay this one if indeed its mine but I am not just going to send someone 400.00 because they called and said I owe it to them. These people call me ALL the time, several times throughout the day AND IT ISN'T EVEN MY DEBT! They tell me to have (Name withheld) call them. I have told them to take my number off their list. They refuse. They said the individual has to do it. I tell them I never authorized my number to be on there so TAKE IT OFF! These idiots had the nerve to be rude to ME and it isn't even my debt! They called me at work telling me I had 24 hours to give them $500 towards the $3000 they would settle for on an old debt to buy not time before they were going to file this in court. I told them no to stop calling me at work and hung up they called back again. I again stated to stop calling me at work I was not allowed personal calls. They wanted to speak with my manager I told them no and hung up. They also called a third time and just kept saying Hello Hello not sure about that one could have been a bad connection but I could hear him fine. This was three calls within 15 minutes. Not to mention they had called the Friday before and I gave them my home number and told them not to call me at work.
Every day these people call and ask for someone I have never heard of, who unfortunately has the same last name as me. Today, Quentin at extension 2317 called and was extremely rude to me when I asked him to remove me from the list. He left a message earlier today and left the number (800) 864-6033. Each day, a different person calls me and asks for a person I don't know. I live debt-free and have no outstanding debts. I am on the do-not-call registry, but that doesn't help. 1st, folks understand that the Do Not Call registry does NOT apply to debt collectors. You do have rights under FDCPA (Fair Debt Collections Practices Act) in that you may inform the caller not to call you on any telephone or communicate with you in any manner. They may only communicate with you to tell you 1) they are invoking specified remedies normally used by them, 2) they are no longer proceeding with your case or 3) they intend to invoke a specified remedy. You should send a letter to the service address of the company stating "According to the Federal Fair Debt Collection Practices Act, [15 USC 1692c] Section 805(c) CEASING COMMUNICATION: You must cease all communication with me after being notified in writing that I no longer wish to communicate with you. Therefore, I demand that you stop calling me at home, at work, on my cell phone or at any other location!" If it were me, I'd send it signature and receipt requested via certified US Mail.
If they continue to call you may inform them that each call constitutes a violation and carries with it a $1000 fine for each occurrence.

Got a message from "Anna" today. We had gotten a call before & have already been making payments to the company, Applied. But this time, I didn't answer & she left a message for my husband. "We have tried calling you several times, why can't you just pick up the phone & talk to us for 5 minutes. Be a man & call us back" Excuse me??? Thats not professional. Our bill/dept hasn't been bought by anyone. We still pay Applied as recently as last week. Not everyone can just sit in there house & answer the phone all day, which is why we have answering machines.

Just returned a call and asked what the debt is for. Said it was for my husband. Again asked what bill does he owe for. Jenn said she could not talk to me about it, only that this is a serious debt and going to court shortly. Told me to have my husband call and give the okay to talk to me about this debt. We have no outstanding debts so this is just ridiculous. They call all day and night....usually a person with that thick accent leaves the message but when you call back someone just answers "Hello". Sounded like she was in the middle of cleaning her house when I called.
Who are these people and are they allowed to call cell phones if we called and gave our number to the "DO NOT CALL" list that the Government posted?
A women called me saying i owe 3000$ I have paid this company ever month and only owe 700 left a women named lynn called and threated to put a law suit and she looked in my bank account and she needs a credit card number to hold the lawsuit for a few weeks she tried to tell me that I gave her the wrong info and she is putting me in jail
I have been receiving calls for several months from several numbers and when I check the # online they all refer to this Sims Associates. I have never answered a call yet due to I always wait for my answering machine to pickup first to screen calls. I refuse to respond to calls who do not identify themselves or leave a message. I have no problem paying my bills if owed but refuse to be harassed and intimidated by a so called bill collector. They started calling appx. 8:00a.m. this morning and every 10 to 15 after that for a while it is now 7:47p.m. and I am still getting calls and hangups from these people. There are many many messages and hangups from them on my caller ID and answering machine I have saved them all. If it will help in a law suit I will be happy to help. What are the legal rules that a bill collector is supposed to follow? Even if I owe a bill are they allowed to harass or wear your phone out ringing it off the hook without leaving messages? Who wants to answer their phone or have someone answer it for them knowing that you will be treated and disrespected badly and possibly even be accused of lying these people have no idea who is on the other end of the phone and have no right attacking a person's integrity in an accusing manner and refusing to hang up when someone no longer wishes to speak to them. A bill is between yourself and the company owed to and I feel the people in the middle have got to go they put their pants on the same way as the rest of us and need to stop working for a company that expects them to lower themselves below the human standard.

I have recieved at least 4 calls a week from this number for months and they claim in voice messages that they are calling in regard to a claim that I filed. I have filed NO claims anywhere.

Weird thing is, they actually tried the nice approach, David lane was super friendly, but also a liar, so needless to say, that cancels out the nice part.
I was told 3 payments would be taken out of my parents account, then the 4th would have to be called back (because i was switching it to another card)

Just received a call from Simm Associates saying I owe 2500 on a discovery card which by the way, never had one.... when I asked for information about this case they refused to say anything, they didn't even give a name and the lady was very rude. When I asked to speak to a supervisor i was told " oh you want a supervisor... I'm going to give you a supervisor" I was laghing during conversation, that made this lady very mad... anyway I was put on hold and just had an answering machine... strange isn't it???

A Dean Phillips with Simms Associates called on an old debt that was being taken care of and when I tell him this he wanted more info. I said I will check it out. About three days ago. I recieved a call from Simms Asscoiates who claimed they were attorneys (Phone # 1-800-864-6033). I spoke with a man named Todd Smith. He threatened he would garnish my wages or sue me within 2 weeks if I didn't pay off my $3,000.00 debt in which I do not owe, I swear to you. He told if I refused to pay I would be sued or arrested. I asked for validation of this debt, which is legal according to the FDCPA, they told me they didn't have to provide me with any. That if I knew the FDCPA, everything there doing is legal, ask anyone. What a bunch of BULL. I refused to pay and then they said they have my banking information and if I don't agree to there terms they will take the funds out of my account wthout my conscent. I hung up on them. I AM ATTEMPTING TO SUE THIS COMPANY FOR EVERYTHING THAT THEY HAVE. What there doing is illegal. IF YOU RECIEVE A PHONE CALL FROM THEM HANG UP NOW. Don't be scared by there tactics. I have done my research and they are rude, falsifying, and illegitiment. What they say they can do or what they THINK they can do is illegal. My lawyer will back me up on this. The callers, particularly Todd Smith, are pretty abusive. They say they are from Simms Associates and that if a debt isn't paid in full with a week or two, that they are representing a party that will press charges against you. I am currently in a debt management program (with the party they were speaking of!), so I knew this wasn't legal.

I worked for Simm from 2002-2003. At first it was just calling people to collect a debt. But then we get into trouble if we aren't aggressive enough. The owners encourage us to threaten and call neighbors and belittle people. It's a part of training. Some people are more aggressive than others and are meaner than others. I wasn't mean but I was very firm, and as I started to make more money, I found myself becoming more mean. I talked to an elderly woman who was working minimum wage and wanted to pay me with her 401k. I told her not to do that and don't worry about it. I couldn't bring myself to let her do that. i got snatched in the office and ripped a new asshole. That was my last day there. I'll never work for any kind of business like that again. It really takes a heartless person to do what they do.

Only ex gutter trash with no other marketable skill would be walking around with their nose in the air because they make 900 dollars a week harassing people who mostly are victims of layoffs and a bad economy. I was making 95k a year when I got laid off and fell back on bills after a 4 month job search causing me to choose between rent and my amex bill. I know have a 85k job in a REAL career that requires a brain and make another 30k a year playing bass twice a week. Get over yourselves. I would bet money you were both -15/hour pieces of sh!t before you started harassing people for back debt in this type of an economy. You're pathetic.

First and foremost, some of the actions that this company has taken are completely illegal; from refusing to provide you with an address (in Wendy's case) to claiming they represent certain municipalities in other cases. According to federal law, they are forbidden to contact you at work if you so indicate and they can not misrepresent themselves in any manner. If they continue to call and harass you, my suggestion is to contact your local FBI field office, the Federal Trade Comission and the US Dept. of Justice. Give them the name of the company, the phone number they are calling from (or the 800 number they are asking you to call), and the name of the person that you spoke with and let those federal agencies deal with them. All it takes is for some lackey sitting in a cubicle to get slapped with a federal injunction and subpoena and realize the $6.50 an hour they make is not worth what they will lose if convicted of FDCPA violations. Bottom line, don't argue or lower yourself to their level...report them to the feds and let the chips fall where they may.
I am with response pyb. First off, I am current on all my bills. It is apparent that my ex husband is the "loser" as you (harrassed) have stated. We have been divorced for 12 years. Unfortunately he has had 4 heart attacks since our divorce and is having problems holding down a job that does not stress him. This company called my home wanting to get in touch with the ex. I refused to give them any information because they would not identify themselves. I do believe that the law states that you must identify yourself and the company you work for. they do not have to disclose why they are calling. I hope at one time you lose your job and can't pay your bills. I would never hire you as a collector because of your attitude. I have collected a lot of funds from bad accounts by working with people and being firm but sympathetic. I can't beleive that you feel okay threatening people who owe money. Shame on you.

Very simple response, do not answer the phone if no number and name is shown on the Caller ID. This firm buys old written off debts - you do not have to pay.
If you receive calls from this number, register your phone number with National Do Not Call and report him.

They said they were calling before turning my claim over to "the county." -- collection agencies always try to scare you into making payments... I don't think I have any outstanding payments to make. NEVER make payment or say you're guilty of such because it will go against your credit report. I made this mistake once when I was younger when I canceled insurance and a year later they sent a CA after me. I paid it just to get it off my back and later found out that it hurt my credit since "paying a late bill is confession of late payment," is what the credit bureau told me.
The caller called someone elses cell phone and left a message for me. This person notified me and had me listen to the message. The woman identified herself and left a number to call back on, said she had been retained by a client for a civic complaint.
Johnathan Taylor from Sims Associates keeps calling me at work. I told him to stop and he told me it was not illegal to continue calling until they received something from me in writing. I asked him for the address and he refused to give it to me so I hung up on him. He then called right back to threatened me again. I hung up on him once again and he hasn't called back, it's only been a couple hours. I found this site trying to find thier mailing address so I can submit my request to quit contacting me at work in writing.
Have called many times and left messages for some person I do not know. Won't stop calling after repeated requests.

SIMM Assoc. is just another run-of-the-mill sweatshop, full of people who can't get real jobs. Most of the tactics described are illegal, under the Fair Debt Collection Practices Act--with the exception of contacting "nearbys" or neighbors, as long as the collector doesn't disclose that he/she is calling from a collection agency. They use Coles directories, and various reverse search methods to get your number. If your number is published, you're at risk of receiving the call. It's really annoying, and besides--who calls neighbors EXCEPT for bill collectors? Just ignore them, and they will eventually stop calling you (you can also write them and demand that they no longer contact you because you're not the person they're hunting).
Received answering message from Michael Fields stating that I have until 12:00 tomorrow to get in contact with him or he would begin arbitration procedures. He also stated that he had been trying to reach me for the past 60 days. I did have an Applied Credit Card that went into default. They continued to pile on interest and late fees even after I cancelled the card and made a payment schedule with Applied Card which tripled my card balance.
"Gary" is absolutely CORRECT! The Statue Of 'Limitaions" is 4 Years in Most States, but some are as High as 10 Years! And, YES, this Company does Buy Old Debts for about $.03 to $.05 on The DOLLAR! So, if you have a $5000.00 Debt, they Paid about $200.00 for it! Then they try to get the $5000.00 PLUS 6% Interest! Also, if they Do Not Quit Calling after you tell them to, you CAN Prosicute THEM! But PLEASE check out your State Laws on this. Basically they are the Same, but Some States ARE Different.

This Company Buys OLD Outdated Debts from other Companies, without properly researching the Debt, then tries to SCARE the Money out of YOU! Please Check your State and see the Statue Of Limitations in Your State. Usually 4 Years after the "Charge-Off". Do NOT take the Call or Pay the Debt! Tell them NOT to call back, and Legally, once Told, they cannot call you back due to the new Laws! This Company Employs Ex-Cons and People who Themselves are under Investigation! I did my Research!
i worked for simm associates and they are a legit business. unfortunantly.. my job was to skip trace.. credit bureau or look up neighbors to contact people who did infact owe money to any clients that obtained our services. i do appologize for some of the inconvience that this may of caused anyone that had gotten ahold of the "wrong person" but after being hung up on, cursed at and/or feeling belittled because PEOPLE OWE MONEY AND WOULNT PAY on accounts that they have been delinqent on for months.. its pretty tough to keep a smile on your face. my suggestion would be, if a wrong number.. says its a wrong number, even if you get a hundred unknown names or 800 #... we do not call more than twice a day so chances are either you owe other companies and they are calling or skip trace gave wrong number. if you do owe money.. set up pymt plan. if you can afford much, somethings better than nothing. there is ALWAYS a manager on duty so if you get an ignorant person, call back and dial ext 2001.. front desk.
