-credit card company- I have NO credit cards, zero, I don't believe in them
-student loans- I've been out of college for decades AND I had a full scholarship when I was a student
-major bank- I've only ever banked at our local, independent credit union
-car loans- I paid cash for my clunker
-debt collector- I (fortunately) have no debt and all my monthly bills are withdrawn directly from my bank account each month

Also, I only recently got this cell phone and I've been EXTREMELY selective about who I've given this number out to. This particular number isn't associated with any of my accounts (haven't gotten around to changing it from my old landline).

For me anyway, this is most definitely either a mistake (transposed numbers) or much more likely- phishing/trolling/fraudulent/nuisance calls. I just confirmed that my cell number is in the do not call registry.

Answer it Verizon (insert your own provider) Security and immediately ask the caller to identify themselves, give the name and location of their company, ask the purpose of the call, and advise that you have "captured" this number per a federal warrant from the FCC based upon their customer's complaint. A call came in and it registered as Ogden, UT 801-823-2013 on my caller ID. A female asked if they could speak to an adult in the house, someone over 21. I responded that if I'm not an adult or the adult of the house then there was no one to talk with. Don't I sound like an adult. She said she was taking a survey and asked if I could spare her a few minutes. I said go ahead. She asked what is the likelihood that I would vote in this election and she gave me a several options. I said I was definitely going to vote in this election. She asked what year I was born. I said I don't think I want to tell you that. She asked if I could please give her the year. I hesitated and then relented and gave her my year of birth. She said thanks and that concluded the survey.

Ryan, I don't know where you got your ''understanding'' of a ''$1,000 per incident fine''. $1K is the FDCPA statutory damage cap, awarded to a winning plaintiff *per action*, not per violation. FDCPA applies only to a third party debt collector, which a lender is not. You would have to catch an original creditor (OC) posing as something it's not before you have a FDCPA claim.

If you still want to litigate against the bank's collectors, you'll need a state collections law which covers an OC. You can also see if you have claims under TILA, UCC, or deceptive trade regs. Don't expect to get rich, though. Capital One bought most of the HSBC credit card portfolio this Spring, which includes the Orchard accounts, and they looooove going to court and punishing their debtors.

All said, keeping careful records and reporting to the FTC and attorneys general make a healthy response to a huge problem, mainly the general lack of control over hostile in-house collectors. Ten calls a day on average is difficult not to paint as annoying and possibly violating your rights. This will raise future incidents to harrassment, thus to clear a path to a civil damage award. Maybe your state can impose a criminal penalty as well.

Since 9-19-12 gotten phone calls (upwards of 60 since I started keeping track of the number) from this number than invariably at least two calls come from an unknown caller. they don't leave a message. we rarely answer the phone regardless of who calls. i am now taking pictures of the date, time, and phone number so that when i have received 100 calls from this number, i will be filing a complaint with the FTC. At the rate this number calls, it shouldn't take more than a week. My understanding is there is a $1,000 per incident fine that will pay for our next vacation.

One point I've not pressed in this thread is that one should not rely on verbal demands to stop calls for strangers. Both federal law and the workplace culture of the high volume collectors permit them to assume you're a liar and keep calling. Turn up your volume on paper. It's called a ''cease-comm'' for short, and it is best sent USPS Certified with a return card. The recipient risks a lawsuit from you if your orders are ignored. You may already be due some payback if you can prove abusive tactics or foul words were used in an effort to collect debt. You might get some legal traction from a harassing or annoying call pattern as well.

Tamara: Yours is another very common issue the catcallers and collection trolls never accept as true. Crap One and lenders like it are primarily in the business of tricking people into digging the deepest debt hole possible, then refusing to send down any rope when help is needed most, laying blame entirely on the debtor. This scam has been going around for several months. The "survey" asks questions about national debt. Then, you are asked for a credit card number to "pay the taxes" on your free trip.

Either we gather evidence of violations and deal with the problem directly, or we huddle in a trench and hope the shelling stops.

A high volume collector like AI has many phone numbers to throw at your few, and their autodialers don't need coffee breaks or sick days. Sooner or later they will misuse their favored weapon, the telephone, and they will hand over legal ammo to fire against them. This does not mean every call must be answered, but everything they say and do should be monitored and studied carefully, then documented. That's a more constructive place to put one's frustration than rants against elected officials and regulatory process.

So to get even, I warn them 1st to please stop calling. If they will not stop, I tell them, they will hear the following, I BLOW A WHISTLE into the phone. It's just too bad. Some of my friends are also using horns, pots with a spoon, etc.
I have told my congressman, gave a list of the numbers, and nothing stops these people who do not understand the word NO.

So far I have been getting only one or two calls a day and noticed a major vast improvement.
I guess losing your hearing is more important, then making a call.

i think, according to the FDCPA, it is illegal for debt collectors to call cell phones as it makes the amount owed higher having to spend cell phone $. basically it is making the debt more without going through proper legal channels, which is a no no. so tell them they are calling a cell phone and you think they are in violation of FDCPA since its costing money to talk to them.

btw: Once a debt passes beyond the statute of limitation in your state, a debt collector no longer has the right to sue you for payment. You may still have a moral obligation to pay back an old, forgotten debt, but you can't be sued over it. Any debt collector who threatens to sue you over a debt that is beyond the statute of limitation in your state is in violation of the Fair Debt Collection Practices Act (FDCPA).

They called twice today. There is a front end recording greeting where a female claims that it is not a sales call and asks to speak to the head of household. When I responded, no one responded. I think that they just robocalling numbers. If someone answers one of the lines then the others go unanswered, like mine today. So I believe that their autodialer will call again.

A little research shows that this is a survey research company called Opinionology from Orem, UT (the caller ID of "Ogden UT" is just a diversion). They were previously "Western Wats". They have a web site, westernwats.com, but you need a login and password to glean any survey results - probably for paid clients only. They have an EU Safe Harbor Truste affiliation, so they are probably a global company. I really don't think that they are trying to harrass anyone, because that would not get respondents. Their autodialer and response techniques may be a little aggressive, however.

Anytime the politicans throw their hats in the ring, we start getting these phone calls, so that's my guess. It happened before the previous preesidential election, and I'm sure that it will go on for this one as well. They'll try a number of times and flag your number then just quit calling. Don't get your blood pressure up. Stay cool. ;) :)

You don't need a valid debt or a derogatory trade line on your credit reports to be hassled by debt collectors. They call third parties to alleged debtors all the time for permitted skip tracing purposes, or at times pretending it's a trace to annoy and shame the intended target. When skip tracing, debt collectors must answer to privacy regs within the FDCPA, hence the obfuscation. Of course, being shadowy works in their favor to make call targets anxious.

I have 2 cards through HSBC, an Orchard Bank and a Discover card. Last week I called all of my credit cards about a hardship program because my husband lost his job. HSBC Discover card told me if I paid $29 on 12/10 and another $29 on 12/17 that my account will be current and up to date with no questions asked and after I paid the first $29 there'd be no phone calls. I paid that $29 and all was silent until today, 2 days before the due date of my bill. So now instead of them getting my $29 they're only getting my past due of $15, yes folks $15 dollars...they're calling me for 15 FREAKING dollars...

If Household is collecting on its own account you may or may not have state laws to help you with the nuisance calls. I believe Texas and California helpfully apply FDCPA-like rules on first parties.

In this era of number spoofing and CID munging there is no absolute certainty, which is why these mystery caller databases exist. You'll sometimes have to compare the comments you find against the pattern and content of calls you receive to make a positive ID.

I do not know who this company is... every time they call, I answer the phone and there is silence on the other end. I am dumb founded at all of the other comment: one comment is that the company is a voting or survey company, another is a bill collector, and the other is prank calling. I am concerned because we have a private phone number and we do not know how this person got our information.

I think these folks, and all the other callers like them, have multiple numbers now, so even using call block doesn't stop the calls completely. But I do block them. And I don't answer the phone EVER unless I know who is calling. If it's important, anyone would leave a message. If they call multiple times without leaving a message, I just block them because then it's obvious they don't even know me and have no legitimate reason to call me. No more interruptions.

Curious that someone reported this as an Allied Interstate call back in the Spring. AI is a third party collector and known scofflaw. (Not that Household Credit was much better in my experience) Wouldn't doubt they tried posing as an original creditor to duck Federal law. Last month they racked up a $1.75 million FTC bill, the second largest for the debt industry, for chronic violation of the FDCPA.

Caller thought she had a live person, but was really caught up in voicemail....she kept asking "for a registered voter....hello is anyone there"? She then hung up, but has called two more times this evening."

I had this exact same thing happen on my work phone!

I'm going to call them back and tell them to remove me from their list. Because they are calling regarding voters, they are allowed by law to call even if you're on the DNC registry. It stinks, but look who wrote the laws!
