This is a scammer from 4630 Border Village Road Suite N1497, San Ysidro, CA, 92173—matches a WHOIS registrant address for the website tesserboigltd[.]com. The registrant's name is Sergio I. Cortes Jr., his email sicortesjr@gmail.com, and his organization is called "Tesser Enterprises." Sergio and his Indian counterpart Sharad Goelfrom of New Dehli India have been ousted as major telephone scammers from fake Tech support to impersonating IRS agents.

Yes it just boggles my mind that they passed that law and there are actually people not obeying it. That is so unusual, a law that some people obey and some don't. This is not a legitimate caller. This is a scammer. They want you to think they are The "American" Chronic Pain Association. They left out the word "American" and it's not the same organization. I think these scammers are the same scammers who do the medical alert bracelet scams.
Pressed 1 and asked for the company name, a phone number and address - the salesperson would not provide anything but saying they are with "Health Advisors". I played along... "I won't give out my health information if I don't know who I'm giving it to, but I am very interested." He said he didn't have that information and wasn't allowed to give out a phone number. I asked for a supervisor because I was really interested (haha) but needed to know more about who I was giving my personal information to first. The supervisor gave me a call back number of 321-248-6292. He also stated they are located in Miami Florida which is correct for the area code. The funny part was when I ask the supervisor for the company name and he paused then said "American Pain Relief" and I heard him turn to the original salesperson on the phone and whisper "Thats right, isn't it?" I then hung up. No clue if the 321 area code phone number is accurate. I didn't want to call it and possibly get on MORE call lists from having called in.
Earlier posters are right. The number is spoofed. I got the same call a few days ago from 650-277-2617. I am on the do not call list so no legitimate telemarketer can call me. I guess once they get an answer once they will just keep calling back. It won't do any good to report it.

The callers have been _relentless_. We "label" them ORGANIZED CRIME CALLERS _because_ they NEVER LEAVE ANY MESSAGE-let alone a credible voice mail message on our answering machine/answering service-which leads us to believe-rightly or wrongly that these are NOT legitimate callers. The calls "began" around 2009-in earnest-and used to be made from California area code 949-after that a 360 are code-for close to 6 weeks the caller ID displays indicated: 304-829-4527/and now "harking" back to several to years ago "back" once more to 235-897-6589. SEVERAL callers begin with a FEMALE PRERECORDED VOICE saying: "Hello this is Bridget [another name used is "Carmen"] from card services...this is a very important call/this is your LAST CHANCE to reduce the interest rate on your credit card.." Caller said that I had a payday loan from 2009...funny thing is, I know for sure that I never took out a payday loan in 2009 because I have not had a banking account since 2007!! Where are they claiming to have deposited the money?!?! When I asked that, the caller hung up the phone. Furthermore, this does not appear on my credit report, which I monitor constantly...caller block, here we go!

"Justin Rolseon" called from "MCM". After five minutes he admitted that it was "Midland Credit Management". It took another five minutes before he would give his address as "8875 Aero Drive Suite 200, San Diego, CA 92123", because his company's policy required him to check with management to see if it was acceptable to provide identification as required by federal law. He was obviously calling from India running some kind of debt collection scam, trying to get credit card numbers. He refused to say where he got my telephone number. He then made up a story that maybe the person he was asking for lived at my house or had the same phone number before; neither of which is possible unless he lived in a tree in the woods that was here before the house was built. Then he said that maybe he was calling a wrong number, which is obviously ridiculous, since no same person calls the same wrong number 18 times. He eventually admitted that "Justin Rolseon" is not his real name. The same scammer also called most recently on July 19, 2009, with a very similar M.O., but using a different faked caller ID number, and also gave the same address, so this scam has been going on for a long time. Previously, this same scammer called on 3-Jul-2009 at 3:05 p.m., 11-Jul-2009 at 10:13 a.m., 12-Jul-2009 at 3:48 p.m., 12-Jul-2009 at 6:00 p.m., 12-Jul-2009 8:38 p.m., 13-Jul-2009 at 2:07 p.m., 13-Jul-2009 at 3:01 p.m. (twice in the same minute), 14-Jul-2009 at 12:07 p.m., 15-Jul-2009 at 10:04 a.m., 15-Jul-2009 at 2:11 p.m.,16-Jul-2009 at 12:38 p.m., 17-Jul-2009 at 7:53 p.m.,18-Jul-2009 at 9:56 a.m.,18-Jul-2009 at 4:13 p.m. Each time they refused to say why they were calling. The FCC and FTC have simply ignored all complaints, as is their policy. One of the previous criminals involved in the scam gave the name "Lynn Malkovitch", but most of them refused to give their names. In fact "Lynn Malkovitch" immediately hung up when I asked her to spell her last name. This same scammer also uses the fake caller ID 877-864-3526. This is part of a large, long-running scam operation that goes by various names including Midland Credit Management, Wells Fargo Home Mortgage, Valentine & Kebartas, IC System, Portfolio Recovery Associates, Accounts Receiveable Management, Allied Interstate, Bureau of Collection & Recovery, Chase Student Loans, Chrysler Corporation, Enhanced Recovery Corporation, FMA Alliance, GMC, HSBC, Juniper Bank, M. S. Gerald, NCC Business Services, NCO Financial Systems, United Credit Bureau, Watson Nelson & Associates, and Regional Adjustment Bureau. They probably use many other names, these are just the names that the scammers have used when calling me. Many others are simply unintelligible on the phone or refuse to give their name but appear to have a similar M.O.

A little about the information posted above. This has taken quite a bit of time to collect. All the information is publicly available, such as WHOIS, Florida State Department, and Zilliow to name a few,

This person has a long history of creating new businesses and using them for credit type scams. This has been going on since at least 2009. In addition person also move around quite a bit but has stayed within the Orlando area. There is a high use of UPS stores for a PO BOX. Generally one is used within proximity of the current home address, many have been used.

There has been a solid effort to make connections between all of the sources and types of data. The person behind the companies is certainly the same, yet there remains a question if person Kimberly Marie Coarse on facebook is in fact the same person. On facebook she indicates a friend by the name of Bill Meagher. This is important because one of the addresses listed for several of the companies was 14421 Paradise Tree Dr Orlando, FL 32828 owned previously by a William A Meagher, Bill is often used instead of William. It would seem unlikely that this is not the individual, how many people could be in Orlando Florida with the name of Kimberly M. Coarse associated to a William (Bill) Meagher?

It could be possible that Kimberly's identity has been compromised. Although this seems unlikely as individual would probably need legal documents from Florida State Department, and such documents would be mailed to a valid address. I mention this because a few of the legal documents from 2009 had to be physically signed, there are PDF/TIFF documents singed by her that are available from sunbiz.org. What is interesting is that signatures are different, and sometimes different enough within the same document, this would indicate possible fraud.

Letters to the FCC and other government organizations have not been fruitful. Hopefully at some point a agent of the government will see these posts. There is plenty of information here to begin an investigation. Simple inquiry into Kimberly's IRS tax filings should be enough to confirm the data provided. Subpenas to her banks, 800 providers, and internet service hosting companies should yield enough information to start litigation.

They said they were calling to setup an appt to check my heater. When I said we were on the do not call list they said they were allowed to call customers. They said we were a customer in 2009 at our current address. We had the same phone number in 2009, but not at this address. Crimnals are they.

These guys called my job about a pay day loan I allegedly took out in 2009. When I asked what bank I had put down they gave me a name of a bank I have never had an account with... seemed fishy. So I asked how they got my work #, they told me it was a listed #. That's now the 2nd thing that doesn't make sense b/ci was not at my current job in 2009. 3Rd & final thing that told me this was for sure a scam was when they told me they have tried contacting me for 2yrs. Calling my office 8times a month.. I think I would have heard about this before now if all that were true.

Caller Identification, or “Caller ID,” allows you to identify a caller before you answer your telephone. It is sometimes offered as an optional service by landline and wireless telephone companies, and may cost an additional monthly fee (fees vary by phone company). A caller’s number and/or name are displayed on your phone (if your phone has this feature). It is also possible to buy an external display unit, and some phone and cable companies that provide phone service even offer widgets that allow you to see caller ID displayed on your TV or computer screen.

Caller ID service, however, is susceptible to fraud. Using a practice known as “caller ID spoofing,” callers can deliberately falsify the telephone number and/or name relayed as the Caller ID information to disguise the identity of the calling party. For example, identity thieves who want to collect sensitive information such as your bank account or other financial account numbers, your social security number, your date of birth or your mother’s maiden name, sometimes use caller ID spoofing to make it appear as though they are calling from your bank, credit card company, or even a government agency.
Truth in Caller ID Act of 2009

The Truth in Caller ID Act of 2009, which was signed into law Dec. 22, 2010, prohibits caller ID spoofing for the purposes of defrauding or otherwise causing harm. In June 2010, the Federal Communications Commission adopted rules implementing the Truth in Caller ID Act.
FCC Rules

Prohibit any person or entity from transmitting misleading or inaccurate caller ID information with the intent to defraud, cause harm, or wrongfully obtain anything of value.
Subject violators to a penalty of up to $10,000 for each violation of the rules.
Exempt authorized activities by law enforcement agencies and situations where courts have authorized caller ID manipulation to occur.

Tips for Consumers

Don’t give out personal information in response to an incoming call. Identity thieves are clever – they often pose as representatives of banks, credit card companies, creditors, or government agencies to get people to reveal their account numbers, Social Security numbers, mother’s maiden names, passwords and other identifying information.
If you get an inquiry from a company or government agency seeking personal information, don’t provide it. Instead, hang up and call the phone number on your account statement, in the phone book, or on the company’s or government agency’s website to find out if the entity that supposedly called you actually needs the requested information from you.
Please let the FCC know about ID spoofers by calling 1-888-CALL-FCC or filing a complaint at www.fcc.gov/complaints.

FCC Caller ID Rules for Telemarketers

Even before passage of the Truth in Caller ID Act, FCC rules required telemarketers to pass accurate caller ID information. FCC rules specifically require that a telemarketer:

Transmit or display its telephone number or the telephone number of the seller on whose behalf the telemarketer is calling, and, if possible, its name or the name and telephone number of the company for which it is selling products or services.
Display a telephone number that you can call during regular business hours to ask to no longer be called. This rule applies even to companies that already have an established business relationship with you.

For violations of these rules, the FCC can seek a monetary fine. If the violator is not an FCC licensee, the FCC must first issue a warning and the telemarketer may be fined only for violations committed after the warning.
Rules for Blocking and Unblocking Your Telephone Number

The FCC’s Caller ID rules protect the privacy of the person calling by requiring telephone companies to make available free, simple and uniform per-line blocking and unblocking procedures. These rules give you the choice of delivering or blocking your telephone number for any interstate (between states) call you make. (The FCC does not regulate blocking and unblocking of intrastate calls.)

Per-call blocking – To block your phone number and name from appearing on a recipient’s Caller ID unit on a single phone call, dial *67 before dialing the phone number. Your number will not be sent to the other party. You must redial *67 each time you place a new call.
Per-line blocking – Some states allow customers to select per-line blocking. With this option, your telephone number will be blocked for every call you make on a specific line – unless you use the per-line unblocking option. If you use per-line blocking and want your number to be transmitted to the called party, dial *82 before you dial the number you are calling. You must re-dial *82 each time you place a call.
Blocking Your Name – Some Caller ID services also transmit the name of the calling party. If you request that your phone number be concealed, FCC rules require that a telephone company also conceal your name.
800 number/toll free calls – When you dial a toll free number the party you call is able to identify your telephone number using a telephone network technology called Automatic Number Identification (ANI). Requesting that your caller ID be blocked when you call 800, 888, 877, 866, and 855 numbers may not prevent the people who answer such calls from seeing your phone number and name. FCC rules, however, prevent parties that are assigned toll free numbers from reusing or selling the telephone numbers identified through ANI without the subscriber’s consent.
Emergency Calls – Telephone companies may transmit numbers of subscribers requesting privacy if the call is to a public agency’s emergency telephone line or in conjunction with 911 or poison control services.

Look before you dial:

To block your telephone number for any call, dial *67 before dialing the telephone number. • To unblock your number for any call (if you have a blocked line), dial *82 before dialing the telephone number.

He stated to me that there was a lawsuit against me of a company called Cash Advance in the amount of $3,449.00 from First California Bank from 2009. He identified my Social Security number, along with my home and work phone number and address, as well as my driver's license number. All this information was correct and I wondered how he got it. He never said, and, when I told him he had a case of ID fraud, he got beligerant with me and started yelling. I was incarcerated in 2009, didn't have a checking account nor had I ever heard of First California Bank before now. I told him to stop calling and he stated for me to speak with his supervisor, Brian Ross, also think strange african accent. He stated that there was 3 charges against me and if I didn't take care of them and send them payments of $590.00, then the police would be called and I would be arrested. He called my work numerous times every 2 seconds, demanding to talk to me and leaving messages for me to call him back other wise this would be settled in court.
This happened all day for the past 2 days and finally I went to the police department and filed a report. The officer called this phone number and whoever answered the phone just hung up on him. I tried to call the numbers back and got nothing. I did a trace on this number from work and it came back a cell phone, carrier ALEC INC. in Greensboro, NC. These people told me they were from the Legal Dept of the Distribution of Federal Finance in Winston-Salem, NC. (DFF) If anyone gets a call from these people, hang up and go directly to your local Authorities. DO NOT SEND MONEY!! They won't call the police, they are too scared.

Duane Romanello, who is now listed as the agent for H&P, is also (according to the state of Florida) the registered agent for a ton of other companies, including several other debt collectors and finance companies. He IS an attorney in Florida...but he is not listed as an officer, just the agent for process. This is normal for a corporate filing, actually.

As you see above, there was a dissolution that was pending in September, but it was dismissed. The original agent's name was Gary Henrion who is NOT an attorney in Florida but is now listed as the Vice President of the Company. Neither he, nor Noel Pooler nor Tammy (Mackey) Williams are attorneys in Florida. Again, all of this is easily verified through the State of Florida's website and the State Bar.

These people also were connected with Legal Mediation Practice, which was a debt consolidation firm that is no longer is business. The addresses were the same a year ago.

H & P, obviously, stands for Henrion and Pooler... and by the dates, you can see that H & P came about not longer after the other company closed around October 2008. It appears the they went from debt consolidation to focusing on collection of payday loans.


Gary Henrion is a Business Broker or Real Estate developer of some kind.

Tammy Mackey/Tammy Williams is listed as the Treasurer for both H & P as well as Legal Mediation.

Duane Romanello was the registered agent for Legal Mediation, but not for H&P initially. Mr. Romanello specializes in bankruptcy, real estate and collections.

Contacted me twice on this number by a lady name Angela Cuddle appearing to get money. Stated
that I had an old loan out and being charged with Check Fraud. Person also directed me from
the 678 number to a 877-205-2906 number. When asking for the phone number to the creditor
Namakan Capitol, they were unable to give me this information. I called the creditor after
finding the number on a bankstatement from 2009- didn't realize I still had this on me.
The rep. from Namakan Capital said that they wree not filing any complaints against me.
This was a loss on their part and the loan was included in BK. Persons from 877 number
are scamming folks and becoming persistent even when BK is brought up and my case #. I
found this very strange that they would not listen to a BK case back in 2009-2010. They
came across as being quite desperate to obtain money.

Sanscrainte may think he is sly, but there is one thing that he overlooked. His client utilizes caller id spoofing (putting misleading information on the caller id). I could make an easy case of misrepresentation on that alone.

Hung up as soon as I asked if she was a paid employee. They do not show up on NY States Charities info page (http://bartlett.oag.state.ny.us/pfc/index.jsp)
and while the NY CHarities Homepage lists them (http://www.charitiesnys.com/charities_new.html), their filed tax returns shows that 1) they have multiple extensions and excuses and are behind on filing taxes, and 2) They raised over 7 million in both 2008 and 2009, but salaries and benefits are over 4 million, and after fees and expenses they lost money in both years (over 300,000 in 2009.) The Director Of fundraising made over 150,000 and while the company, which is out of Dearborn MI, the CFO/President Kyle Efflet is from Knoxville TN. This smells very fishy, and should be investigated. Where is your money really going? The Company's financial reports state that they have affiliations (via grants) from the Cancer Fund of America.

Have you been getting unwanted and harrassing calls from 813-899-1569? Be aware that there system is set up to verify your phone number. When you call back you are prompted to leave a message to be removed from their call list. This verifies your number as active! They then sell your number to other companies or telemarkers who hope to gain your business. Consider that Network Marketing (MLM), and work from home businesses are big these days. Everyone is trying to sell time shares, candles, coins, gold, silver, health supplements, etc. Be aware that these MLM are set up to on personal interactions... cold calling. Now there are many businesses like this that profile you and sell your info to people and business in an attempt to funnel customers to them and one that are interested in those products or serivces.

Now how do you go about finding out about a company? Well it is easy today with computers and the internet! Simply Google the number or if you have any info on the company then that's all you need! Next you need to Google or look up this company and find out what state they are in... if you don't already know. Once you have that, then search that state's Secretary of State (S.O.S.) website. Next you will find a place where you can search for business names, incorporation filings and such. Then click on it and there you go! Be aware that each state's site and info shown maybe different.

Okay so now you have all of this info at your finger tips and IT IS PUBLIC KNOWLEDGE... so what do you do with it? Good question! You have many options. You can write the company or principle agent a Cease and Desist letter and send it Certified Mail! This is imporant as you want a record! You can also file complaints with the BBB, the Federal Trade Commission, Federal Communication Commission, as well as the Attorney General's office for each state they operate in as well as your home state. You can also contact you local public Prosecutor and have them write a letter to the person(s) or company. Or you can take the info and have a your attorney write them a Cease and Desist letter. If they fail to comply, then sue them!

Don't be sue happy people! When people go over board with legal suits like in the medical field for example, then courts put "caps" or limits on what you are able to obtain. That really hurts those who have a real claim.

Okay, so there you go people! Don't just leave a complaint here that blah blah blah company is calling and harrassing you! TAKE THE NEXT STEP... file complaints on them. When I file a complaint against a company, I flood them. I post their info here as I have doen here and them I file complaints with Angies List, the BBB, FTC, FCC, Attorney General, Chamber of Commerce. When you have lots of people do this, you get action real quick!

DENVER – Colorado Attorney General John Suthers announced today that his office has filed a lawsuit against Western Sky Financial, a South Dakota-based online lender, and its principal, Martin A. Webb, for making unlicensed, high-interest loans to Colorado consumers.

According to the lawsuit, filed in Denver District Court, the company made more than 200 loans to Colorado consumers since at least March 2010, during which time it was NOT licensed with the state. The loans to ranged (sic) in value from $400 to $2,600 and had terms ranging from seven months to 36 months. The loans' annual percentage rates ranged from 140 percent to 300 percent. Under Colorado's Uniform Consumer Credit Code, lenders making subprime loans MUST be licensed with the Office of the Attorney General. Because Western Sky Financial made loans with interest rates higher than 12 percent, it must be licensed.

The Federal Trade Commission went after them starting in December 2009 and action against them was finalized in February 2011 with a permanent injunction and fines of around $9,000,000 (yes, that's million) which was suspended due to the people claiming they were broke. The $9,000,000 was based on estimated losses incurred by people due to the actions of the Heather gang. If you wade into the FTC stuff their is actually a phone number to the individual FTC attorney's office that handled it. I called and the woman that answered said they get calls all the time from Heather, Rachel et al. She said she had talked to the attorney in the office and they all agree it's illegal, they try to stop it, but these people clearly don't give a shit (Heather, Rachel). So, there you have it. this is the result of 411.com reverse phone look up, i answeared this call and it was a male recorded voice attempting to tell me i had won something, i immediately hung up for fear of fraud or scam..not interested what ever it is...its probly a scam of some sort...

I just got a call on my PERSONAL cellphone from these @holes. I called back and asked where they got my number from and they hung up right away.

This is a SCAM people!

I once went to a car show and applied for a trip and ever since I've been getting these calls and it's a scam. They tell you you've won a trip and that you only have to pay for a certain portion. They will ask for your credit card...ha!

I just got a call from this number also on my cell phone...it was an automated male voice saying something about me having been selected and to press "1" for my promotional gift...something like that. I hung up right away for fear that it was a scam.

Got a call and it was a message saying "congratulations, you have been selected....." that was enough for me to hang up. I pay all my bills ontime.....therefore, NOONE should EVER call my cel unless they know me personally or if its an emergency. Anyone else can go F#$K a sock of needles.

"WTF", while your attitude is admirable, your first response should not be "How do I pay?" but "Prove I owe!" Make sure GRC duns you on paper, as required of them within five days of first contact, before you cut any deals.

When skip tracing, debt collectors must answer to privacy regs within the FDCPA, hence the obfuscation reported by "Mysterious Girl" and others. Of course, being shadowy works in their favor to make call targets anxious. Calls not meant for are best silenced with a cease-comm via USPS Certified with card. The FTC and many consumer watchdogs explain how to draft one.

I also don't buy NW's quality control story from March 2009, given that GRC has all along been perfectly willing to display a full number in the 513 area code. 513-605-7537) If you peruse the underlying WCU comments, there are some pretty damning ones about hostile and nonsensical skip tracing. By the way, CID spoofing just turned illegal almost six weeks ago with the signing of the 2009 Truth in Caller ID Act.

Back in July, "Me" was correct in that the FDCPA bans calls which incur a charge. It does not apply to "any bill collector", only third parties to the account. Otherwise only a similar state law would help. Speaking of which ...

I was seen in the ER Dept at a hospital in Florida while on vacation in March 2009. In May 2009, I received a bill from HRRG for services given while I was in ER. After some investigation, I was able to determine that HRRG was/is a collection agency that TeamHealth used/is using. When I contacted TeamHealth I found out that they had sent my original bill to the right name, right street address, BUT WRONG CITY & STATE!! After clarifying the address, TeamHealth sent me a bill which I paid. Also sent a letter to them explaining what happened.
In regards to those of you who are unable to pay your bills, you need to contact the health care provider (hospital, doctor, etc.) and find out the address that they want you to send a monthly payment to. Then you need to set up a monthly automatic payment from your bank to the health care provider. The amount can be as little as $5.00-$10.00. The main thing is that you pay SOMETHING MONTHLY to the health care provider, and not to HRRG. I have written a sample letter that I have used several times for several bills when I got sick and became unemployed for several months.

(You could add, “Please contact HRRG and notify them that I will be making monthly payment to your business office/accounts payable office so that HRRG needs to end any attempt to contact me. If HRRG continues to contact me, I will forward copies of everything that I receive from HRRG to your office.”

Also, if you owe money to a hospital, some of them have “Charity Forgiveness” where they “Forgive” your bill because of your unemployment status. You will have to complete a comprehensive financial report; however, it is worth the time. I had a few thousand dollars “Forgiven”. PTL!!
In regards to the telephone calls, you need to keep a log of each phone call, who you talk to (or who won’t talk to you), and what you talked about. It is EXTREMELY IMPORTANT that you talk in a calm, professional, & business-like voice no matter what the caller says. Do NOT get angry. They want you to get angry. Use the broken record technique, such as, “I have made arrangements with ____________Hospital and am sending them a monthly payment. Please contact ___________Hospital for further information.” “Repeat message." “Repeat message again and again and again.” Remember to use a calm, business-like voice. Do not get in an argument with the caller--it will get you nowhere.
As to the letters that state that you hadn’t paid yet—you can contact your bank and ask them to verify whether the check has been processed. If it has, then you can send a copy of the front and back of the check to HRRG (and file their letters without worry.)
I hope that this helps. Yes, I worked for a health insurance company for a couple of years. These hints are some of the things that I learned that make it easier in regards to paying your bills.

Here is the transcript of the call we got. Female voice and script is very similar to "Rachel" calls heard here in the past couple of years. The canned message, as so often happens with these goons, stupidly assumes a live respondent even if a machine answers. Therefore we yet again do not have the opening of the message.

".... urgent that you contact us concerning your eligibility for lowering your interest rate to as little as six-point-nine percent. Your eligibility expires shortly, so please consider /this/ your final notice. Please press the number 'one' on your phone /now/ to speak with a live operator and lower your interest rate. Or press the number 'three' to discontinue further notices. Thank you, and have a great day."

Here it is with phonetic spelling and other indicators of accent and inflection:

This script is almost verbatim the same as one heard here and transcribed for WCU in July 2009 by "Disgusted in TX" and "James Bond", and also by "Stormy" in April 2010, heard via this number: 402-982-0771

Clearly this ruse must be working on someone, somewhere, or they would have changed the patter by now. I would hardly be surprised if the missing front end was also the same and even reused a favorite fake rep name like "Heather" and "Rachel". My Summer 2009 questioning of the inherent illogic remains: How can this be a "final notice" if they need to be told explicitly never to call again?

There is little I could add here to the learned remarks of "Annoyed" from April 2009. A few states have some form of "repose" law, which renders a debt legally nonexistent once it passes SoL. North Carolina passed an Act in September 2009 which calls past-SoL collection or litigation "unfair". This sort of provision frankly needs to be echoed nationwide, since by the time a debt account has changed a few hands its chain of title is usually too distorted to have standing anyway.

Make the FDCPA your new pal and learn how to exercise your rights as an alleged debtor at FTC-dot gov.

Bill COllector for an account that wa Closed in 2009 with Cogeco Cable of Burlington ON. WAS for a 180 Bill that Cogeco added after I had asked to have my service Terminated, and and Zero balnce was owing after the disconnection. It WAS supposed to be looked after in November 2009, but wasnt. We'll see if this one works out. Cogeco did commit to re-Zero the account and to inform the collections agency. This time I asked to send me proof after they zero the account (Again!).

At FTC�s Request, Court Stops Deceptive Telemarketing Calls Pitching Credit Card Interest Rate Reduction
At the request of the Federal Trade Commission, a federal judge has put a stop to three companies� allegedly deceptive telemarketing calls, including robocalls, that promised to reduce consumers� credit card interest rates; frozen their assets; and appointed a receiver to take control of the business.
According to the FTC�s complaint, over the past two years, the defendants made or authorized calls to consumers nationwide, claiming that they could negotiate with credit card issuers to substantially lower the interest rates on the consumers� credit cards. They also allegedly delivered prerecorded �robocalls� that consisted of urgent-sounding messages from �Card Services� or �Financial Services,� stating that consumers needed to �press one� to speak to a representative about their credit card interest rates. Many consumers believed the calls were from their credit card issuers.
Consumers who signed up for the defendants� services were charged from $499 to $1,590 up-front and promised their money back if the callers failed to deliver at least $2,500 in interest rate savings, the FTC alleged. Instead of arranging reduced interest rates, the complaint states, the defendants sent consumers instructions to pay down their credit card debts early, thus saving money on interest. Consumers who complained and demanded refunds allegedly were denied outright, got the run-around, or had a $199 �nonrefundable fee� deducted from their refund.
�The last thing debt-ridden consumers need is to be deluged by illegal robocalls � especially when all the calls are offering is a scam,� said FTC Chairman Jon Leibowitz.
The FTC�s complaint alleged that AMS, Rapid Reduction, PDMI, and their owners violated the FTC Act and the Do Not Call and other provisions of the Telemarketing Sales Rule by:
� deceptively promising consumers they could reduce their credit card interest rates;
� misleading consumers about their refund policies;
� illegally calling numbers on the National Do Not Call Registry;
� failing to honor consumers� requests not to be called again; and
� making pre-recorded telemarketing calls to consumers without their express written consent. Nearly all such calls have been illegal since September 1, 2009 (see press release at: http://www.ftc.gov/opa/2009/08/robocalls.shtm).
U.S. District Judge Lonny Suko has issued an order appointing two receivers to take over the businesses, and freezing the assets of Advanced Management Services NW LLC, doing business as AMS Financial, Rapid Reduction System�s [sic] LLC, and their principals Ryan Bishop and Michael Rohlf, all of Spokane, Washington, and PDM International, Inc., doing business as Priority Direct Marketing International, Inc. (PDMI) of Bedford, Texas, and its principal William Fithian, of Colleyville, Texas.
The FTC vote approving the complaint was 5-0. It was filed under seal in the U.S. District Court for the Eastern District of Washington on May 10, 2010. The court granted an order temporarily barring the alleged conduct on May 10, 2010. The seal was lifted on May 11, 2010, the day the Commission served the temporary restraining order.

Payback? Consumer lawsuits against bill collectors skyrocket

WASHINGTON — Shawn Traylor of Stamford, Conn. , still doesn't know what the debt was for or how much it was.

He did know it wasn't his, and he knew he wasn't going to pay it.

So when bill collectors started calling four to five times a day in March, Traylor, a 39-year-old finance officer, sent them a letter asking them to verify that the unknown debt was his.

When he got no reply, he sent another letter, this time by certified mail, asking that they stop calling his home since they never verified that he was the delinquent account holder.

Instead, Traylor said, the collection agency called the next day. "And the day after that, and the day after that and the day after that," he recalled.

Sergei Lemberg , Traylor's attorney, said the continued calls after Traylor asked in writing that they stop were a violation of the Fair Debt Collection Practices Act. The law bars debt collectors from using abusive, unfair and deceptive tactics to force consumers to pay.

Since the recession hit in 2007, federal lawsuits filed under the Fair Debt Collection Practices Act have more than doubled, while complaints about problem collectors have skyrocketed.

In addition to Traylor's lawsuit, which is in settlement negotiations, Lemberg's firm has filed about 1,500 such lawsuits in the past three years. He said the economic downturn has created a nightmare for cash-strapped borrowers and lenders now saddled with delinquent accounts.

"I think debt collectors have become more aggressive by necessity because folks just have less money. And how do you collect more from people who have less money? You have to become more aggressive," Lemberg reasoned.

As a result, consumers feel cornered. "And consumers are more likely to think legal when they're being cornered" Lemberg said.

The numbers suggest he's right. In 2007, nearly 4,400 federal lawsuits were filed for alleged violations of the law, according to WebRecon, a website that tracks the filings for the collections industry.

As the recession deepened, the number rose to 6,000 in 2008 and then to nearly 9,300 in 2009. This year, filings are on pace to reach nearly 12,000, said Jack Gordon , the president of WebRecon.

Unlike Lemberg, Gordon doesn't think the filing frenzy is rooted in the recession. He said the spike in lawsuits began years before the economy tanked. The greater culprit, he asserts, is the Internet.

"You can't type the name of a collection agency into a search engine without getting bombarded by (advertisements) from consumer attorneys begging you to call them before you pay a penny to a collection agency," said Gordon, a former debt collector who left the business over frustration with frivolous lawsuits.

Generally, debt collectors can't contact you at inconvenient places or times, such as at work or between 9 p.m. and 8 a.m. — unless you okay it. The law also prohibits bill collectors from threatening violence, using profane language, or using the phone to annoy someone. Collectors also can't lie or misrepresent themselves or the amount a consumer owes.

The law requires that collectors, within five days of first contacting a consumer, send a written "validation notice" that gives the name of the creditor, the amount owed and what to do if you dispute the debt.

Gordon said "gray areas" of the law make it hard for collectors to follow the guidelines and do their job. For instance, the law requires debt collectors to identify themselves in messages left for consumers. But it also prevents them from telling others about a person's debt.

"So if you get a (phone) message from a collection agency, you can claim they disclosed the debt to a third party because your buddy heard the message," Gordon said.

Websites such as Debtorboards.com and DebtorsFoxhole.com, also tell consumers the ins and outs of filing lawsuits to block overzealous collectors.

"People find their way to a website like that and then they're suddenly greeted by a community of people who tell them: 'You don't have to take that, you can sue. Here's how you do it.' They provide the instruction, the legal advice and the moral support," Gordon said.

Costs are an even bigger driver in the lawsuit surge. In most cases, it's cheaper for collection agencies to settle rather than fight a case, Gordon said. A collection agency can spend $10,000 to $15,000 to defend itself in a lawsuit. If the consumer wins, the agency will likely have to pay their opponent's legal fees as well.

"Now you're looking at $30,000 to $40,000 just for choosing to fight the case and not having won it outright," Gordon said.

Violations of the collection law can provide up to $1,000 in statutory damages and can include additional "actual damages" for mental, physical and emotional suffering. Plaintiff's legal fees are often awarded as well.

A borrower's actual debt isn't automatically erased with a victorious lawsuit. How the debt is resolved, however, can become part of the settlement negotiations.

Nonetheless, collections company tactics can be aggressive.

Philadelphia attorney Brent Vullings said: "Our concern is not with the underlying debt. Our concern is how they go about trying to get it and that's exactly what the (law) is in place to assist consumers with."

It wasn't until 2008, when millions of people lost jobs and were unable to pay their bills that problems with bill collectors really took off. Awash in red ink, credit card issuers declared as losses, or "charged off," $53.5 billion in uncollectible accounts in 2008 and nearly $81 billion in 2009, according to CardHub.com.

As collection agencies hired more people to handle the bad accounts, complaints about bill collectors exploded.

Debt collectors didn't crack the Federal Trade Commission's top 20 list of consumer complaints in 2007. In 2008 and 2009, however, they logged more than 224,000 FTC complaints — second only to identity theft.

Vullings said that many complaints stem from mistaken identity, in which a collector wrongly thinks the actual debtor is on the phone.

"I've had collection agents tell people, "I know it's you,' 'don't lie to me,' 'stop skating the issue.' I get that all the time, Vullings said. "So you can just imagine what's being said and done to a person who actually has the underlying account."

Here is where it gets real interesting though. I decided to research the owner's name given above, Jason Jackubec. He appears to have been a player in various buffalo collection agencies, all of which seem to break every law out there for consumer protection.

I decided to search "jason jackubec ny" on Google. It corrected me, apparently the proper spelling is "Jason Jakubec". One reference comes back to another buffalo collection agency, there is also one from classmates.com and FaceBook. Classmates says jason is a 2000 graduate from Wilson High School in Wilson, NY. Being sure to have the right person, I looked up where Wilson is located. North of Buffalo about 30 miles. Just a small town it looks like... but get this, guess what town is right next door? Newfane, NY... sound familiar? See the corporate filing above for Interstate.

Ok so now we have the right guy... but what is this maple road address? I did a google maps/street view search of the address. Comes back to a ritzy looking house, that's right a house... a private residence. So off we go, who's house is this? Started to dig a little more. Second link on google at www.ypsort.com/main/ny/newfane/ shows a name and phone number for that address:

Wait a minute... who is Richard Elia? Second page on google says he is the Executive VP of Sevenson Environmental Services in Niagara Falls. Well the location of his company makes sense, the location of his house definitely makes sense. But how and why is he tied to a collection agency. Time to dig deeper yet again!

Remember that facebook search that came back on google? Well for being such a big shot, he isn't big on privacy! Clear as day, right out there is all his info! His profile is wide open! Oh, and his profile does confirm all that information, plus it gives his cell phone number, personal email, and his birthday in case you want to wish him a happy one! Back to Elia though...

I decided to check out his friends. He has 249, so start scrolling through the list! Page 3, first hit, jessica elia. Page 5 rachel elia. No richard elia though. Well I have facebook, let's search for elia's in wilson high school... nothing. But we definitely have Jason linked to the Elia family. So back to google we go.

I'll start with some common sense. Jason is class of 2000 so let's focus on his class. Going back to google searching for wilson high school alumni, I come across a new site, mylife.com. Enter the name Richard Elia and Newfane and let it ride. Well, it happens to bring up other people related to the same address as Richard Elia along with his age (56). It shows a Karin and a Joseph H Elia. Time to start making assumptions. Richard Elia must be a father! Remember, Jason is in his mid 20's as facebook shared. So let's find out who this Joseph Elia is... maybe he is our guy. Same site, just change the first name to Joseph. Guess what, comes back to a 26 year old matched up with Richard. I can't get any more info without registering but I have a name.

Joseph H Elia - let's google it. Not finding much on him, all i see is a Joseph Elia from Newfane winning some money at the Niagara Falls casino in a poker tournament. That would make sense, degenerates to tend to fall into collections. Well I'm at a loss nothing. Back to square one.

So as a final result, I decided to search "northtown capital joe elia". You're not going to believe this one. 1st result on google, guess what I find: Elia, Joe, Northtown Capital & Associates. Jakubec, Jason, Northtown Capital @ Associates - DBA Conference attendees. There it is clear as day! DBA - Debt Buyers Association. It is apparently a conference where these agencies go to buy and sell debt. A meet and greet of the scum of the earth!

So here are your owners! Jason Jakubec and Joe Elia... do some searches... actually, if you want to have fun, get Jason's cell phone number from his facebook page and start harassing him like he has been harassing us! Oh, and don't forget... file complaints with the Attorney General in both your state and in New York. New York's attorney general is not messing around anymore when it comes to collection agencies who break all the rules! I'll keep digging into this and update if I find out anymore information.

You’re Dead? That Won’t Stop the Debt Collector

MINNEAPOLIS — The banks need another bailout and countless homeowners cannot handle their mortgage payments, but one group is paying its bills: the dead.

Dozens of specially trained agents work on the third floor of DCM Services here, calling up the dear departed’s next of kin and kindly asking if they want to settle the balance on a credit card or bank loan, or perhaps make that final utility bill or cellphone payment.

The people on the other end of the line often have no legal obligation to assume the debt of a spouse, sibling or parent. But they take responsibility for it anyway.

“I am out of work now, to be honest with you, and money is very tight for us,” one man declared on a recent phone call after he was apprised of his late mother-in-law’s $280 credit card bill. He promised to pay $15 a month.

Dead people are the newest frontier in debt collecting, and one of the healthiest parts of the industry. Those who dun the living say that people are so scared and so broke it is difficult to get them to cough up even token payments.

Collecting from the dead, however, is expanding. Improved database technology is making it easier to discover when estates are opened in the country’s 3,000 probate courts, giving collectors an opportunity to file timely claims. But if there is no formal estate and thus nothing to file against, the human touch comes into play.

New hires at DCM train for three weeks in what the company calls “empathic active listening,” which mixes the comforting air of a funeral director with the nonjudgmental tones of a friend. The new employees learn to use such anger-deflecting phrases as “If I hear you correctly, you’d like...”

“You get to be the person who cares,” the training manager, Autumn Boomgaarden, told a class of four new hires.

For some relatives, paying is pragmatic. The law varies from state to state, but generally survivors are not required to pay a dead relative’s bills from their own assets. In theory, however, collection agencies could go after any property inherited from the deceased.

But sentiment also plays a large role, the agencies say. Some relatives are loyal to the credit card or bank in question. Some feel a strong sense of morality, that all debts should be paid. Most of all, people feel they are honoring the wishes of their loved ones.

“In times of illness and death, the hierarchy of debts is adjusted,” said Michael Ginsberg of Kaulkin Ginsberg, a consulting company to the debt collection industry. “We do our best to make sure our doctor is paid, because we might need him again. And we want the dead to rest easy, knowing their obligations are taken care of.”

Finally, of course, some of those who pay a dead relative’s debts are unaware they may have no legal obligation.

Scott Weltman of Weltman, Weinberg & Reis, a Cleveland law firm that performs deceased collections, says that if family members ask, “we definitely tell them” they have no legal obligation to pay. “But is it disclosed upfront — ‘Mr. Smith, you definitely don’t owe the money’? It’s not that blunt.”

DCM Services, which began in 1999 as a law firm, recently acquired clients in banking, automobile finance, retailing, telecommunications and health care; DCM says its contracts preclude it from naming them.

The companies “want to protect their brand,” said DCM’s chief executive, Steven Farsht. Despite the delicacy of such collections, he says his 180-employee firm is providing a service to the economy. “The financial services industry is under a tremendous amount of pressure, and every dollar we collect improves their profitability,” he said.

To listen to even a small sample of DCM’s calls — executives played tapes of 10 of them for a reporter, electronically edited to remove all names — is to reveal the wages of misery, right down to the penny.

Dear Chairman Leibowitz:

I am dismayed to learn from recent media reports that some debt collection companies have made it a practice to attempt to collect unpaid credit card balances – and perhaps other types of unsecured debts – from the families of the deceased. According to numerous reports, these companies call surviving relatives, often shortly after the death of a loved one, to coax or cajole them into making payments on the deceased relative’s credit card. To say the least, this practice is distasteful and unethical. Moreover, this practice may very well violate the Fair Debt Collection Practices Act. I am hereby requesting that the Federal Trade Commission investigate whether debt collection companies are violating the law when they engage in this practice, and exactly what information they are conveying to surviving relatives who are under no obligation to pay off their loved ones’ credit cards.

The Fair Debt Collection Practices Act, among its many prohibitions, prevents debt collectors from contacting anyone other than the credit card holder without the prior consent of the holder. Specifically, the Act provides that “a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.” “Consumer” is defined in the Act as a “natural person” who owes a debt. If this language does not apply to a situation in which the consumer is deceased, I would like to know the basis for such an opinion.

I find it shocking that a debt collection company would determine that it is worth causing profound anguish and embarrassment in order to collect debts that are sometimes as low as $50, or which result in a payment of $15 a month from a widow or widower who is struggling to make ends meet. If a debt is large enough to be worth collecting, there are legal ways to obtain payment. First, if a surviving family member has also signed for the card, that family member will be obligated to pay the debt. Second, an unsecured creditor such as a credit card issuer can obtain payment from the estate of the deceased through a routine probate proceeding, after the holders of secured debt – such as mortgagors– are paid. This practice of harassing living family members for upfront payments results in putting credit card issuers in the front of the line to get money from an estate, rather than after those who hold secured debt.

Given the current economic situation, in which millions of honest, hard-working Americans are struggling to meet their obligations, this practice is opportunistic and destructive.

In addition to opening an investigation into these practices, I would like the answers to the following questions:

Which debt collection companies (“collectors”) are engaging in the practice of collecting credit card debt from widows, widowers, children, and other relatives of the deceased?

Which credit card issuers are hiring these collectors, or selling their debts to these collectors? Have the issuers endorsed this practice, either by turning a blind eye toward it or by specifically encouraging it?

Does the practice of trying to collect unsecured debts from the living relatives of debtors who have passed on violate the Fair Debt Collection Practices Act’s prohibition on communicating with third parties? If not, why not? What measures could be taken to make sure that these practices are stopped?

If these practices are currently legal, are these collectors uniformly making sure that they tell living relatives that they have no legal obligation to pay the debt? Further, are the collectors informing the living relatives of the statute of limitations for collecting these debts? Are the collectors informing the living relatives that any credit card debt would be paid from the estate only after other secured debts, such as mortgage and car payments, are paid?

Given that the FTC receives more complaints about debt collection companies than any other American business, I hope and expect that you will be thorough in your investigation of this matter.

The debt collectors are behaving badly again. This time they're hitting up surviving family members for money that's owed by the dead!

The New York Times reports that some collection agencies specialize in this somewhat morbid pursuit. Collectors even receive "sensitivity" training to deal with grieving relatives. They'll speak in hushed tones on the phone like a funeral director and refer you to a legitimate grief counselor if necessary.

In most cases, you have no legal obligation to assume the debt of a late spouse, sibling or parent. But the collectors will never tell you that.

The only states where there is a possibility that a surviving spouse may have some responsibility for a debt are "community property states" -- Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington and Wisconsin.

In such states, an executor/executrix or administrator (in the event there is no will) may be responsible for assessing the estate to see if there's money to pay out to creditors.

But in general, if you get a call from these slimeballs, know that you likely don't owe them a penny.

Sales call center with HQ in the Philippines, reportedly with several top corporate accounts. Collected wisdom on Global Contact Services LLC indicates they like to bend if not break Federal DNC rules. In spring of 2009 many related calls were connected to insurance sales campaigns with a claimed affiliation to Bank of America. It appears this campaign has begun again in Spring 2010.

Some BoA reps, when challenged, have called GCS practices fraudulent. GCS reps are said to be rather shifty when challenged on their employer's identity. It is unclear whether BoA (or any client) actually underwrites the offered services. It sounds likely that BoA has sold customer contact data to GCS to operate as a third party and walked away from oversight.

New Rule Prohibiting Unwanted "Robocalls" to Take Effect on September 1, 2009

Telemarketers Must Obtain Prior Written Approval from Consumers Who Want to Receive Such Calls
Beginning September 1, 2009, prerecorded commercial telemarketing calls to consumers – commonly known as robocalls – will be prohibited, unless the telemarketer has obtained permission in writing from consumers who want to receive such calls, the Federal Trade Commission announced today.

“American consumers have made it crystal clear that few things annoy them more than the billions of commercial telemarketing robocalls they receive every year,” said Jon Leibowitz, Chairman of the FTC. “Starting September 1, this bombardment of prerecorded pitches, senseless solicitations, and malicious marketing will be illegal. If consumers think they’re being harassed by robocallers, they need to let us know, and we will go after them.”

The new requirement is part of amendments to the agency’s Telemarketing Sales Rule (TSR) that were announced a year ago. After September 1, sellers and telemarketers who transmit prerecorded messages to consumers who have not agreed in writing to accept such messages will face penalties of up to $16,000 per call.

The rule amendments going into effect on September 1 do not prohibit calls that deliver purely “informational” recorded messages – those that notify recipients, for example, that their flight has been cancelled, an appliance they ordered will be delivered at a certain time, or that their child’s school opening is delayed. Such calls are not covered by the TSR, as long as they do not attempt to interest consumers in the sale of any goods or services. For the same reason, the rule amendments also do not apply to calls concerning collection of debts where the calls do not seek to promote the sale of any goods or services.

In addition, calls not covered by the TSR – including those from politicians, banks, telephone carriers, and most charitable organizations – are not covered by the new prohibition. The new prohibition on prerecorded messages does not apply to certain healthcare messages. The new rule prohibits telemarketing robocalls to consumers whether or not they previously have done business with the seller.

Under a previous rule that took effect on December 1, 2008, telemarketing robocall messages by businesses covered by the TSR must tell consumers how to opt-out of further calls at the start of the message, and provide an automated opt-out mechanism that is voice or keypress-activated. Prerecorded messages left on answering machines must also provide a toll-free number that connects to the automated opt-out mechanism.

After September 1, consumers who receive prerecorded telemarketing calls but have not agreed to get them should file a complaint with the Commission, either on the donotcall.gov Web site or by calling 1-888-382-1222.

He advised he has evidence I have made purchases for drugs on the internet in violation of some law (he cited the "law" by name but I cannot make out what exactly he is saying at all.) I did a reverse call look-up on the number 916-491-9401 and discovered this number is a land line phone located in Sacramento CA belonging to someone called CA Sacramento. Sounds like a bogus name but it also was a completely bogus call.

These people have been calling my house, my cell phone, my work and my mother. They say I owe for a loan they deposited into my account in December 2009. I did not get a loan in Decemeber of 2009 and I do not owe these people. They have been harrassing me for 2 weeks now saying I am going to jail if I don't pay them and yelling and cussing at me when I will not verify any of my information with them. Do these forgieners really think they have the right to come into our country and take advantage of our people? I have reported this to the police, the BBB and the district attorney's office. They all know about it and say it's a fraud and they are going to add them to their fraud alert list. Well if they know all of this, then why the hell haven't they done anything about it???!!!??? I am at a lost as to what to do, I have had my cell phone munber changed and have been fired from work because of the harrassing calls all day.

What does this mean for small business borrowers? When Utah regulators seized Advanta bank, the FDIC was named receiver and could not find a buyer for Advanta’s operations. For borrowers who owed money to Advanta Bank, “right now the FDIC is the owner of those loans,” Jones says.

Some Advanta borrowers have already had their debts sold to third-party debt collectors. Advanta’s seizure shouldn’t affect them. It’s unclear whether it will affect those whose debt is now owned by the FDIC.

Advanta issued exclusively small business credit cards. In 2007 the bank was the fifth-largest issuer of small business bank credit cards (which excludes American Express and Discover), with 1.3 million accounts and $14 billion in annual payment volume, according to The Nilson Report, a credit card industry newsletter. Business owners often use credit cards for convenience to cover every day expenses. Many also use them as a source of longer-term financing in lieu of bank loans or credit lines.

Many Advanta borrowers, hit by rate hikes, have been trying to negotiate lower payments and interest rates, and at least one group was seeking class action status for a lawsuit against the bank. The FDIC received 976 complaints about Advanta raising interest rates in the 18 months leading up to Jan. 2009. Advanta stopped making new credit card loans and cut off credit to existing customers in May 2009. By that time, the bank had become notorious for repricing interest rates, sometimes to over 30%, on cards opened with 0% APRs or other low teaser rates. In July, Advanta settled with the FDIC over rate hikes and agreed to pay $35 million in restitution, without admitting nor denying wrongdoing. Advanta Bank’s parent company, Spring House (Pa.)-based Advanta Corp., filed bankruptcy under Chapter 11 in November.

In filings with regulators, Advanta reported $205 million in loan charge-offs in 2009. In December, the bank reported $1.62 billion in assets and $1.52 billion in liabilities.

Advanta’s seizure is unlikely to have much effect on the availability of credit for small businesses. Advanta cut off all new lending, including to existing customers, last year. The most significant consequence may be whether those borrowers trying to renegotiate their payments and write down their debts will have an easier time doing so now that the FDIC is their creditor.

November 2009 Got a call today on a debt that is now under the SOL. I tried years ago to settle with these guys and 2 other creditors but they were not willing to settle so i had no other choice but to not pay.

I just learned today from this great site that the SOL in California is 4 years. This debt goes back to 2004 so I'm safe. The guy on the phone was a complete jerk.. now what do I do If I get a notice in the mail threatening legal action or a judgment? Go ask over at www.collectorsexposed.com on the forum...

October 2009 My husband obtain a credit card through Bank One NA in 1995 and stop paying the card in 1997, the credit card was charged-off in November 2001. He began receiving calls from various collection agencies in December 2006, we stated to the various debt collectors that this debt reached it SOL. It bounced around for a year in a half until it reached AAC. He received a summons in the mail stating that he owed $ 4800 and was bang sued. We went before a judge and the lawyer stated that he owed the debt and we stated that the account was charged off in 2001. the judge ordered them to submit a Bill of Particulars and they submitted a copy of a faxed copy of a statement that stated my husband made a payment in December 16, 2006, which is untrue. Because a few weeks later we began receiving collection calls and I had to file a complaint with the FTC and BBB in regards to the threats made by the previous collection. In my Grounds for Defense I listed that this debt exceeds the SOL, iI have his credit reports that go back to 2005.

October 2009 Well, I'm not quite sure where to start with these guys. In April of last year I sent them a c&d asking them to verify that they owned my account. As expected, nothing ever came. Almost a year later, the phone calls have started again. I have been ignoring them, waiting to the breaking point of madness before I would speak my mind to them. I finally did. The young lady on the other end of the phone stated, there was nothing on my record stating they got the C&D.

Long story short, I filed with the BBB of Western Michigan and today I got a response from Asset Acceptance. It was photocopies of my original documents that I signed. Yep, I signed them. However, the information that was listed was somewhat inaccurate.

My point. Is this just another scheme that a bottom feeder uses. The debt is close to the SOL, and I know that when things get there the flood gates start to be open and everything flies out. (If need be Bud, I can forward the paperwork to you and you can take a look).

September 2009 I've been getting calls from Asset Acceptance Corp. My mom took the calls and they left their contact info. I figured it was some scumbag trying to pull a fast one, instead of calling them back I got online and did some research which is how I found this website (thank god for the Internet). Today I received a letter from them pertaining to an old Wamu/Providian Credit Card Account opened in 99 which I stop paying on back in 03 or early 04 because of a charge dispute with them.

The SOL here in Louisiana is 3 yrs for Credit Cards. I know this account has since been charged off. I checked my credit report and found the same Wamu/Providian Credit Card # listed twice with Chase but with 2 different high balance amounts, however I could not find it listed with Wamu/Providian. I have never had any cc accounts with Chase until the end of 2007 at which I was approved for and received an Amazon Chase CC for 400.00. I feel that if I owed Chase anything for an unpaid CC account they would not have approved me for a CC period. I had another scumbag company Called CACH LLC trying to collect on this same Providian account up until last year they finally gave up and stopped.

There ought to be a law against people like this getting into our credit reports, altering information, and harassing consumers. I'm 47yrs.old lost my husband in 99 to a brutally violent crime I've raised my 3 children on disability & soc sec with the help of my mom. I do not want to be harassed about something that is totally worthless. The letter states that I have 30 days to dispute the validity of the debt or they will assume the debt is valid, it also says they will obtain a copy of a judgment. I have never had any judgments against me for anything and don't want any now. I am sending a dispute NOTICE & DEMAND FOR DEBT VALIDATION I have enough going on in my life to worry about then having to deal with these sorry scumbag lowlifes?

June 2009 I think we should call them 400 times a day trying to collect on the debts they have and also invent some from supposedly owing money to places that went out of business in 1880 they do this to us so we should do this to them and have a original amount of 1600 add up to 600 billion from interest accruing since 1880 see how they like their own fraud used against them

June 2009 Received a call from Amy Wright at AAC. She stated they were not a collection agency but a finance company. She was trying to collect on a debt that was charged off in 2001, is she a lair, are they for real? What are my options?


Asset Acceptance Corp is very good at lying. They are not a finance company , they are bottom-feeder junk debt collectors with ankle high b.s. Your state has a three year statute of limitations, they had to stop reporting it at seven years from the charge off date. That account is under a lot of dust as well as their colorful lines of crap. Asset, like most junk debt collectors is low on fresh accounts, so they have descended into the abyss of old, out of stature debts to collect. Management must have one heck of a time motivating collectors to convince consumers to pay, so they simply lie and misrepresent to status of the debt in hopes of earning a paycheck. I suggest that you make them spend as much money as possible. Wait for the mandatory written notice, send them a dispute validation letter. They can call and ask you to pay, you can refuse and keep their meter running for a very long time.

September 2009 I can't believe it. These bottom feeders sent me a letter for an alleged debt from First Premier bankcard from 2000. They got this from Arrow Financial. Is this even collectable - it's way too old! What the hell is it going to take to clean the credit/collections industry up? This is nothing short of extortion. How in the hell to these A-holes get away with it? Because it's out of control and no one wants to do anything about it! 7 years on credit reports is crummy, it should be 3 MAX - At my rate, this will go on for the next 100 years as one CA will sell it to the next - this is NOT right and needs to be corrected!

September 2009 Just received the collection letter in the mail from Capital trying to collect on an old Sears account charged off way back in 1997. They say I owe over $18k. The balance was never anywhere near that. Since those days we have cleaned up our credit to the point of purchasing two residences, and enjoying o% financing plans on our vehicles etc. . I'm wondering if they stuck this back on my credit report as I have been receiving notices of rate increases and my credit card companies lowering my credit limits. If so, what should I do, especially since this activity will snowball and all together create an ever worsening credit score.

September 2009 I have been receiving calls from Capital Management for months. Each time, I have politely told them they have the wrong number, as no one by that name lives here. I suppose they don't believe me, as they keep calling and calling and CALLING! Yesterday they struck my last nerve! It probably didn't help that we're having a record heat wave... I answered the phone and went into my "you have the wrong number, no one by that name lives here, please stop calling us" routine, only to have the guy at the other end of the phone, talk OVER what I was saying. How rude! I found myself getting LOUDER and LOUDER to talk over him! I asked him to STOP HARASSING ME, YOU HAVE THE WRONG NUMBER! And..."Let me speak to your manager." He refused, so...I picked up a whistle I had on the counter and blew it as loudly as I could into the phone. I have to tell you, after months of these irritating calls from Capital Management, that felt pretty darn good! Then I hung up. The phone rang almost immediately, this time the caller i.d. gave a Buffalo NY # and didn't say "Capital Management" on it. But it was the same guy. He said, "I can't believe you did that!" I replied, "I can't believe you keep calling!" I asked again to speak to his manager and he refused, and started blathering at me again. I hung up. The phone rang again...."anonymous" calling. It was him, of course. This harassment continued for a good half an hour. In between the calls (which I wasn't answering, of course...not that it stopped them), I called Capital Management directly and asked to be put on their No Call List. I was told I would be...but as soon as I hung up from that call, Anonymous called again--and again--and again. ARRGHHH!!! I've filed a complaint with my state's attorney general. Not that I think it will do much good...

September 2009 These people call me at home, cell, work and my HR folks at work at all hours…early, late, 7 days a week. I never talk to them…I did leave a message a few weeks back to stop harassing me at work and the calls stopped for a while. This is about a debt that has not been paid on since 2001. I’m in S C. Is there anything I can do?

May 2009 After harassing phone calls at work from Capital Management I quit answering the phone when there number came up. They finally got tired of that so they threatened to send a fax to the Human Resource department on my voice mail. They did this last week. Human resources had the paper from them to verify my employment and who my boss was and how much I made. The name of the company was on the header. Is this illegal? Are they in violation? I told my company not to fax this back to them. They said they will not. This will tick them off. This has
not even gone to court and they are pulling this. Can I sue these jerks for this?

Capital Management pays out a lot of money in lawsuits. It is illegal for them to make your debt known to a third party. That fax may give you a free ticket to suing them. I am sending you to an excellent NACA attorney who can assist you and perhaps put some money in your pocket. The collectors working there are not too bright, many may have drug and alcohol problems. Call the attorney, make them pay.

April 2009 Hired by Original Collector to collect on a account I am behind on. They called asked for me and then a lady proceeded to be nice and tell me they had a financial hardship program they wanted to work out with me. She asked me if I refused to pay the account, I said no, then said she needed to calculate how much my monthly payment would be. Well she didn't return to the phone! A man did and he said he was a supervisor and started yelling at me saying I needed to borrow the money and I could settle the account for a lower amount. They are sneaky crooks! I should have known after seeing them on Dateline in their scam operation.

March 2009 Received a call from 877-211-9178, co called CM Services. Some little bitch wanting to know property address for filing a lien on a credit card that was last paid on in 2001. Tried to tell her she was too late, just went off trying to impress me in her Buffalo accent of my potential problems.

We edited your letter, liked the accent. They are Capital Management Services, Buffalo, NY. They have a bad reputation for threats, posing as someone they are not and using various scams to get money. Your state statute was four years, she is a little late. I am aware that their legal counsel is still paying off on claims so anyone dealing with their latest con should tape their calls, (where legal.) A good tape could (potentially) make it very easy for your consumer attorney (contact me for a referral) to negotiate a settlement, if warranted. January 2009 I was called today by my great aunt patty who is 95 yrs old and in a assisted living home. This company called her looking for me regarding a legal matter. I live in FL and she lives in NY. Sadly I have only met my great aunt about 4 times in my life, I am 29. I would never list her as a reference. Anyways, I called them and they blind transferred me to a supervisor Mr Young. He was rude, would not give me the name or account # of the credit card he was saying I owed. I asked that he send me verification. He refused. He kept demanding my credit card information to make payment. I of course refused. After being yelled at and belittled by him I hung up. I do not know what to do. I have credit problems and have been trying to correct them. I have been taken advantage before and given my card to a creditor that I thought I owed and was taken for all the money in my checking account. I had to change banks to get them to stop taking my money. I am going to look over my credit report I may owe this debt but I am scared to give them my credit info. Also the debt they say I owe is from a credit card opened in dec 2004 and last payment was dec 2007 and it has been delinquent for 36 months.

NO! Your state statute has already run out, so has their right to report it in your credit files. We are receiving a number of complaints on Cap Management collectors, all are old, stale, out of statute debts. Be VERY careful about sending them money as some states allow that just one payment restarts the debt collection clock. Don't fall for the lies or the threats of a desperate debt collector. It's winter and they are in Buffalo, NY, do you think they could be a bit desperate? This agency appears to be hurting because they can't obtain 'fresh' paper, so expect the calls, threats and lies to increase dramatically. You do NOT legally owe a debt that is past your state statutes. If you need assistance, get in contact with us, save your money!

January 2009 I received a letter from them about an account with Elite Recovery Services. I called CMS three times in one evening to try and figure out what the heck is going on. Not once did they read me the mini miranda. Sounds like the Elite failure caused the portfolio to be sold to Capital.

I have received 28 phone calls on caller ID since February 8th, 2010. This does not count the numerous calls received prior to this date. I also have gotten over 31 calls from "unavailable" in this period of time. I have told them in August of 2009 and in October 2009 to stop calling but this only lasted for 3 days and the calls started again! Today, when I answered the number which I usually ignore, it took 7 minutes for someone to get on the phone to let them know they are calling the WRONG number and have been warned twice already! I got hung up on by the first 2 operators. The third operator argued with me that my number has been taken off, I heard this back in Aug. and Oct. I have both parents very ill and a grandfather ill who is 92. When that phone rings, I think it is an emergency since they are the only ones who use this number.I am totally fed up with these people! Does anyone have advise for me. I am already on a "do not call" list. I feel like calling them 100's of times for the next 6 months! Very aggravated!!! FYI they are looking for someone I never even hear of!!! Yet insist this is her number even though I don't even know ANYONE with the name they are looking for!!!!!

A Toledo man appears to have forgotten an unwritten rule for wanna-be police officers: Don’t pull over any real cops.

And according to Perrysburg Municipal Court records, Nicholas C. Douglas, of 2442 Lawrence Ave. was still on probation for a previous impersonation conviction when he stopped and detained an off-duty Northwood police officer at the Woodville Mall last week.

Mr. Douglas was arrested Wednesday at his home by Toledo officers carrying a Northwood warrant charging him with impersonating a peace officer. Following a preliminary hearing yesterday in Perrysburg Municipal Court, the case was continued until Feb. 20. Mr. Douglas has been released on $2,500 bond.

Sgt. Ken Campbell, a Northwood detective, said off-duty Officer Michael J. Wilkinson entered mall property while test-driving a vehicle on the evening of Jan. 30. Mr. Douglas pulled him over with several aggressive driving maneuvers, questioned him, and told him he was trespassing on mall property and would be arrested if he did not leave.

While Mr. Douglas did not specifically claim to be a police officer during the incident, his actions - including stopping and questioning the off-duty officer - constitute impersonation, Sergeant Campbell said.

Northwood police hope to speak with other people Mr. Douglas may have pulled over, threatened, or otherwise accosted, the sergeant said. Police have spoken with one woman whom he allegedly ticketed, and have received witness reports of other patrol stops Mr. Douglas is accused of making, he said.

On July 25, 2002, Mr. Douglas pleaded no contest in to an impersonation complaint from Perrysburg Township police. He received a suspended 90-day jail sentence and two years’ probation. The township police did not respond to a request for further details about that case.

Mr. Wilkinson said he did not identify himself to Mr. Douglas as a police officer because he had heard about the previous encounters and wanted to see what Mr. Douglas would do.

"I just let him dig a deeper hole the more he talked," the officer said.

According to Officer Wilkinson’s subsequent report, Mr. Douglas was operating a black Chevrolet Lumina marked "Public Safety" on the doors and "Chief Enforcement Agent" and "Community Response Unit" on the fenders, according to Officer Wilkinson’s report. The car was equipped with red strobe lights in its taillights, white strobes in its headlights, and a blinking green light near its visor, the officer said.

Mr. Douglas claimed first to "work for the state of Ohio," then later said he was working on behalf of mall tenants, though not for the mall itself.

Hey to all about this Douglas guy. I think most of us are recenlty seperated Veterans. Why he choose to target us, i have no idea. The facts are real! He is a convicted FELON. He's done this a lot, and actually he's on parole in the state of Ohio. He promises a great job, takes your money, and that's that. I've done a TON of research about this guy. Sucks though huh? sounds like a dream job... Anyway this is what i did, he didnt get me for my money. I did however email the Toleto Ohio police department with all the information, website, promises, the 1500 as a sign on bonus, and the 800 inital fee for the training. I asked them to email me back so i know what's going on. Do the same!

It's not slander, Nick, if it's true. Your Criminal Record is a matter of public record. No need to be an investigator to find out. You are not licensed by any state. Your parole officer may just be getting a call. That's revocation. Remember what the judge told you? You can get half of your original sentence handed to you for this violation plus operating without a license and god help you if you have any weapons. Try to stay out of trouble, try to find another line of work. In a short 20 years you will be able to work this field again as long as you stay outta trouble....Godd luck to you nick.

GEESE - really? these people have nothing better to do. i REFUSE to pay for something that i've already discussed with T-Mobile. I shut my phone off in August of 2009 [i had 2 lines, the 1st line i had transfered, the 2nd i asked to be cut off...] i got a bill in December 2009, saying we owe 800+ dollars!?! it was supposed to be shut off, long ago & they were charging us for each month, but we never used the other line & they can see the history! these people are getting to the point of harrassing. i'll pay the cancellation fees $400 dollars; but as far as paying the entire amount when there "customer service reps" have no idea what there doing, that's not my issue!

First, thank you to the authors of each report recorded on this web page! The phone rang unexpectedly one morning recently. I happened to be scratching Pichu's tummy and reminding her she's the best puppy in all the land, so I was unable to get to my phone across the room. (Pichu is my seven year old. She looks just like a 68 lb snow white wolf, but she'a big, harmless baby and demands nothing,) so I see I see there is a voicemail a few minutes later and the above number is listed in my missed calls menu. The caller is female and states, "This is not a solicitation it is a business call." She identifies herself as "Theresa Bailey." She continues and informs me that I should return her call as soon as possible. When I returned this call, the connection begins with "You have reached MedCorp , we are unable to take your call at this time - we are working with other customers. Please remain on the line and we will be with you as soon as possible." I had never heard of this firm, Ms Bailey and I didn't know of any business link with 'these folks,' and I became skeptical and curious. I had no reason to believe, furthermore, that there was any shred of validity to the event and its claims. Later that day, my girlfriend called this number. She stated she, too, was greeted with a recording, but said it was Not mentioned that she had "reached MedCorp," rather she was told she was in line. The only answer I know to this query, is in the comments I discovered of people posting on this page. The call is related to a series of quite similar calls from the 502 area code, less revealing, yet highly documented with a web page like this one. There is one and only one reason I received a call from this number and I am and consistently have been committed since February of 2009 to selflessly satisfy repeated attempts by agents employed by a hospital here in Georgia who have doggedly sought to get me to pay them $26,000 for treatment I voluntarily sought and received because I would have died had I not done so. While I remain alive, I was unable to resume employment and I have no money, assets, or otherwise negotiable resources left to offer the hospital or its outsourced confederates. I have never been without a job for more than three days. I say this because I have done precisely what I knew I wanted to do since I learned as a child that work is never a curse or a misfortune. Rather, it is love made visible. I spend every day like I would spend a wounded eagle and if one's longing to serve his fellow man is not always springing forward, then one is always dying. I have applied for work at the very hospital where I was treated, in vain. I am eminently qualified as an executive chef, with not only many (20+) years of documented success on many levels, most importantly; I served thousands in my community recently, all by myself, and for nine years, 100 hours a week, simply because I couldn't help it.
For work now, I'll do anything.I will gladly clean toilets, listen while any boss tells me why he's boss, the reason he married his cousin, I'm too old, he can't pay me much. Even offering to pay the medical bill $10 a month I don't have is not allowed. The funniest thing of all is that it wasn't even mentioned until upon discharge, and that's where the fun started. Since then, I have been threatened by rude and ill-mannered phone calls, and lots of extra attention from their Land Of Triple Exclamation Points abundantly finds my mailbox. Meanwhile my partner struggles to pay all of the bills without complaining. By September 2009, I have cheerfully learned that we can save a little more money because I only eat on Monday, Wednesday, and Friday. I sold everything I owned on eBay and Craigslist and could care less. Her (my partner) daughter, 22, returned from 10 months military - Marine-duty. I was in the Navy four years after receiving appointments to and one year college at the US Naval Academy in Annapolis. I disenrolled after a year, I was young and really didn't respond to people the way others did when superiors practiced screaming an inch from my face.
So now we're a family. This Christmas, while there wasn't money for gifts, and no tree, I made a beautiful 24 foot peace sign in the front yard out the 200 and some huge rocks I've removed from the property over two years. It can be viewed with Google or anyone who drops by to add their own personal rock. A few hours after the huge symbol was completed on Christmas Eve, my inseperable girlfriend drove her daughter to our favorite and only nearby hospital so her daughter could deliver a seven pound eight ounce baby girl! It was a memorable Christmas eve and the hospital was again perfectly compassionate and the mother was allowed to keep her baby and return home, even though the bill of $25,000 hasn't yet been enforced.
Lastly, the hospital knows none of this. This web page is the only record that such absurd contradictions exist peacefully side by side.
Funniest and most interesting to me is the people who need a special oath to which they must adhere, not one time ever called and said, "How are you feeling," "are y'all doing okay?" but I guess what I'm hoping is that if they really seek even monetary closure, they could be a little creative and hippocratic and, instead of vitriolic threats of litigation, why not a fitting "If we find out, Mr. Vann, that you haven't been eating your vegetables, (practicing skills to improve your health) we gonna send someone from MedCorp over there to beat your ass!" I have received a call from Allied International credit corp, 100 East shore drive, 3rd flr, Glen Allen, Va. 23059. They have called every day starting 27 Dec 2009. On 30 Dec 2009 I sent a certified letter stating under the Fair Debt Collection Act that they were not to call again. I last received a call on 9 Jan 2010, until today20 Jan 2010 they called again, a clear violation of the FDCA. I also want to add that starting on 15 Jan 2010 I started getting calls from Phillips & Cohen Associates. Today I received a letter from them on this same issue. Tomorrow I will be sending a certified letter to them. Before Allied it was West Asset Management that called until I sent them a certified letter to stop calling.

The number belongs to Medical Recovery Specialists, who represent that they are not subject to the requirements of the Federal Trade Commission's Do Not Call Registry even after being informed that their automated calls demanding payment of medical bills by persons who do not owe any such are in violation, and they refuse to remove telephone numbers of persons, such as myself, who have requested that they do so over a period of more than 5 months.

This last call occurred on CHRISTMAS EVE at 12:18:00 P.M. CDT 12/24/2009 and the FTC site exhibited the following message:

I am debt-free, but I live in a rental house and I believe I get collection calls/mail for everyone who has EVER lived in this house. I blocked their number, but I plan to further resolve this issue by moving and by turning off my landline phone.

Call received back in Sept.2009 from 207-512-5089 APP CONSMER SVC on Caller ID. Today (16 Dec. 2009) received a call from 207-512-5086 APP CONSMER SRV. Please note they changed the last digit of the phone number AND they changed the spelling of the abbreviation for the word "Service" from SVC to SRV. Boo-hoo, now I have to enter the new hang-up telemarketer info. onto my blacklist blocker software. This will give them a, satisfying-to-me, one-ring disconnect.
Since this summer of 2009, I have listed over 200 separate would-be phishing/hang-up telemarketer/car warranty & credit card interest lowering, etc, etc, ad nauseum, phone numbers/Caller ID Names on my blacklist. Today, besides this specific one changing their Caller ID Number/Name by one digit and a slight spelling/abbreviation change, I've received two others pulling the same trick. Hoping to get around my blacklist blocker, guess they were hoping I'd be stupid enough to pick up the phone. Nope, instead, I just Googled the "new" Number/Name, verified they are reported online as hang-up telemarketers, and added thewm to my ongoing blacklist. Taking time/effort is worth it when all day long we hear just one ring and then my system disconnects them.
BTW, all this idiotic nonsense began within a week or so of when we signed up with the DO NOT CALL National Registry. Tried to reoport the violators but when the DNC National Registry investigators attempt to call the hang-up telemarketers, the phone numbers are nearly ALWAYS no longer a woreking phone number. If lawmakers or law enforcement groups or the FBI or anyone with capabilities of tracking down and shutting down these hang-up telemarketers, they could arrest, trial, and hang the scum, as far as I'm concerned, for all the grief & aggravation they give us all. Hanging is pretty drastic, but just the example of a few getting hung could put a STOP to it. Phones ringing and hanging up all day long, disturbs our peace in the home. Drives some folks nuts. I really firmly believe that NO ONE would ever knowingly be a customer of a business that uses hang-up telemarketers to aggravate & totally annoy consumers.
Do what you can to help fight these idiots. Keep sharing with others whatever you learn. If you EVER have the opportunity to encourage punishment/enforcement/law-making against these idiots, please use you persuasion to help us all put an end to this form of annoying telephone stalking. Overview
Global warming has become perhaps the most complicated issue facing world leaders. On the one hand, warnings from the scientific community are becoming louder, as an increasing body of science points to rising dangers from the ongoing buildup of human-related greenhouse gases — produced mainly by the burning of fossil fuels and forests. On the other, the technological, economic and political issues that have to be resolved before a concerted worldwide effort to reduce emissions can begin have gotten no simpler, particularly in the face of a global economic slowdown.
After years of preparation for climate talks taking place in Copenhagen through Dec. 18, 2009, President Obama and other leaders announced on Nov. 15 what had already become evident — that no formal treaty could be produced anytime soon. Instead, the leaders pledged to reach a placeholder accord that would call for reductions in emissions and increased aid to help developing nations adapt to a changing climate and get access to non-polluting energy options.
This would in theory give the nations more time to work out the all-important details. Negotiators would then seek a binding global agreement in 2010, complete with firm emission targets, enforcement mechanisms and specific dollar amounts to aid poorer nations.
At the heart of the debate is a momentous tussle between rich and poor countries over who steps up first and who pays most for changed energy menus.
Within the United States, Congress is similarly fighting over legislation on climate change. The House in the summer of 2009 passed a bill outlining a cap-and-trade system that could, over the next few decades, lead to an early end to conventional use of coal and oil, fuels that have underpinned prosperity and growth for more than a century. But between stiff opposition from energy interests and the overwhelming distractions of health care reform and the economy, the legislation has stalled in the Senate.
In international discussions over climate, Mr. Obama has urged other countries not to be discouraged by the stasis on Capitol Hill, pointing to big investments in energy efficiency, solar and wind power and his move to restrict greenhouse gases using environmental regulations.
In the meantime, recent fluctuations in temperature, seized on by opponents of emissions restrictions, have intensified the public debate over how urgently to respond. The long-term warming trend over the last century has been well-established, and scientists immersed in studying the climate are projecting substantial disruption in water supplies, agriculture, ecosystems and coastal communities. Passionate activists at both ends of the discourse are pushing ever harder for or against rapid action, while polls show the public locked durably in three camps — with roughly a fifth of American voters eager for action, a similar proportion aggressively rejecting projections of catastrophe and most people tuned out or confused.
Background
Scientists learned long ago that the earth's climate has powerfully shaped the history of the human species — biologically, culturally and geographically. But only in the last few decades has research revealed that humans can be a powerful influence on the climate as well.
A growing body of scientific evidence indicates that since 1950, the world's climate has been warming, primarily as a result of emissions from unfettered burning of fossil fuels and the razing of tropical forests. Such activity adds to the atmosphere's invisible blanket of carbon dioxide and other heat-trapping "greenhouse" gases. Recent research has shown that methane, which flows from landfills, livestock and oil and gas facilities, is a close second to carbon dioxide in impact on the atmosphere.
That conclusion has emerged through a broad body of analysis in fields as disparate as glaciology, the study of glacial formations, and palynology, the study of the distribution of pollen grains in lake mud. It is based on a host of assessments by the world's leading organizations of climate and earth scientists.
In the last several years, the scientific case that the rising human influence on climate could become disruptive has become particularly robust.
Some fluctuations in the Earth's temperature are inevitable regardless of human activity — because of decades-long ocean cycles, for example. But centuries of rising temperatures and seas lie ahead if the release of emissions from the burning of fossil fuels and deforestation continues unabated, according to the Intergovernmental Panel on Climate Change. The panel shared the 2007 Nobel Peace Prize with former Vice President Al Gore for alerting the world to warming's risks.
Despite the scientific consensus on these basic conclusions, enormously important details remain murky. That reality has been seized upon by some groups and scientists disputing the overall consensus and opposing changes in energy policies.
For example, estimates of the amount of warming that would result from a doubling of greenhouse gas concentrations (compared to the level just before the Industrial Revolution got under way in the early 19th century) range from 3.6 degrees to 8 degrees Fahrenheit. The intergovernmental climate panel said it could not rule out even higher temperatures). While the low end could probably be tolerated, the high end would almost certainly result in calamitous, long-lasting disruptions of ecosystems and economies, a host of studies have concluded. A wide range of economists and earth scientists say that level of risk justifies an aggressive response.
Other questions have persisted despite a century-long accumulation of studies pointing to human-driven warming. The rate and extent at which sea levels will rise in this century as ice sheets erode remains highly uncertain, even as the long-term forecast of centuries of retreating shorelines remains intact. Scientists are struggling more than ever to disentangle how the heat building in the seas and atmosphere will affect the strength and number of tropical cyclones. The latest science suggests there will be more hurricanes and typhoons that reach the most dangerous categories of intensity, but fewer storms over all.
Steps Toward a Response
The debate over such climate questions pales next to the fight over what to do, or not do, in a world where fossil fuels still underpin both rich and emerging economies. With the completion of the United Nations Framework Convention on Climate Change at the Earth Summit in 1992, the world's nations pledged to avoid dangerously disrupting the climate through the buildup of greenhouse gases, but they never defined how much warming was too much.
Nonetheless, recognizing that the original climate treaty was proving ineffective, all of the world's industrialized countries except for the United States accepted binding restrictions on their greenhouse gas emissions under the Kyoto Protocol, which was negotiated in Japan in 1997. That accord took effect in 2005 and its gas restrictions expire in 2012. (The United States signed the treaty, but it was never submitted for ratification, in the face of overwhelming opposition in the Senate because the pact required no steps by China or other fast-growing developing countries.
It took until 2009 for the leaders of the world's largest economic powers to agree on a dangerous climate threshold: an increase of 2 degrees Celsius (3.6 degrees Fahrenheit) from the average global temperature recorded just before the Industrial Revolution kicked into gear. (This translates into an increase of 1.3 degrees Fahrenheit above the Earth's current average temperature, about 59 degrees).
The Group of 8 industrial powers also agreed this year to a goal of reducing global emissions 50 percent by 2050, with the richest countries leading the way by cutting their emissions 80 percent. But they did not set a baseline from which to measure that reduction, and so far firm interim targets — which many climate scientists say would be more meaningful — have not been defined.
At the same time, fast-growing emerging economic powerhouses, led by China and India, still oppose taking on mandatory obligations to curb their emissions. They say they will do what they can to rein in growth in emissions — as long as their economies do not suffer. The world's poorest countries, in the meantime, are seeking payments to help make them less vulnerable to the impacts of climate change, given that the buildup in climate-warming gases so far has come mainly from richer nations. Such aid has been promised since the 1992 treaty and a fund was set up under the Kyoto Protocol. But while tens of billions of dollars are said to be needed, only millions have flowed so far.
In many ways, the debate over global climate policy is a result of a global "climate divide.'' Emissions of carbon dioxide per person range from less than 2 tons per year in India, where 400 million people lack access to electricity, to more than 20 in the United States. The richest countries are also best able to use wealth and technology to insulate themselves from climate hazards, while the poorest, which have done the least to cause the problem, are the most exposed.
In Copenhagen in December 2009, negotiators had planned to try to settle on the basic terms of two new global climate agreements. One would renew the commitments of countries bound by the Kyoto emissions limits; the other would rein in emissions of all countries to varying extents, depending on their wealth and emissions history. Given the many competing interests, and the reality that any big emissions shifts would have substantial economic impacts, the negotiations have been called one of the most complex diplomatic challenges ever.
Democratic leaders in the United States Senate continue to try to follow the lead of the House of Representatives by securing passage of a bill aiming to sharply cut greenhouse gas emissions by 2050. The chief mechanism would be a "cap and trade" system that sets a gradually declining ceiling for over all emissions. Companies and institutions could buy and sell credits from one another as a way to curb emissions at the lowest cost. Companies that made deeper cuts than required could sell credits to companies that fell short of their targets.
But a national preoccupation with the slow economy and competing issues, led by health care, threaten to delay or weaken such legislation. Another impediment is the shortage of money flowing to basic energy research and large-scale demonstrations of non-polluting energy technology. While the Obama administration and Congress directed some stimulus money toward such efforts, such spending comes only after decades of declining investment in these areas.
President Obama came into office vowing to take swift action on climate change, and under him, the Environmental Protection Agency has declared that it will regulate carbon dioxide emissions. But with the cap-and-trade bill facing an uncertain future in the Senate, his ability to take big steps on the issue has been severely constrained, and without significant actions by the United States, China and India had made it clear they would remain on the sidelines. Just weeks before the planned Copenhagen session, he and other leaders gathered for an Asian summit announced that no treaty would be reached in 2009. Instead, leaders will try to reach a political agreement that could be the basis for new treaty talks in 2010.
In the meantime, a recent dip in emissions caused by the global economic slowdown is almost certain to be followed by a rise, scientists warn, and with population and appetites for energy projected to rise through mid-century, they say the entwined challenges of climate and energy will only intensify.

Then he called her and got her name off of her voicemail and text her back with it. Then he text that he was going to f^ck the sh^t out of her. This guy is obviously a creep. These people have called 39 times since Dec. 03, 2009, thru Sunday Dec. 06, 2009. My payment was due and sent on the 2nd, and to have received 39 calls in a 72 hour period is ludicrous, my payment is not considered late until the 15th of the month, now from what they spend on long distance phone calls, and mind you, they never leave a message, you would think in todays economy, they would leave a message and save some money. I have called GE and asked to lodge complaint with their procedures at which they replied if I had paid my bill in a timely manner we would not be having this conversation, I advised them that if this is how they conduct their business I will never do business with them again.

So, I understand that some people do not like to use their credit cards over the internet. I replied to the woman that I would accept a cashier's check or a money order, and once that is received by me and validated I would process her order.

She wanted my home address...not my post office box, so I knew something was going on. I contacted my director who informed me of a scam. I let the lady think I would fall for it so I could get her address and information to contact the authorities.

So she mailed my "check" via FedEx to the false address I gave her. I went to FedEx, picked up a FAKE CHECK for $1,800.00. Her avon order was $240.18. Of course, she wanted me to cash the check and western union the difference to Latunya Fowler. The check was written on Mountain Mineral Law Foundation in Westminster, CO. I contacted them also, and informed them of the scam. On the check, the "M" in "Mountain" was partially missing and the abbreviation for Colorado was not capitalized. The paper was cheap as well.

I have been in contact with the authorities, and was told that this fraud ring expands to Florida. But they're going down now!!!

When she was told that I cashed the check (of course I didn't - it was handed over to the state police) she called my phone 27 times in an hour from 1-866-747-7352 and then she tried scrambling the number to 1-186-674-7735

Hi, both number are from california, I got a call 0n 11-12-2009 from 760-526-8108, no left message, got a text on 11-11-2009 from a 619-252-2340, offering a gift card, and to go to a page(www.giftsnow101.com)to collect my gift or to call 877-808-9348 to stop replies. when calling 619-252-2340, got a voice mail, was a guy from the KKK asking for money, can u all believe this, the KKK asking me for money, call the number and try, i left a nice message in the voice mail.

I have received the following calls: 11.7.2009 @ 9:23 a.m., 11.6.2009 @ 2:25 p.m. & 9:18 a.m., 11.5.2009 @ 3:55 p.m. So four (4) calls in three (3) days. When I answer everytime they start this message, "My name is ______ and I am calling on behalf of the new healthcare reform...." I usually stop them there and tell them I am not interested, but by reading a lot of these comments I realized I am not saying the right thing. Just simply tell them "take me off of your calling list or put me on your do not call list." I am the first one to admit that I HATE, no DISPISE, well maybe LOTHE is more appropriate, telemarketing calls, but I realized that they are just trying to make a living too.

Now with all that being said I have added my number to the DO NOT CALL REGISTRY and some do not realize that it usually stays on the DO NOT CALL REGISTRY for five (5) years and then you have to re-register. Another face some do not realize is that politicals calls like "employee" said way down the comments, are exempt from the DO NOT CALL REGISTRY. I work in a Registrar of Voters office and if your phone number is listed on your voter registration record it is considered public record and can and will be purchased by companies to use on calling lists and being on the DO NOT CALL REGISTRY does not exempt you from being called from these lists. So....

make sure you re-register yourself on the DO NOT CALL REGISTRY every five (5) years and call your local Registrar of Voters office and ask that your phone numbers be taken off of your record. Hope this information helps.

I received a call today from800-214-7887, but these people used 800-214-5362 on 5/30 and 6/12. On 6/2/2009 they used (214) 324-9575, which is their main number. They are sneaky.This is a collection agency called Commercial Recovery Systems of Dallas, TX. They are the absolute worst of a bad lot of scum sucking bottom feeders that give cat fish a bad name. The Fair Debt Collection Practices Act (FDCPA) is a joke to these vermin. Download the full 26 pages of the act from the fEDS.

A Mr. Evans called today and said that "he had received my case from a client, a bank, and that the IRS would be involved". No company mentioned. No "purpose to collect a debt" per FDCPA rules. Just a threat.

The stink of this call sent me back to my collection call log. On May 30, 2009 a Marcus Lee called from (214) 324-9575 and said that he was "processing a complaint against me in his department". He called back on 6/2; same threat. On 6/12 he upped the ante by saying that he was with the "Law Enforcement Division of CRS", and that he had a "complaint against me for falsifying information", but he was giving me the "benefit of the doubt". He concluded with "you have been notified".

These Lowlifes have been calling me since Aug. 14, 2009 today is Oct. 26, 2009 that's nearly 3 months now. I tried to ignore them, they would NEVER LEAVE A MESSAGE ON THE ANSWERING MACHINE. Have Called EVERY DAY sometimes 4 times a day. Finally I couldn't take it anymore picked up the phone and they asked for a Megan----Maybe the lowlife referenced here--Maybe she owes money anyway I YELLED AT THE LOWLIFE that there is NO MEGAN HERE. He wanted to know why I was angry----I said after nearly 3 months of this everyday I had ENOUGH. We've had this number for 20 years and we're listed---He knows who he's calling. I sent a Cease and Desist E-Mail to the CEO. One more call and I fill out the complaint form to the Attorney General!!!!!!!!!!!!I am not well and can't take ANY MORE OF THESE CALLS!!!!!!!!!!!!!!!!They have called from 202-367-9124---757-209-2045----410-968-7980---202-607-2543----434-533-9007. Every number comes up MRS on caller ID. The jerk wanted to know how I knew they were Debt Collectors--Dah--Internet---Google!!!!!!!!!!!!!!!!STOP CALLING

I guess I join the group that has been taken by this group. On 10-5-2009 placed an order for some ziplock sandwich bags to be used when sending coupons to the military bases overseas which is a project of mine. On 10-6-2009 my credit card account had been charged $56.93. (I had ordered previously so they had credit card number). To date I HAVE NOT RECEIVED THESE BAGS. I have called numerous times and am getting no response whatsoever. Upon reading the other comments here, I guess I might as well realize I have been taken. What I thought would be a nice gesture has turned into a real problem.

Call received 11:01 AM 10-17-2009. This is the continuation of a barrage of calls received during the month of September 2009. Calls come in at various times during the day and on weekends. DO NOT CALL protocol does not apply if a donation has ever been sent.

The caller ID only shows "OUT OF AREA", but I have TrapCall setup on my cellphone. However, the number was still masked even at TrapCall, so I answered it. Guess who - effin' MIDWEST PUBLISHING COMPANY, scam artists extraordinaire. They claim to solicit "charitable" donations for dozens of non-profits, including Narcotics Officers Association, Firemen's Charitable Fund, etc. I told them to stop calling me for the millionth time and hung up. I have *repeatedly* told them not to call me for ANY charity, fundraiser, or product they represent and to put me on their internal DO NOT CALL list. I do not donate to any charity over the phone, PERIOD. Yet they continue to call me, and it has gotten to the point of harassment.

They have somehow gotten my personal home phone number (though it is unlisted), and they call me all day long, from 8:30AM to 9:30PM at night. I blocked their number as well as any "anonymous" callers, so one of their asinine employees by the name of STEVE ROSZELL has taken to calling me at home all hours of the day from his PERSONAL CELLPHONE in an effort to get around my call block service. His cellphone number is 231-250-8006, so I'm guessing he works for the Midwest Publishing facility in Big Rapids, MI.

Here is a call history:

On 10/12/2009 they called me at 10:13AM and 11:47AM. The 11:47AM call is when I told them to stop calling me on my cellphone. Then the calls began on my home phone. On 10/12/2009 they called my home phone at 8:22PM, 7:43PM, 7:42PM, 5:27PM, 5:22PM, 4:56PM, 4:51PM, 4:50PM, 3:20PM, and 12:22PM. That's a total of 12 calls on 10/12/2009.

On 10/14/2009 they called me on my home phone number at 9:05AM, 10:13AM, 11:02AM, 1:05PM, 1:23PM, 1:24PM, 2:38PM (Steve Roszell's personal cellphone number showed), 3:17PM, 3:23PM, 4:10PM, 4:11PM, 5:35PM, 6:15PM, 6:16PM (Steve Roszell's personal cellphone number showed),7:38PM , 7:50PM , 8:58PM. On that same day (10/14/2009), they also called me three more times on my cellphone despite me telling them two days earlier to never call me again at that number: 4:12PM and 6:16PM That is 19 (NINETEEN!!!) calls IN ONE DAY from effin' Midwest Publishing.

Today, 10/15/2009, it started again bright and early on my home phone at 8:58AM, which was once again immediately followed by a call from Steve Roszell's personal cellphone number 231-250-8006) at 9:05AM. The tool is still trying to figure out how to beat my Call Block service. (Good luck, moron!) If that isn't harassment, I don't know what is. I'm seriously considering legal action at this point. I feel they will not stop harassing me unless I initiate a lawsuit! This is ridiculous.
