They are FRS, Financial Recovery Services. They are a collection agency that usually works on behalf of a third party debt holder. As such, they most likely are calling to collect on a debt that:

1. Is past the statute of limitations (check your state's statute).
2. May exist, but the records are incomplete to the point where they have no legal claim, and will attempt to intimidate you into paying.

You have rights under the FDCPA, which include cease-and-desist, as well as punitive damage claims up to $1000 per incident.

These... "people" will not identify themselves until you verify your name or the last four digits of your SS#. You have no legal obligation to give them this information, or to remain on the line. You can also tell them that "...under the FDCPA, I demand that you cease all telephone contact and mail copies of all pertinent financial records referring to this claim. If you continue to call and harass me, I have the right to sue under the FDCPA for up to $1000 per incident." And then hang up.

Hello,
Thanks for your email, I have decided to rent the house because we are going to spend more time here in Valdosta GA, my family and i will be here for about 3 years due the nature of my job. Let me start by introducing myself, I am hearing impaired and I must confess I am very new in this landlord business. However, I own the house located at; 37 Randlett St Quincy, MA 02170
2bed, 1 bath 1,110 sqft Single-Family Home, the initial plan was to sell the house but sometimes the Realtor inflates the price and it takes longer to sell, because of this reason we have decided to rent out the house to a responsible tenant that can take very good care of the property as we are not after the money, we want it to be clean and tidy at all time. Pets are allowed as long as they are not destructive. The rent is $1000 and security deposit is $600 and total move-in cost is $1600. Here is the number to text me (508) 444-2956 because of my hearing condition and i also check my email often so feel free to contact me via email or text message for any further inquiries. You can drive-by to view the outside and neighborhood of the house and get back to me asap so i can forward you the rent questionnaire.

I just got a call from this guy wanting $1000 for a YPO (Yellow Pages Online) bill from 2007. He started out pleasant then when he sensed pull back he became immediately aggressive and very rude. he said things like "I have a recording of you telling an 18 year old girl to go "F" herself." I actually grabbed a check and started to write it then did some checking and thinking.
So, "Jerry" if you're reading this....
1. I wouldn't sign up for this, nor would I agree to pay for something we already get for free.
2. A real professional wouldn't bring the F-bomb up, even if it were true. They say something like "We have a recording of you saying some disparaging things to one of our employees. Don't divulge what it is until I ask.
3. Only a desperate man would call back.
4. you never gave me any info like name, address, phone number. I'm using "Jerry" because another complaint did.
5. no credentials as far as being a collector, lawyer, etc..
6. I do give you some credit for being a doosh though. Good work! The problem is, I don't give money over the phone to dooshes.
7. You finished with "you have my number and no how to reach me?" I said no, then you hung up without giving it to me. Jeez "Jerry", what if I wanted to call you back with the money?
8. Don't be so quick to turn aggressive. I worked in customer service for years and noticed it was the super pushy aggressive ones that were always scamming, or trying to push buttons.
9. Referring to me as a "deadbeat who doesn't want to pay his bills" then failing to listen to me explain how I just needed more proof as to who I'm giving money too, is a direct indication of illegitimacy. If you'd have supplied something a little more concrete besides your verbal harassment, you could be $1000 richer right now.
10. thank you! Because of this I studied up on these kind of scams and now will never be manipulated by someone like you again.

Just trying to you helpful advice, doosh! (Sorry to call you that, I don't know your real name.)

SCAM - Don't fall for it! Robo Call, silence, then a Fake Microsoft computer repair technician answers with a claim that your computer is sending virus reports out to Microsoft. If you follow their instructions, your computer will no longer work at all. To have them "fix" it afterward costs $100 by credit card. Computer still will not work, and they keep control of it. People who have fallen for this have had thousands charged against their card with no way to recover lost money. They will not stop calling if you ask them to stop. Please report all calls to your State Attorney General's Office, FCC and FTC. An international cyber crime case against the criminals is in progress. They also claim you have won a $1000 Walmart gift card if you pay processing fees. It will cost you more than $1000 if you give them your information.

Got a text from this number that says, "Dear Walmart Shopper, Congratulations you have just won a $1000 Walmart Gift Card. Click here to claim your gift. www.mywmartgift.com (cancel: reply STOP)"

I pulled up the website because I had just recently did a survey (one of those from the bottom of the receipt from Walmart) to enter in to win a $1000 gift card. But the website is for one of those sites that you have to go through a bunch of crap to get to anything and agree to a bunch of crap too. It was obviously from one of those crappy spammer sites.

Sorry I used the word crap so much... I'm just ticked off....

This is an text message offering me a $1000 Walmart gift card. All I have to do is go online and input a number. Wow, how easy, and I get a $1000 gift card. This is the second time in the past week that I have received this email but from a different number. The scam is that if you input the number on the web site, it downloads a program that allows the scammers to access your computer, giving access to passwords and personal data. If received on your cell phone, I urge individuals to contact the FCC to report a complaint. The FCC actually assigns a case number, and begins follow up. Unfortunately, the cell phone number that is being used by the scammers, according to the news reports, is a throw-away.

Yet another jackass CC scammer with a robodialer. These people are lower than scum. The "Do-Not-Call" list is a joke. All it does is gives these jerks a list of known good numbers. They need to put some teeth into that law so that for any call to a number on the list costs the scum say, $1000 to the party called, and another $1000 as a fine to the govt.

Hi
We know that the business of FDCPA laws by a CA results legal action and the consumers can file a class action lawsuit against them.
So what happens when there are shady collection agencies like Allied Interstate Inc still in business? They call people endlessly without any details of the debts and show rudeness. They go against the Mini Miranda disclosure as mentioned in Section 807(11) of the fdcpa. The company is also famous for false representation of the accounts. You can be forced to pay some unknown account because of their wrong contact. Remember, "Allied Interstate" can be sued up to the $1000 depending upon the extent of damages.
I read many of you being victimized by this collection agency. Use the federal laws as a protection against such shady collection activities. Report them to the FTC, BBB as well as the State Attorney General office.
How many of you want Allied Interstate Inc to undergo legal actions. I am thinking of consulting an attorney and put a legal fight against them. I will like all of you to post your experiences here so that it can be documented. After browsing through this forum thoroughly, I picked some threads of their illegitimate business.

* The illegal activities of Allied Interstate. The poster in this thread said that the company wanted to settle the matter without any documentation. This is illegal.
* Allied Interstate making threatening calls to the family members. It is illegal as per the FDCPA laws.
* Here is an example of Allied Interstate not identifying them and making regular calls at work.
* This collection agency uses profane language and gets in contact with the wrong person.
* Allied Interstate will try to force you and make a payment on the debt that is past the SOL period. You are under no legal obligation to pay the debt if it is past the SOL period.
* One more thread about the misdeeds of Allied Interstate Inc.
* This company does not identify properly while leaving messages on the phone. They keep calling endlessly.
* Allied Interstate never stops. They contact persons who do not owe any money.
* Allied Interstate reviews the credit reports without permission.
* A thread on bombarding phone calls done by this collection agency.
* Threatening calls starting from early morning and ending just before 9.
* Allied Interstate harassing whole year
* Here is the contact address and phone number details of Allied Interstate Inc.
* Calls get disturbing for someone not related to the accounts.
* People are getting fed up with allied interstate and their calls. No phone numbers, no e-mails just mailing address but not sure whether it is proper or not. Contacting them is really tough.
* Confusion is still there on LVNV Funding and Allied Interstate.
* Allied Interstate Inc not following up with the cease and desist letter.
* Getting empowered on how to deal with Allied Interstate.
* Harassment with "person to person"

I keep getting calls to my personal cell phone from this company saying I have a past due amount of $1000+ on a Verizon account. They say this before they even verify that they are speaking with the right person. I have the same first and last name of the person they are trying to reach, but our middle initials are different. This is the thrid time I have received such a call from them, and the third time I have told them that (1) I have never had Verizon as a service provider, (2) I have never had an account go to collection, and (3) most importantly, they have the wrong guy! They promised to remove my number from their records...again. If this is a reputable company, they're not very professional. I told the agent this time that I thought this was a scam, that there are a lot of people out there phishing for information. Instead of trying to verify that he had the right person on the line, he just started flying off the handle about how RPM was a multimillion dollar company. Phbbt. Yeah, right. Don't give this company your information if the call doesn't seem like it's meant for you!

G: Probably that was an abandoned call, more a matter for FTC. Since you're past SoL, send NCO a cease-comm notice via USPS Certified with card. The FTC and many consumer watchdogs explain how to draft one. Anyone not the target of a skip trace can do the same.

Turning now to older entries here:

If you are receiving repeated, misdirected, and/or abusive calls from a third party debt collector, you may find relief in the provisions of the FDCPA, the federal law which regulates collector behavior and provides you simple tools for your own defense. It grants you control of how you are contacted, and the means to sue at low cost. Learn your rights and first response tactics at FTC-dot-gov. See also your state laws for additional support.

The DNC registry is for sales calls, therefore collectors are exempt. The DNC website tries to tell you as much when you register.

Blasting whistles or air horns, prank return calls, and other obnoxious behavior are not valid countermeasures. They may in fact draw special attention to your case and accelerate the path to a lawsuit. THEY must be seen as desperate, YOU must be calm.

JKY, whose father was in the debt industry, said of the statutory award, "There's no teeth to the law, you'll never get the $1000"

No, you won't if you sit on your hands, neglect to document all calls, and never draft a civil complaint. If you insist on trying to enforce a verbal cease-comm, true, your case stops dead. You must use the laws as intended to get satisfaction.

Allied Interstate, Inc is one of the most prominent collection agencies. According to one consumer, they make the most number of collection calls in the country. Consumers seem to have several grievances against Allied Interstate and their method of debt collection. If you want to know about the consumer grievances against Allied Interstate and how to deal with the collection agency when they harass you, check out the topics below:

* Common grievances against Allied Interstate collection agency
* What to do when you're harassed by Allied Interstate

Common grievances against Allied Interstate collection agency

* Making collection calls for debts that are not owed by the consumer. They may also report the same information on credit reports.
* Allied Interstate often sues consumers over debts they don't owe.
* Allied Interstate Inc. calls and harasses the relatives and family of the debtors.
* Not disclosing their identity while calling.
* Being rude and aggressive over the phone.
* Reviewing credit report without the debtor's permission.
* Violating FDCPA on several counts.

What to do when you're harassed by Allied Interstate

* Ask for identification: If you have been contacted by Allied Interstate, you may respond to their call and ask the caller to identify himself/herself. If it is a call related to debt collection, ask for their physical address.
* Debt validation: Send a validation letter via certified mail with return receipt requested and preserve the receipt for future references.
* Check credit report: Pull your credit report to check if they have it reported to the bureaus. If they have wrongly reported to the credit bureaus, you may dispute the same with them.

Sub: #2 Allied interstate Collections called me last night

Thank you David for this information as we just received our first phone call from ALLIED INTERSTATE collections last night on the answering machine from the no. 877-225-1118. Had to play the message 5 times to understand who was calling and after researching on the web found out it was a collection agency. Since neither of us owe anyone money, we do not plan on returning their call. Because of your information, I feel less guilty about ignoring them, since we have only had this phone number for a little over 6 years.

Sub: #3 Allied Interstate Collection Agency- Don't ignore their call

I will suggest you not to ignore the call of allied interstate collection agency. You will never believe how fraudulent their actions can be if you sound ignorant to them. Companies like "Allied Interstate" make wrong contacts with the people and even go to the extent of taking the matter to the court. Since you never thought of a reason to talk to them, Allied Interstate Inc will take the advantage and prove in the court that you were ignoring the debt account.

My suggestion is to fight back with this company and get the reason for which they are calling you. Check your credit report also to verify if they have hit your file negatively. If they don't have a legitimate purpose, you have a legal case against them.

Called at 3:33 PM Sunday afternoon, no message left. Folks, if you get a call and no one is there, keep hitting the POUND KEY, and then hang up. No one is there because it is a robot dialer and they will keep calling until they get a report on approximately what times of the day a human voice answers, and then they will have their own representative available. This has been going on for years, and Verizon and Attorney Generals will tell you there is nothing they can do, because the calls end up being traced to Hong Kong. Here;s why:
Someone outside the U.S., Hong Kong for example, buys a block of 10,000 numbers from your local phone company. They then re-sell them to scammers in the U.S., for instance 1,000 numbers at a time. So, a scammer will buy the numbers 283-0001 to 283-1000 ( a thousand total numbers) and robcalls will start dialing household numbers, for instance, they will call your house on Monday at 2:00PM, if no one answers, they will call back at 4:00 PM on Thursday. If someone answers, and they don't have an operator available, they will hang up, but now they know that a human might answer at around 4:00 PM on weekdays. So, they may call the next day around 4:00, and when you answer, they go through their spiel.
How to thwart them:
1) Look at the caller ID.
2) If it says "unavailable", or wireless caller, or Texas,, or any number you don't recognize, DON'T SAY ANYTHING. Instead, hit the POUND KEY repeatedly, and hang up. The robocaller is instructed to DELETE the number it calls (your number) from its database, when it hears the tones of the pound key, it's that simple.

CoBlonde: IC Systems is a domestic junk debt collector. You've also been taking a lot noise from fake payday loan thugs, so it's hard to say which is the correct answer. If the latter, you already know complaint filing is about the limit of your response. If it's the former your options widen.

- Count 1: Threatening legal action is a serious FDCPA violation.
- Count 2: The collector is required to dun you on paper within five days of first contact.
- Possible Count 3: I would bet they have never "tried" to contact you at all before that phone message. Saying otherwise is deceptive practice.
- Possible Count 4: Why aren't "the company lawyers" calling for themselves? A collector cannot falsely claim to be or have a lawyer.

What I'm saying is, I hope you have a copy of that call. I see a minimum $1000 check in your future. Now my plug for other readers:

If you are receiving repeated, misdirected, and/or abusive calls from a third party debt collector, you may find relief in the provisions of the FDCPA, the Federal law which regulates collector behavior and provides you simple tools for your own defense. It grants you control of how you are contacted, and the means to sue at low cost. Learn your rights and first response tactics at FTC-dot-gov. See also your state laws for additional support.

Hi, B ... A little digging in the other mystery caller sites reveals some intel:
800-615-8948 - reported as First Revenue Assurance
888-382-6623 - reported as Virtuoso Sourcing Group

All three appear to collect on mobile phone debt accounts. Not sure if they have common ownership or some other connection. You would have to get a physical address for all three to be sure NRS disobeyed your request. It's not too surprising that one rep got worried the moment you hinted at your rights. I would still follow on with a cease-comm letter, along the lines of documenting your little chat with their agent Mr. Schmuckatelli, or whomever. This may help fix the date of your invoking cease-comm verbally. Could be useful if you find they called between then and the receipt of your letter.

Whatever case you'd read might have been for TCPA violations, which would explain the $500 a pop. Collectors can be dinged based on issues of "express consent" and canned calls. Violating a cease-comm gets them hung under FDCPA, carrying a $1000 max statutory fine per suit.

Complaints to attorneys general and the FTC are never a waste, as they help the public good and could get the bad actors eventually fined and shut down. But your own problem is yours to solve, and you are already seeing the rewards from beginning that process.

Got same call from two numbers two days apart. 704-231-1000 and 702-520-1111 but its the same exact message. The recording claims there is a problem with our credit card and we need to call them back immediately. Funny thing is we have no credit cards and haven't in over ten years.

Company is Town & Country Food out of Fort Collins,CO. The main number to call them back is 303-414-1000 and ask for customer service to remove you from their list. There are 3 other phone numbers that they use for calling, but will not answer. From what I have read about this company they are sleeze bags.

The only way you will get this number to quit calling is, the hard way, YOU have to send them by CMRRR a letter listing the number they keep calling and that you are issuing a Cease and Desist to them. Then when you get that green card(cmrrr) back, the first time they call-instant lawsuit you file for $1000 in your pocket, oh and they have to pay all legal fees. That is unfortunately the ONLY way you can get them to stop.

I have received about half a dozen calls from this number starting a few months ago with about a month with no calls now 2 calls in 2 days. I picked it up yesterday and no one is there then a recorded voice says something like hanging up now or call ending now. I cannot find any info on google about this number. I am on the canadian do not call list so I had thought when the calls stopped for awhile that was why but I guess not. The other odd thing is that the number actually appears 2 ways on my call display..1-111-111-1000 as well as 11-111-1000 pretty strange.

You get a fast talking "good ole boy" to ask for the owner. He wants a name for sure, and then the pitch starts about yet another Police organization that wants your money.

We are on the do not call list, but since this company plans to give at least 3 or 4 cents out of every $1000 they collect to a Police friendly organization, they can call you anyways.

A foreign (Indian) sounding woman called and spoke something about "Credit Financial" referring to me by my first name and then stating that she showed that I have over $1000 in credit debt. I requested that if she represented a for-profit organization she not call in the future and relayed that this number was registered on the federal Do-not-call list. The lady replied "I'll call back." I don't believe that she correctly interpreted the meaning of my request.

"Out of Area" was reported on my caller ID at 9:47A on Nov. 8, 2010. My home telephone number is on the Federal DO NOT CALL list. Here is the link if you would like to register your home number... http://www.fcc.gov/cgb/donotcall/

(304)981-2335. Its not a debit collector. It is a scam. My mother-in-law got scammed. It is a travel company out of Miami,Fl.. Anybody can obtain an out of state number. That way you can't trace them back. I have done a lot of check around for the last week. They target The Spanish community. My mother-in-law is Spanish. So they call, A recording come on tells her "Cha-Ching.. you have won $1000".
She says hello then they answer, they tell her she has won. All they would need is her credit card number to deposit the money in to her account. Now most people would have told them to kiss there a**, but she didn't. She should have none better, but what can you say. Pisses me off they target the spanish community, and that alot of people really do think there getting something for free. I check with her bank and sure enough they took $299.99 out. They gave me the the name and number of the company. Millennium Travel 1-888-440-5778 was that company. I call them, Talk to someone named Matt he told me they have sub company's that work for them. The company that did the trans. was Mega Travel Discovery Market AKA Travel One Network 1-888-593-8998. I called them and sure enough this was the company. If you search the net about this company, you will see there is a long line of complaints on them. but hey don't take my word for it check it out for yourself.

My mother in-law got a call from this number to. The cash register machine "cha-ching" speaking Spanish saying you have won $1000 dollars. My mother in-law is Spanish and they tell her she has won a trip to Disney Land, and all they need to do is deposit the money in to her account. "agggg". My Mother in-law........ what can I say she is gullible. So they ask for her credit card number and of course thinking she getting something for free.....DID. this was Saturday 30th at 10:00 a.m.. I didn't find out tell Saturday night. So I shut down the card. Traced the number and the only thing I found is it was out of West Virgina. So these morning I call the bank and sure enough they took $299.99 out of her account. So I said where did it go. answer is Mega Travel Discovery Market. Then today out of nowhere they called my phone, same as she had describer "Cha-Ching" in Spanish saying you have won $1000, but when I tried talking to them the quickly hang up. This time I call them back with the GOOD number and chewed there a** out. When I finally got to talk with someone who could speak English of course. I got this number throw my bank, when they did the transaction. Spanish speaking number is 1-888-593-8998 Mega Travel Discovery Market. English speaking number is 1-888-440-5778 Millennium Travel. Both of these numbers are out of Florida. This sh** is getting old. Sorry 4 the Lang. I just pi**off. Hope you rip them a new one. hope this helps

"Hello friends, This is Thomas Moore, a citizen of Texas. I am a school teacher in profession. I am in debt of amount $1000 due to the excessive use of credit cards and my bad expenses. I don't have any such friends who can help me in getting out of the debt. So, I am posting this thread in this forum to get your help and advices." This was a thread by me on a debt community forum. On the very next day I got one PM from Mr Steven Wilson, an active member of that forum referring this site: http://www.debtconsolidationcare.com/creditors-information/dunstonefinancial-llc.html#528943. I went through this site and got some information about "Dunstone Financial LLC". I took the help of this collection agency and now I am totally debt free.

I was wandering to know about a phone call that I received from this number: (410)444-8022 last week. The person on the line was asking about a debt amount of $1000 that I had to pay them as a credit card debt. Though I was in debt but was not sure that the call was from that particular collection agency. Then I informed this to one of my best friend who was also working as an agent in a well known collection agency. He referred me this site: http://www.debtconsolidationcare.com/collection-agencies/estaterecoveries-inc.html. I went through this site and got the detailed information about that number and the corresponding collection agency.

Amazed that this is from ALLY aka GMAC. Bought my first GM product in August. Have already been harassed by XM Radio, and now their stupid finance company. I have no clue why they would call me...on a SUNDAY... and leave no message. I've only had one payment slip from them, and it was paid immediately. There was an offer of an additional $1000 discount for financing, which has to stay in place for at least 90 days. I had intended to pay cash, but allowed them to run it through this company, and will pay it off and close it out as soon as that third payment is cleared. Why am I now thinking I'd have been better off to pay the $1K and stay away from them.

As General Motors goes, so goes the nation. Guess that means that our nation is now some slimy lecherous entity that lives to harass innocent and unsuspecting folks.

Thanks so much for this site. Without it, we'd never know who the real "criminals" are.

Invest in a recording device and record the call.
This is a collection agency and it's illegal for them to hide their identity.
If you have told any collection agency not to call you, you can sue both the collection agency and American Express for violating the Fair Debt Collection Practices Act.
Its a $1000.00 violation per item plus they are responsible for court cost and your lawyer fees.
Find a consumer lawer on the internet, they will file the case for you and give you the $2000.00 and keep their fees form Amex and the collection agency. Its a great payday for you and will teach these dumb as%$#$ that they are not above the law.
I just collected a nice check just in time for Spring Break, Flordia here I come.
Thanks Amex and _____________ Collection Agency. (I agreed not to disclose as part of payment)

Give The CEO a call let Him know how you really feel about Bot callers... It is High time we get laws past that force the Debt collectors to call from the same address a number is listed at. and that they can only call once in a calender day. In Most states recieving to unwanted phone calls in a 24 hr period from the same person is considered harassment, and is punishable by law. We need to make sure that we get protection added to the Fair Credit act to ensure the write of a peron to not be harrased by this stuff. Let the market place dictate business, Dont use a Capital one card, dont use any credit cards... OH By the way.. LVNV Funding is a canadian based comany that is exempt from US law. They own or go buy HSBC, Assure, Emerge, Capital One, RMS, >>>>>>>>>>>>>and on an d on and on... If your phone is ringing and it is not a friend or family member Dont answer it. If it is LVNV funding each time you answer (even if you dont speak) the dept gets redated... it starts the duration the report will remain on your report... Hope this tid bt helps...

I followed another search string which said that this number was associated with FIA Card Services. I called FIA, they transferred me to Quantum. Quantum said it was Privacy Assist, and gave me two numbers:800-516-9561 and 806-369-2506. Privacy Assist said it was Bank of America, 800-432-1000. I do have an account at BoA. I called - BoA reported that yest it does sub to Privacy Assist, but it has a list of its subcontractors, and this telephone number is not on that list. Further, BoA does not have my two cell numbers in its records - but the cell numbers keep getting the calls - at my expense. BoA said it would take up to 12 weeks for the changes to my account (putting me on a do-not-call list for the telephone number that IS on my records) to filter down throughout the company.

DO NOT GET MAD GET EVEN!!!!!!!!!!

WHEN THEY CALL ACT LIKE YOU ARE INTERESTED BOOK AN APOINTMENT AND SEND THEM SOMEWARE ELSE LIKE ANOTHER CITY, A VACANT LOT, POLLICE STATION, TO YOUR EX WIFES HOUSE ETC. (BE CREATIVE!) I HAVE DONE THIS IT LEADS TO HOURS OF FUNFOR YOU!

YOU WILL NOT MAKE MONEY THIS WAY AND YOU WILL ONLY MAKE YOUR JOB HARDER!!! (STOP BEING SO STUPID!!!!)

I AM QUITE SURE THAT IT IS ONLY A FEW INDEVIDULES THAT ARE DOING THIS THEY ARE MOSTLIKELY THE SPAMERS ALSO!!

(YOU CAN FILE WHERE YOU LIVE BECAUSE THEY ARE DOING BUSINESS WHERE YOU LIVE!)

IF IT IS A ROBO CALL YOU JUST NEED TO SERVE THEM! (THE COURTS HATE THESE THE MOST AND THEY ARE HIGHLEY ILEAGLE!)

WHY DO TELEMARKETERS CONTINUE TO CALL EVEN WHEN MOST PEOPLE DO NOT WANT THEM TO CALL? ANSWER (BECAUSE IT IS PROFITABLE!) THEY DO NOT CARE ABOUT YOU THEY ONLY NEED A SMALL SUCKER LIST!

P.S. THESE FIRMS ONLY HIRE STUPID PEOPLE WHO GET PAID ON COMMISSION ONLY (NO SALE NO $$$$) SO WASTE THERE TIME AS MUCH AS YOU CAN....

THE OWNERS PROMISE THESE STUPID PEOPLE THAT THEY WILL MAKE A LOT OF $$$$ AND THIS NEVER HAPPENS! (ONLY THE OWNERS MAKE $$$ OFF OF YOUR WORK!) STOP DRINKING AND GET A REAL JOB!

As I have not had a chance to fully compile the list of every Small Claims Court in the United States yet, please visit this list until such time. If and when I get my list fully compiled, I shall be including a lot of extra data such as links to the applicable court rules and which courts allow the filing of claims online as mine does.
Suing Telemarketers - Simple and Cheap
When most people think about the process of suing a business entity, they naturally consider it a complicated and expensive process. They consider having to find an attorney who specializes in the particular area of law, the costs for such and weigh it against the potential gain. Forget all that when it comes to suing telemarketers!

For those individuals like me who have successfully prosecuted cases against telemarketing firms, there is little need for an attorney. (A cover-my-posterior caveat: I am not an attorney, so I cannot legally advise you. Whenever you are considering legal action, it is always advisable that you consult an attorney. Personally, I have never needed one when filing claims against telemarketers, but you may wish to consider doing so.) The key is that the best venue for filing suit against a telemarketer is in your local Small Claims Court. The only fees you must pay are the filing fees (varies upon venue and amount, but generally is somewhere around $50) and the fee to perform service of process (anywhere from $10 to $100 depending upon whether or not you have the court serve the telemarketer via certified mail or you have a law enforcement officer or other process server handle such). When the potential gain is thousands of dollars, what is a hundred bucks?

I have personally filed four claims in Small Claims Court against telemarketers. I have been paid on three of them (the fourth was against SBC and they gave me such a runaround on the process serving - BUT they stopped calling) that I let that one slide. Of the three cases where I was paid, the following were the results:

1. Filed a claim against a telemarketing firm based in Florida (Health Benefits Direct) for $1500. This amount was based upon two calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy. I settled out of court for $600.00 prior to the trial date.(Initial Cost to me: $55)
2. Filed a claim against a mortgage brokerage firm in southern California (due to settlement agreement, I cannot reveal their name) for $4500. This amount was based upon seven calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy and their failure to maintain a Do Not Call List. I settled out of court for $2000.00 prior to the trial date. (Initial Cost to me: $80)
3. Filed a claim against a mortgage brokerage firm in southern California (Country Club Mortgage) for $3500. This amount was based upon five calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy and their failure to maintain a Do Not Call List. I received a judgment for the full amount of $3500, plus $60 in court costs. (Initial Cost to me: $60)

I am on the national do-not-call list so I was curious to find out who this could be! So I answered the call and to my amazement, this number has now been leased out to a secret entrepreneur doing a study on automated phone solicitations. The call center operator verified this was true and for being one of the rare citizens to cooperate with the study I was paid $1000. I couldn't believe it! Thought for sure it was a scam of some sort but I checked my paypal account one hour later and sure enough the money was there!!! I guess the moral of the story is sometimes they are not all bad!!!

I just recieved a call from (920) 999-2928, at 3:18pm eastern time. There was a cash register noise then a woman speaking Spanish and said something about $1000.00, but her talking was too quick for me to catch it all.

Penny Ball: There is plenty you can do without an attorney holding your hand. It's not clear if you settled the debt account with the original creditor or a third party. In either case pulling your own credit report(s) would be advised to see if the account was accurately noted. If your settlement was with NCA or any other debt buyer, there is a greater chance of misreporting, turning your account into "zombie debt". This is why if (as a last resort, natch) you pay a debt buyer you need to be very specific about what you expect in return for the ransom.

Now as to "phonecalls from two different people", verify who they work for to be sure only one entity is chasing you. With a few exceptions, two tradelines for one debt account cannot exist on your reports. You should have been dunned in print a few weeks ago to confirm who is contacting you by voice, which you may find an empty exercise in frustration.

The bit about asking if someone "had received his warrant" sounds like a threat of legal or police action, a huge no-no under FDCPA. If you document everything you are told you may possibly build a case to sue for violations, each of which carry a $1000 penalty plus legal fees. If the violation looks clear enough you could proceed pro se and win a fat check in the mail without setting foot in a courtroom, which is generally a cheaper solution for the rogue collector.

Please Note!
