They've been calling me constantly and never would say anything when I would answer the phone, never left any messages. How is one supposed to know who the hell they're trying to contact or what their business is if they won't SAY anything?? They call and call and call and call .... no messages .... saying nothing. That's harassment, in my opinion. After emailing, I finally spoke with someone, and it turns out they were looking for someone other than myself. Bothering people like this is bad enough, but especially worse when they've got the WRONG person! Something's definitely got to be done about this. It's just not right.

These folks haven't started calling me too! They ring me back to back, often several times just within 1 minute. I ignore the calls on my cell phone, which means I shoot them to voicemail. Sometimes they leave messages, sometimes not. Why can't we block callers on cell phones yet?!? I am getting these calls as early as 7am EST, and 9pm EST. Even on weekends. This sucks.

These people call--no exaggeration--9 times a day. They refuse to let me call back after I check to see where my elderly mother's finances are (she is the indebted one). They will not leave a message, nor will their supervisor answer my messages. They refuse to provide an address. My mother is willing to pay, but cannot pay the entire lump sum; she needs to do so over 3 mos. They refuse anything except that she pay it all off over the phone. The message is clear: pay it all NOW, or we will harass you all day every day. I am filing a harassment complaint with the Arizona Dept of Financial Institutions. These guys are the WORST!

It sucks to be a debt collector and that is probably why you only know one half of the laws as a collector and it does not take any education to be a collector. That is why collection companies often break many laws because the people they hire to often work for such low pay do not have the education to know all the laws. I know collectors are doing there job but and it is a sucky job but know all the laws not just some of them or if you really hate people because of what you have to do to earn an income then find another job

Often, simply advising the collector that you are aware of the act and your rights under it will stop the harassment. If it doesn=t, you may want to save the messages and letters and keep a log in case you need to utilize the federal and state protections.

Implying or stating that the collector is affiliated or connected with the government; falsely representing the character, amount or legal status of the debt. For instance, a collector cannot falsely represent himself as an IRS agent to frighten the consumer into paying the debt. (Please note that if it is IRS debt, it is probably not a consumer debt and not protected by the Act.)
Falsely implying the communication comes from an attorney or that a person is an attorney.
Threatening to send out false credit information.
Using language or symbols on envelopes that indicate that it is from a collection agency. (This includes sending postcards.)
If your life has been made more difficult by bill collectors utilizing unfair practices, keep in mind that you have rights that protect you from abusive or harassing collection behavior. Not only should you be able to stop some of the behaviors outlined above, but you may also be able to collect money damages from the collector for willful and repeated violations. The federal act allows for a recovery of $1,000 or actual damages and the state act allows for a $500 recovery or actual damages. Plaintiffs of successful lawsuits are often entitled to recover costs and reasonable attorneys= fees. In some circumstances, punitive damages are also recoverable.

Failure to identify oneself as a debt collector. Collectors may use a Adesk name@ to protect themselves individually, but they must disclose the name of their employer and the nature of the business.
Making deceptive, false or misleading misrepresentations. For example, mass-produced collection letters not reviewed by an attorney prior to mailing are considered false and deceptive.

Contacting a debtor at work after the collector has been advised not to phone the debtor at his or her place of employment. Once a consumer notifies a collector not to call them at work, further calls are prohibited.
Advising third parties (friends, relatives, employers) of the consumer's debt. A collection agency should not be defaming a consumer to third parties.
Harassing, oppressive, or abusive behavior. This is a broad category, and subject to broad interpretation.
Threatening criminal acts or violence. If a collector threatens to perform "impromptu dental surgery," rest assured that he is in violation of the Act.

Communicating with the consumer in connection with collection of any debt at any unusual time or place. In the absence of knowledge of circumstances to the contrary, a creditor shall assume that a convenient time for communicating with a consumer is after 8:00 a.m. and before 9:00 p.m. You should not be receiving phone calls at midnight from your credit card company, or "King-Kong Collection Agency."
Contacting the consumer when the consumer is represented by an attorney, unless the attorney fails to respond within a reasonable period of time to communication from the debt collector, or unless the attorney first consents to direct communication with the consumer. Basically, if you have turned the problem over to your attorney, you should not be receiving phone calls from the collection agency.

You have 30 days from the receipt of the notice to dispute the validity of the debt, or any portion thereof, in writing, or the debt collector may assume the validity of the debt. I too have been getting calls from this collection agency and others for someone I have never heard of. She must have some really bad credit. They just started calling and I finally answered, greeted by a voice recording, told to hold for operator, transfered to one, asked to speak to the person they are looking for, told them there is NO ONE BY THAT name at my number, I don't want anymore calls, that I already filed a complaint to the FTC about them repeatedly calling. She said they would remove me.

I got the same company from the number - 800-535-5650

TDM has been calling my parents house CONSTANTLY for a few weeks (and I only lived with them for about 6 months over 2 years ago). My Dad finally answered the phone and got a contact extention and name for me to call but the man would not say what it was about. I called the number and a guy answered and I told him the extention number and he said "what is this regarding?" and the guy said that in order to discuss anything he would need me to verify 4 pieces of information. the first thing is asked is what is my FULL S.S.N. I told him I wouldn't give it and asked him what this call was regarding. He wouldn't answer. Finally he said he would remove my parents number from his list but didn't ask me for mine or anything. I called the number back again and got a women and I asked for the same extention and her question was "who are you trying to reach". I said Mark and then the same guy I talked to the first time answered - he has a VERY thick middle-eastern accent. Now if that was a true creditor (and I have gotten those calls before) - they would have said who they were and would do ANYTHING to keep me on the phone. As soon as I said I wouldn't give my S.S.N. and that I didn't trust he wasn't some scamer he seemed to be totally fine with our call ending.

Thanks for all the help from those of you on this board! I followed the website information and started making phone calls. I was eventually given 706-644-3333, which is their customer service line. I spoke with someone who said he would "open a ticket" to resolve the situation. We'll see if that works. If not, I also found a phone number for reporting things to their Board of Directors. It is a 24/7 number for reporting complaints: 800-240-1242.

Really annoying that there is no way to contact them to stop the calls. The automated voice claims the mailbox is full and that we'll be transfered... we never are but instead get hung-up on.

I have an update!! I was home this weekend when they called for a Mrs. Wilson. We have been getting calls for her and Mr. Wilson daily from several different people. I informed the caller (TDM) that they had the wrong phone number and they have stopped calling.

This number is account management for capital one credit cards. They cant talk about the account issues until you verify who you are, ie personal information. Its against privacy laws for them to state the nature of their call until they can confirm they are speaking with the correct person. They are not in violation for calling, all you people must have someone who used your phone number on their accounts which have gone dilinquent. They have existing business relationships with whoever used that phone number as a contact number on their credit card account. They can call you whenever they want. Don't like their calls? Maybe you should consider paying your bill

TSYS Debt Management is more than a typical telemarketing scam, it is a total system. Our company has been getting calls everday and we are on the National Do Not Call List. My recommendation - print out a copy of this website page, write a formal complaint to your state attorney general (where you reside) and the state attorney general for Georgia. Each time they receive a letter, and the piles of mail get bigger, they will be forced to address it. The next step - send a copy of your letter to each large circulation newspaper and TV station news desk or features dept. in Atlanta. Won't they love it each time they receive a new letter from a new state. We provide the story, they get the ratings....and maybe we'll stop these damned telemarketers once and for all. It's not like it doesn't happen - the courts have recently set a precedence. FIGHT!

Has been leaving voicemails with a standard recording then someone says, "Hello" once or twice and waits for the time to be up on my voicemail. I finally answered and they said they are TDM and asked for my information to verify who I am. I told them no. They said I have business with them. How can I have business with someone I don't know? They would not tell me anything about their company or let me talk to a supervisor. Now they are calling my office number as well. Who are these people???

"This is not a solicitation or a sales call"...This number calls at least twice a day and has for months. I have tried to connect to a live operator and haven't gotten anyone. Today is Saturday. I tried to connect again today and NOTHING. I called back and found that the number goes to "Sherman"'s mailbox, which happens to be full. So I was to be transferred to the "attendant". I held and held and held. I don't know what "Sherman" wants, but if he doesn't stop calling, I have a feeling that many people are going to report him to the authorities for communications harrassment.
