Interrupted: You might sue for harassment but not for violating the Telemarketing Sales Rule, which is the law linked to DNC. Debt collectors are not sales reps to you, therefore exempt. You were correct that your calling rep was required to give you the name (or at least the acronym) of her employer. That alone won't give you much of a FDCPA case, I'm afraid.

Bill: What is ''obvious'' is that you don't comprehend the scope and usefulness of DNC. Here's ''the law'' you wanted ... the one ''Irritated'' is using correctly:

The call time you have reported is perfectly legal unless you have already given PRA written orders to the contrary. If the debt at issue is not yours or ''out of stat'' as in Irritated's case, you can follow his/her example and send a cease-comm notice via USPS Certified with return card. PRA is like other high volume agencies in that your verbal demands will not be taken seriously.

Told the woman who called that there is no person by the name she asked for residing at this phone number. I asked 5 times who was calling but she kept ignoring my question. (I thought that under the law they had to tell you who they were and the name of the company that they were calling from.) She then told me that I didn't have to yell, and I said, "I thought you were hard of hearing since you didn't answer the question that I asked you 5 times". I asked, "Do I owe you any money?" she replied "NO". "Then stop calling me or I will sue you for violation of the Do Not Call List and harrassment."

Anal pores called at 8:06am. Where is the law? Obviously operating outside legal limitations and don't give a damn because the DNC is a joke.

If it is Portfolio Recovery send them a cease and desist letter... the last time I got a "settlement offer" from them I noticed the following hidden on the back side: "Because of the age of your debt, we will not sue you for it and we will not report it to any credit reporting agency." Meaning the debt is past the statute of limitations and the only thing they can do is call you incessantly. If they continue calling after they receive the cease & desist letter it is harrassment and they are in violation of the Fair Debt Collection Practices Act and you can report them or sue them.

No message however based on the comments left here a real classy company. Next time they call I might answer with a pleasant and ear shattering high pitched whistle into the phone speaker

They are scumbags. They also call when they are not supposed to. We received a call from them Sunday night at 9:05pm. They are the lowest of lowest. Check out Bud Hibbs site and get the dirt on these people.
