Ms. Baker: You imply paying on a court judgment but it's not clear. Debt collectors are covered by the FDCPA post-judgment and still have to play fair. You'll have to compare the collector's conduct to what that and your state laws say, and I doubt anyone here can advise you fully.

} My original debt ... ballooned ... how can they do this?

Defaulted debt can inflate quickly due to the terms of your lender contract, the right to enforce that contract usually given to subsequent collectors, and any local laws permitting the slathering on of fees and interest by a plaintiff who sues to collect. That said, if any part of the math is wrong, that misrepresents the character of the debt and therefore violates FDCPA. I would guess in the past you did not properly dispute the debt when you still had a chance, which also naturally pumps that balloon over time.

} regarnish my wages

Threats of garnishment are often empty bully tactics, making them illegal when not carried out. If the targeted asset is exempt somehow that's also violative. It's likely there is a limit on how many meathooks can be sunk into your assets and/or what percentage can be taken. A new garnishment order may simply have nowhere to go if you're already tapped out.

There are a lot of "if/then" statements which can be made here. You ought to start your homework on what your laws say and find a good consumer attorney if you get lost. Given the thug-like behavior reported in prior comments here about Credit International, (nee Computer Check Verification / CCV) you may pay little or nothing for advice and representation, due in part to the FDCPA's fee-shifting provision.

Dean Hamilton is a cold hearted ruthless man. He called me at my office threating to regarnish my wages even though I am paying $25.00 monthly without fail. I have paid this without fail since October of 2011, My original debt was only $75.00 and ballooned up to 840.00 how can they do this? I am over half way paid off and he wants to take me back to court again to regarnish my wages. how does our state let someone like this hurt the little people who are making an effort to take care of their obligations.

I am being sued by CCV. They are suing me for a payday loan from three years ago, which was paid. They had never contacted us before this, so they are appearantly counting on me not having proof of payment. They have humg up on me, refused to provide proof of debt, and resorted to bullying. Dean Hamilton said specifically that he is not an attorney. We are countersuing them, but I thought everyone should know that for a payday loan, in Washington State, it is illegal for a debt collection agency to collect attorney/court fees. They can only collect the amount of the check and a collection fee.

I just got a call as well. 11413 Beardslee BLVD Bothell, WA - Both Dan Roberts and Dean Hamilton work here. I simply asked for proof and he hung up. my prior call stated I could pay the following week if I could see proof of debt. Sorry his attitude as threatening and arragont. Looks like they will be visiting the hospital soon.

We have been registered with the Do Not Call list since it's inception. Dan Roberts was the name of the individual leaving a message. Said he was calling for the business owner or "HR" for employment verification of an individual whose name he left. There NEVER has been anyone by that name employed by our business, nor do we personally know this individual. The return telephone number left by Dan Roberts is 888-452-9152; our caller ID shows the call came from 425-487-4021.

Mr. Dean William Hamilton is a subcontracted collections attorney doing business at: 1126 S Gold St. Suite., # 101 Centralia, WA 98531. PH: 1 360-330-5887. Hamilton works independently for various firms who contract him to collect outstanding debt(s). He does not work for, nor is he directly employed by, any particular company. He is a freelancer, passing the WA State bar in 1989.

Dean William Hamilton was cited for Professional Misconduct by a Washington State disciplinary authority in 2001; meaning he lost his license to practice law for a period of time (suspension). Since then, there have been several complaints concerning his methods and conduct. As filing a grievance is considered a very serious action against an attorney, do so only if you feel you have been exceedingly harassed, mislead, or mistreated. To file an official written grievance with the WSBA go here: http://www.wsba.org/info/operations/odc/updatedapril2007.pdf Or call 1 206-727-8207 for assistance.

DEAN HAMILTON "HEAD OF THE LEGAL DEPARTMENT" IS VERY RUDE. WHEH I FIRST ANSWERED (BY THE WAY HE CALLED MY OFFICE) HE WAS WILLING TO WORK WITH ME BUT WHEN I ASKED FOR COPIES OF THE INFORMATION HE QUICKLY CHANGED HIS ATTITUDE AND WAS NO LONGER SO WILLING TO WORK WITH ME. SURPRISE MR. HAMILTON NOT ONLY WERE YOU ON SPEAKER PHONE BUT I NOW HAVE A WITNESS TO YOUR BULLY TACTICS. MY SUGGESTION TO EVERYONE IS TO CONTACT ATTORNEY GENERAL AND FILE A COMPLAINT IF THEY DEAL WITH THIS GUY.
