Renenber this: Collection agencies either BUY debt (credit card loans, judgments, etc.) from debt auction houses (from 4-6% on the dollar) or take a consignment consisting of a "collection contingency fee" directly from the lender -- all in an effort to collect debt from YOU. Do your homework, and understand how the system works. The biggest problem collectors have is in proving an "assignment" of ownership, particularly from debt auctions. Read into this, the difficulty of being unable to trace all the paperwork down to "prove up" the debt" if they bought it at auction. If they cannot collect, they seldom sue (but they can if they want), but likely won't win, if you know how to fight back. Of course, valuable is a lawyer on your behalf, but if the collector cannot prove a "chain of custody" of the debt, he's out of luck at the courthouse. In the meantime, you're not supposed to know all this stuff, believing their harassment techniques will bluff you into making some form of payment to them (which only starts a new clock running when you do in terms of statute of limitations). BE WISE, not stupid. Know what you are up against, and you can better defeat them and their illegal collection tactics. Never acknowledge, nor admit any debt by phone, or by letter. In fact, simply hang up on them when they call. And don't answer any letters, unless you get trapped into signing a "certified letter return receipt" and then the presumption is that YOU got the mail, and were officially notified, and by not responding, they may take the chance and file a lawsuit, hoping you will also ignore that, and then secure a default judgment; only at that point looking at the profitability of foreclosing on the judgment at a good profit (think your assets), or alternatively, anything you sent them ABOVE what they paid for the debt, is Profit, and once they have sufficient profit, only turn around then and sell it back at auction as now a Judgment instead of just a debt. Then, once a LEVY is brought about upon your property (assets) compounded with a Court ordered Judgment, its at that point you may be up the creek without a paddle. That's when they can take money from a checking account (think FREEZING an account), an automobile, motorcycle, boat, camper trailer, typically anything that is "registered," and easy to determine in terms of age, condition and value. Many homes are protected via Homestead Exemption, but not in all states. Secure an internet printout of the EXEMPTIONS in your state and the amounts by which you are protected on assets (type in Asset Protection State by State) and you'll find it. Whining gets you no where; become pro-active and smarten yourself up a bit, and you'll be glad you did. Adios. Whistleblower.

this is a creepy law firm that buys overdue accounts and trys to contact ANYONE who ever knew the person they are looking for....ever. They hound me looking for someone else. I called them and told them I DON'T own them money and never did... They keep calling. Any Credit card company that can't get who they are after... will then sell the bad account to this jerk. The frigen Jerk is BLUHM, CFG, creditors financial group, who hounds anybody they can find, who once knew the person they are looking for. PLUS, they have several phone numbers to bug people. Telling them "you have the wrong person, and phone number" makes no difference.

Not to be snide, Linda, but you can't report anything to FDCPA. That's a document, not an agency. You did a good job documenting calls, apart from having no names of the reps. For the purpose of sharing experience with fellow WCU readers, you should have redacted or changed the name of the alleged debtor in this version. I'm sure there are other women with her name, so it's not the worst 'oopsie'.

The FTC makes two demands of third party collectors which are sometimes in conflict. A collector must make "meaningful disclosure" of its identity yet respect the privacy of whoever is named on a debt account. Not surprisingly, some collectors are shy with phone messages and the courts don't all agree on what makes a privacy violation. I do think a collector can and should reveal a business name. Discussion of an account beyond that is a definite no-no if the collector is not certain the correct person has been reached. CFG _might_ have made two counts of nondisclosure, but they probably won't float a case.

Technically ignoring your verbal cease-comm is a harder violation, but you would have to subpoena CFG or have your own recording to prove it. Rogue collectors are anyway trained to assume everyone they call is a chronic liar. (Pot, meet the black kettle.) That's why creating a paper trail makes things simpler. The mere arrival of Certified mail signals how serious you are.

You're correct that Michigan is an all-party consent state regarding phone call recording. However, the Second Circuit Court of Appeals ruled this August that single party consent is just peachy so long as your intent is not in some way criminal or malicious. At the Federal level, you're good to go, and it's not like the collector's attempt at a transaction is not interstate. Honoring the state level, you could hedge your bets and announce recording, but that may cause the rep to either refuse to continue, or grudgingly switch to Very Best Behavior. My vote of course is to quietly roll tape and let the collector decide how far to stray from FTC regs.

I'm sure your cursing was deserved, but the best revenge comes if your attacker loses control while you remain cool. Also, I can't find the statute which says the term "please" is required for compliance. I think the rep was trying to assert control after you got the drop on the drone. Luck be with you.

I just submitted a complete description of my situation to the FDCPA. Here's what I said (minus the epithet).

They are calling for a person named Camille Hope. I have had calls for Ms. Hope before from other debt collectors (the others have always taken me out of their databases once I told them they were in error). Apparently Ms. Hope entered my phone number as her “contact number” on a loan application. I have no idea who Ms. Hope is and have had my telephone number for the past 34 years.

CFG called me looking for Ms. Hope on

--9/2/10, 1:00 pm – my answering machine picked it up; they left no message (I got their number from my caller ID)

--10/4/10, 1:30 pm – I answered. The caller (without identifying himself or his company) said “Camille?” I explained the situation and asked to be removed from their list. The caller refused, so I told him he could [redacted]. (Sorry, but that’s what I said. They probably have it on tape, although the tape wouldn’t be legal in Michigan, which requires both parties to be aware of the taping.) He hung up.

--10/19/10, 10:30 am – I answered. Again, the caller (without identifying himself or his company) said “Camille?” I explained that (1) I had no idea who Camille was, (2) I knew he was from a collection agency, and (3) every time Camille’s debt was re-sold to another collection agency, people started calling me again. I again asked the caller to PLEASE remove me from their database. The caller told me I would have to say “please” (which I had) and then hung up on me.

The next time they call, I plan to tape the encounter, myself.

Linda: Do file your complaints with FCC and FTC for the good of all, but don't expect regulators to solve your individual problem. The collector will ignore verbal requests every time. Your cease-comm needs to be on paper and sent USPS CMRR to make it stick.

George: Mobile phones have no blanket protection from collectors. The FDCPA forbids such calls on the basis of creating undue cost to an alleged debtor. However, industry lobby group ACA International won a recent exemption from TCPA, clearing the same call category. To my reckoning, court rulings have not been of much help with this confusion.

From this thread alone Creditors Financial Group seems comfortable with using lies, deception, and nasty tactics to score commissions. Make no mistake, this bad behavior is the rule and not the exception among Buffalo Bullies. (Economically depressed Western NY is a debt collector mecca.) Dealing with them by voice alone will be a wasted exercise except maybe to gather violations for your own lawsuit.

If you are receiving misdirected or abusive calls from a third party debt collector like CFG, you may find relief in the provisions of the FDCPA, which regulates bad collector behavior. Learn your rights at FTC-dot-gov.

Male voice with a Canadian Accent would not give his name, claimed someone with a name that sounded like a composite name of two different relatives who live in two different states(Neither one Virginia, or Louisiana)had given this number as a "Primary Contact Number" He asked me my name without giving his, or who he was representing. I didn't give it to him, or tell him the names of any of my relatives. He said he would "remove the contact info.
If he callas again, I'm reporting A harassing caller.

Recieved the first call today from a Ms. Murphay asking for my father said I was used as a refrence. Knowing my father has steller credit and would never involve m, his adult child in his financial matters I played along and took down all the info she had to offer. I checked here on the number and seeing my point proven- that this is a scam I called back to point out what an idot she was and to let them know there was no more need to call. I spoke to Ms. Murphay once again for her to get an attitude and scream at me... Am I your CHILDDDDD???? She said over and over. This was after I told her she was an idot for telling me my father listed this number on an application in 05' when I have only had this number for less than a year. She told me when I got a better attitude I could call back. I did call back and spoke with the supposed "dumbass in charge". He tells me my number has been taken off the calling list, I let him know we would have issues if they called back. I know it's silly ut I can't stand people like this. I just pisses me off to the point I actually get mad. I am not an agressive person by nature AT ALL... But these fools get me going!!!

I just recently hired an attorney and their lies cost them over 3k! they had to pay me plus attorney fees. do not tolerate this. tell them to cease calls and put all comminucation in writing. as for their address to send it to - if they do not comply or refuse to give the address you can hire an attorney and get paid too.

Have good credit and no unpaid debts but cannot say the same for some family members with the same last name. I assume they are trying to reach these people by harrassing me.

Get Google Voice Mail. It's free, it just takes awhile to get an account. Then get call forwarding on your phone and let it ring twice then forward to Google Voice. You then can block the calls from the numbers you do not want. All they will hear is "the number you have reached in no longer in service or has been disconnected" It's free and it keeps these scum bags away.

The VP of the Buffalo office is Mike Porth. The assistant to the VP is Jo Deguillio and his direct number is 877 298 2251 ext. 3502.

Give these guys a call directly if you get a call and they are rude. keep calling and leaving messages of your own. I'm sure that they don't want you to have these numbers. The employees guard them pretty closely.

I have actually been doing business with these folks. Had arranged payment plans and been paying them, but when life took a nasty turn, I no longer had the money. The check bounced and the most interesting of conversations with them ensued. I challenged them on all of it stating that I had no intention of defrauding anyone, just didnt have any money right now and reminded them that I made arrangments to pay as proof of my not wanting to defraud anyone. Once the collector had no verbal leg to stand on and the threats were childish (which I stated to her as well), she had no more skills left and hung up on me. I assume from this that my business with them is over for now, good thing....I dont have an money until I find a job.

The collector handling your settlement makes a commission from what you pay, so they will say wrong things to avoid having to pay their bonuses back from your bouncing checks. Creditors Financial Group employees have very few skills in their basket to work with and resort to unrealistic and unprofessional claims and statements, why would anyone give this group money after that. I call their legitimacy as a company into question; they have a poor rating with the BBB. I am writing to the CEO, Henry Swayze at 3131 S Vaughn Way Ste 110, Aurora CO 80014 to inquire about his employees inability to conduct business in an appropriate manner and challenge his company's legitimacy to collect debt. He incorporated this company Aug 30, 2001 in the state of Florida, which is still active, so he is pretty sly. He also runs NCO Financial systems which is also a collection agency. This will be interesting and fun.

FYI: Collection agencies purchase your debt at auction for a fraction of its total value, so whatever they get out you is usually profit for them. On my $3000.00 debt, they paid $400.00, so the money I gave them is profit. This is why they will make settlement offers; they arent losing anything at all because the settlment offer is generally 30% more than what they paid for your debt at auction.

"Jason" said they were CFG and when I asked what that was and what they do he was very vague "we do alot of things". I refuse to p/u any calls from #'s I do not know. So this company can have fun talking to my machine. With all the comments on here, I would tell EVERYONE to NOT take calls from them!!

You people who just jump in here and snipe "Well just pay your bills!!!!!" Wouldn't that be nice. I think we'd all love to be rolling in the dough like you, consider yourself lucky. There are dozens of reason why people get into debt in the first place, and it isn't usually because they are scam artists looking to steal from the poor, victimized little creditors. Most people who don't "PAY THE BILLS!!!!!!!!" don't because they CAN'T. And before you say something stupid like, "then don't borrow in the first place," I suggest a reality check. Again, most people do not recklessly take on debt they can't ever pay back for no reason.

Well they called my neighbors for saying they were lawyers for a debt I don't even owe! Screaming yelling calling them liars. My neighbors were horrified and I am furious.

Unless you yourself owe the debt they legally cannot harass you but they do it anyway. Well I intend to tape the next conversations and sue and in addition my neighbors are going with me to the attorney to fill out sworn affadavits of what happened. Even if you owe the debt they can only call a neighbor once and only to verify your address. They called my neighbors more than once, misrepresenting both themselves and the situation.

The fact is some collectors justify what they do by saying "pay your bills" well guess what I do and this debt has nothing to do with me but you won't listen! And lots of other people have the same issues.

So quid pro quo collector. Since you think its okay to harass the innocent then its fine for me to sue the guilty!

They call three times a day. When I called them back, they would ask for my name. When I asked them why they call, they don't tell you and ask for your name. When I say they should know who they are calling, they say they need to know my name first. When I asked them to take me off their calling list, they hang up. They are still calling me. I don't owe them any money!!!!! How can we report these callers. I'm tired of getting these calls in all hours of the day.

I keep getting calls every four months for a Richard R. with a case file number and little other information. I have called and called again telling them that I do not know this person, and I've had the number for over 7 years, even moved it to our new apt. They try to be seeking and ask if it's my husband's name. Gee, let me think about that, no it's not my husband. Also, they say well how about this guy, Henry T. do you know him. Now I know they are digging, just because someone's last name on your list rhymes with my last name doesn't mean I know them. Really, are they so desperate that they will throw out a bunch of names, just to see if they can get lucky. So for the third time I've told them to take my number off their list. We'll see if this works or if I'll be calling back in four months. CFG, check your records, and stop leaving multiple messages at wrong numbers. Oh and stop giving my number to other crappy credit collection agencies.

If they break the laws, by all means report them to the authorities. But just calling you and telling you that you owe money and trying to retrieve it isn't a crime. You are committing the crime by charging up a credit card with no intention of paying and excusing that fact by saying that someone was rude to you!
If you get a call for someone you don't know, tell them or call them back and tell them and I am sure that you won't be bothered any further. Likewise, if you get a call saying you owe money, tell them you want proof in writing and politely hang up the phone. When you receive that proof, "PAY THE MONEY YOU OWE" and it's over.

Pretty cool huh?

I have received several calls. So far only messages are being left. A Jeffery called twice, 877-298-2251, ext. 3520. I never could understand his last name. The messages were sharp and referenced a claim number but was no reference to what the claim number was for. I received another call yesterday from a female. It came in on 866-919-4901, ext. 3578. Her message was more pleasant. She referenced the same claim number but again no indication of what it was for. Thank you for the insight of who is calling and past experiences.

I answered and this guy alexander Jessup said he represented the "United Federation of Space Aliens for the Collection of Bad Planetary Debt." With that I just had to stay on the phone and listen as he told me that earth was way over its head in debt and that it was affecting the economies of the other planets, especially Jupiter and Uranus. If we earthlings don't pay up on our credit card debt, which is by the way non-bankruptable due to a law passed in 07 by aliens planted within our government, the UFSACBPD would be forced to destroy earth, He said first that aliens hiding in Gaza would begin to shoot at israel, then aliens in the government of Iran would attack Israel and then WWIII would begin. the idea is to not let us know that it is aliens fighting against earth since that is too creepy but to make us think this is just another typical middle east conflict.

A Craig Wagner called from a cell phone number saying that he was from Bank of America and that I owed $1050 from some old bill from years ago. He had NO information on what this bill was or who it was from. I have checked my credit report to see if there is anything fishy going on, and I have a completely positive report, with NO delinquencies. Do not give these people any personal information - please check to verify their claims and let them know that you will investigate what they have told you. Get as much information from them as possible, but DO NOT give them yours.

There is a guy that keeps calling from this number stating that there is a "claim" that is linked to my name and social security number and it is "imperative" (big word for these Bozo's!) that I call back or have a "legal representative" call back for me. I am guessing that this is a collection agency for United Mileage Plus Visa card as I ended up with the debt from my divorce and refuse to pay it since they don't work with me on it.

For everyone else - I have recieved multiple calls from these people as well. Seems like a scam especially after they were so pushy about getting my SSN. Word to the wise, never reveal any info about anything to a company who calls you on any of your phones. If they were even remotely legit, they would have mailed you some sort of official document and even then, you need to be cautious. Also, I never recieved any derogatory or threatening phone calls, but I wish I would have just so that I could have fun fucking with these lowlifes. Any by the way, I have a perfect credit report with no debt overdue, so they don't just call those who actually owe debt.

Got a call from this number ... before I identified myself, I asked the person to identify themselves and who they represented.
The woman made several threats, saying she would call later to reach the person she was seeking and would then start contacting my family and see what they thought of the situation ... then hung up when I asked again who she represented. It wasn't until I did a search of the number gained by dailing star 69 that I realized who the person represented. I have previous interactions with this company and they demand a lump payment ...
Seems to me there is a law reguiring these folks to identify themselves and forbids them from making threats ...

This is at least the fourth call I've had over the last six months from this number. They always ask for someone different. I've asked them to delete my number from their data base and filed a complaint but they continue to call. I fortunately do not have any bad debt and there can't be that many debtors out there giving out my cell phone number. What's the deal?

Caller (Julie O'Donnell) sounded very serious, professional and threatening. Left message which was supposed to sound like it was a legal matter and I was in Big Trouble if I refused to return the call (which I did). Prefaced the message by stating that if I wasn't the person who they wanted, I was to ignore the call. Stated CFG was calling in response to a complaint filed against me on July 25th, complaint #6289243 (which I will do a search later and see if I can learn what that is supposed to represent). Stated this was a very serious matter and failure on my part to comply by responding will seriously alter my ability to solve this matter voluntarily. Told to contact them or have my attorney call. If I don't, their client is prepared to go against me or something like that to the fullest extent of the law. Good luck, CFG.

got a call at 0855 am this morning for someone that hasnt had my telephone number since 2/2005... at first, 'Mark' didn't believe me, then he suddenly hung up in my ear... star 69 gave the number as 8772982251, and on a return call, they answered the phone as Creditors Financial Group. I tried to explain that I had no business with anyone they were affiliate with, she put me on hold to check based on the number they had called and everything came back to the person they wer looking for, who hasn't had this numberr for more than 3 years. I demanded she remove us from her records, and cease and desist any further attempts to contact us... We'll see what happens. If they are as smart as the typical collector, I don;t hold out much faith in them. ASSholes.

We have recieved numerous calls from these obnoxious and rude jackasses (darryl porter, sarah frazier, and dan "I don't have to give my last name by law"), looking for someone, who we never heard of, who happens to have the same last name. I've been told off, told how I should manage my family better, told to shut up while they are speaking to me, and threatened with harrassment if I called them back again, trying to get our phone number removed from their list. My mom got a phone call from CFG, looking for someone by my sister's maiden name. They wouldn't tell my mom who was calling until my mom (unfortunately) told them she had a daughter by that name. (Didn't mention that she has been married for 20 years, lives in another state, etc.) So, as you probably be know, they keep calling her. I'm trying to figure out if there is anything that I can tell my mom to say to these idiots to get rid of them. I have been trying to satisfy a debt with these people for two months but they have asked for an large amount of money at one time. I have done everything that these people has asked me to do including to apply for a loan to pay off my debt. When my loan was declined I was told I would have to pay them $100 for the next two months and the remained of the balance to be due in 2/08. The supervisor Mr. Diaz yelled at me. I called back to ask for a statement of my debt,stating that I have rights and was told "You have no rights when you stop paying your bills!"I was told to never call them back again and that they were red-flagging my account. I called back later to get the name of the person I had spoken to (Mr. Powell). I took down his name and hung up. He called me back immediately and told me that if I called them back they would file harrassment charges against me! HUH? So much for trying to get back on track with old debts.

I recieved a call from these people requesting me to do a service for them on my business phone answering service, it wasn't my line of profession, but he said that I may be able to help him, I returned the call and a receptionist answered CFG, bingo, I hung up and he called right back and said sorry I got disconnected, I have paid over half of the debt which they harassed me into when my debt relief service screwed around with me. I think it is sad that they have to resort to trickery to get you on the phone, I also sent them a do not call letter, certified and asked for a statement of my account which I haven't received yet!!!

Got a call from this number from a person named Kim. Didn't tell me the company. Said she was calling about a "formal complaint" that was placed in her office. Gave a case number. Said that if I didn't respond in 24 hours that would result in a "recommendation". If this is a creditor, they are operating very illegally. First, they never mentioned the company name. Secondly, they're threatening. It is extremely illegal for credit companies to bully clients into paying. Thirdly, they threaten legal action which is, ironically, illegal. I'm pretty sure these people are the same company that called my friend and when she asked to speak to a supervisor, he got on the phone and the first thing he said was "Ok so what do you want me to pull out of my magical bag for you?" Extremely rude, unprofessional and ILLEGAL!!! I refuse to give my money to any company that would treat people like that. I don't care if it's my debt that I owe, you don't treat people like that. These nut cases called my house 3 times. They left a message on our machine for my wife, then me, then the third time they called my wife talked to them.. They were looking for someone else. I called them back and confronted them about this and they denied calling me, or having any information about me or my wife. They were looking for two completely different people. They were very rude, nasty, and threatening. The cunt that called was Mrs. Robinson. The number was 877-298-2251, a CFG or Creditors Financial Group. I started citing section 804 of the Fair Credit Reporting Act at which time the guy I talked to agreed to have our number removed.. The same number they claimed not to have called.

Word to the wise. If you owe these fuck heads money, IMO, do not pay them. They are assholes.

Person named John Reagan called looking for my son (who is in debt and not paying on it). He said it was a financial matter and could I get my son a message. I said no, didn't have a phone number or address. He VERY rudely said, "Your son, ma'am, I highly doubt that! You are a moron ma'am. I said, excuse me? I asked for his name and he hung up on me. He already had my son's number because he called him right after he hung up with me. He told my son that I was a real piece of work and told him that he needed to pay his debt in full in one week that he could get papers filed in one day.

Don't put up with it! If you owe money on a debt, go to www.creditinfocenter.com for info to help in dealing with rats like these. File a complaint (online, very easy) with state's atty. general against any of these companies that are harassing you and send the company a letter telling them to stop calling you. If they don't comply, they are breaking the law (FDCPA) and can be sued in small claims court.

After checking Google, I found this site and wanted to add my input. Currently we have NO outstanding debts that someone should be calling about. I'll just hang up on him the next time they call. Or if they persist, I'll tell them they have to send the paperwork certifed by USPS and THEN I'll take it to my attorney for them to deal with.

This was a low-profile collection bottom-feeder agency UNTIL they opened an office in Buffalo, NY which is home to the MOST disgusting, unprofessional, under-trained and illiterate debt collectors in America. Apparently CFG owner; Henry Swayze wanted to take advantage of the cheap labor, and high unemployment that Buffalo offers to the sleazy side of the collection industry.

Anyone who collects out of Buffalo can be assured that the law, the Fair Debt Collection Practices Act (the federal law regulating the activities of the collection industry) is mostly ignored in the collector’s pursuit to make that commission paycheck. One such Buffalo collector using the name of “Investigator Shaw” at ext.#218 wants you to believe that he (an uneducated collector of debts) has the AUTHORITY to file a lawsuit against you, initiate a wage garnishment (even in states where they are prohibited) and file a lien against your property. This is all done in the name of a scavenger debt buyer who pays pennies on the dollar for a (mostly) worthless account that ONLY a bottom-feeder could get excited over.

They called from number: 312-279-0122 I called the number back and it IS the same collection agency!! So first they called my cell and did not leave a message, then they called my home phone. Both of my phone numbers are on the 'do not call' list. I don't know how they got these numbers of mine!

came up on caller id as: Creditors Financ...I answered the phone not realizing who they are and got a very friendly voice on the phone saying his name is Craig Osborne (he even spelled his last name for me)He scared the begeezers out of me talking very quickly about lawyers and judgements. I have no idea what he's talking about other than I know the bill he's referring to.

I have received calls from CF&G on my message service at work. Odd that the only calls I have received have been over the holiday season - dates are as follows: Dec 14 at 3:33 pm; Dec 18 at 2:16 pm and Dec 29 at 10:20 am. All calls are a female voice leaving extension 3301 and using a very stern voice. You know these people have no idea WHO they are calling and the circumstances involoved and sometimes for things that should have been settled a long time ago with the death of a said party. Some of us are still trying to keep our heads above water and refuse to go on welfare. Little do they know the next person that they "yell" at and speak nasty to will have a heart attack or stroke at work due too all their evil adn extremely rude demeanor and then they will be sued. Of course, I am preaching to the choir. Hope this type of abuse stops. Just because you do not see the person's face does not mean that you can abuse him and will never run into the other party. It is a small world and everyone's action affect a great number of people especially those of us in the public eye. Hope all had a great holiday season - oh what the heck at the risk being un-politically correct - Merry Christmas. Let's regain our American Foundation!! G-d Bless America.

They have a unsatisfactory record with the BBB in multiple states and often use you set up a payment plan.
