Suing Telemarketers - Simple and Cheap
When most people think about the process of suing a business entity, they naturally consider it a complicated and expensive process. They consider having to find an attorney who specializes in the particular area of law, the costs for such and weigh it against the potential gain. Forget all that when it comes to suing telemarketers!
For those individuals like me who have successfully prosecuted cases against telemarketing firms, there is little need for an attorney. (A cover-my-posterior caveat: I am not an attorney, so I cannot legally advise you. Whenever you are considering legal action, it is always advisable that you consult an attorney. Personally, I have never needed one when filing claims against telemarketers, but you may wish to consider doing so.) The key is that the best venue for filing suit against a telemarketer is in your local Small Claims Court. The only fees you must pay are the filing fees (varies upon venue and amount, but generally is somewhere around $50) and the fee to perform service of process (anywhere from $10 to $100 depending upon whether or not you have the court serve the telemarketer via certified mail or you have a law enforcement officer or other process server handle such). When the potential gain is thousands of dollars, what is a hundred bucks?
I have personally filed four claims in Small Claims Court against telemarketers. I have been paid on three of them (the fourth was against SBC and they gave me such a runaround on the process serving - BUT they stopped calling) that I let that one slide. Of the three cases where I was paid, the following were the results:
1. Filed a claim against a telemarketing firm based in Florida (Health Benefits Direct) for $1500. This amount was based upon two calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy. I settled out of court for $600.00 prior to the trial date.(Initial Cost to me: $55)
2. Filed a claim against a mortgage brokerage firm in southern California (due to settlement agreement, I cannot reveal their name) for $4500. This amount was based upon seven calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy and their failure to maintain a Do Not Call List. I settled out of court for $2000.00 prior to the trial date. (Initial Cost to me: $80)
3. Filed a claim against a mortgage brokerage firm in southern California (Country Club Mortgage) for $3500. This amount was based upon five calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy and their failure to maintain a Do Not Call List. I received a judgment for the full amount of $3500, plus $60 in court costs. (Initial Cost to me: $60)

I've gotten called 2 times today by this number. I've missed both calls because I've been in class, but I've tried calling back both times and the number says it's either disconnected or out of service. There's also a lot of static noise and screeching/beeping in the background. After reading that so many people have been called by this number, so it's most likely just some scammer, I'm hoping to contact my phone company and block the number from my phone.

When the message starts there is a beeping noise, like a low pitched squealing when a recording of a woman speaking Spanish came on saying something about money, then the phone call ended. When you call the number back, the SAME squealing noise comes on and a recording of how the number is "disconnected", however I believe that is just the incoming phone call message they recorded on that number, because the noise on the line sounded exactly the same as when they called me the first time.

I do not speak Spanish and so I did not understand the voicemail left on my office phone. I was glad to read the messages posteded here for clarification. I have been receiving the same kind of messages on my cellphone of this sort for several months. I have all my phones on the do not call registry and I file complaints which do absolutely no good. My solution: I purchased call-block software for my cellphone which allows me to auto-forward blocked calls to another number. I forward the blocked calls to another of the Spanish-speeking blocked numbers. Here they are: 403-791-8251; 403-649-6521; 323-876-1275; and 403-826-0413. Have fun!!!!!

It's a money scam aimed at spanish speakers, what I know and have done;
The skinny: the calls from 414-962-9898 are being done on a Ameritech-Wisconsin Comm landline (not cell) from the city of Glendale (zip 53211) within Milwaukee County. Besides giving all transcribed info to those related police fraud depts and the state A.G.s (my state and Wisconsin) I've reported the same to the Do-Not-Call-Registry and will eventually drag these b*****ds into court for yet another payday at their expense (you do not have to be present in court, THE CONS DO, you prepare a thorough deposition), it pays to go after these cons. The more others use this info I gleaned the more unwanted attention will be directed to the crooks. The harder the times the more criminals try to scam/cheat good people out of their hard-earned and too few dollars.
Pressure also needs to be applied to Ameritech-Wisconsin they cannot plead innocent of responsibility once we directly confront the fact their system is the means from which the crooks are able to commit their scams. I filed complaints via email and phone (keep an accurate diary of all calls and who spoke to you and returned calls, give those those to appropriate Law Enforcement Agencies if they waffle, foot-drag or fail to take you seriously) to Ameritech-Wisconsin Comm and told them that they are aiding-abetting & profiting from the illegal/criminal activities of those using that ph#/landline and they have exposed themselves to civil liability once informed of this activity and fail to pursue in a timely fashion the termination of the service and co-operation with related authorities to prosecute the parties involved. Ameritech is like all corporations, large, polite when they need to be but seemingly unresponsive till the public image of which they (only) care about is about to be shown as dirty (think British Petroleum in the aftermath of the largest oil contamination in the world plus killing 11-12 of their own employees, they went on a public relations spree to "save face")
Like many here I've been caught up in the wave of calls from number 414-962-9898. From what I was able to learn this is a typical money-scam(s) that is mainly targeting spanish speakers, counting on greed, desperation or both to con you. I speak portugese as a second language and was able to get past some of the false layers over the phone and turned the tables on them. Why bother you say? first if common citizens merely vent/complain to blogs or websites it may make you feel better but taking no action because it is "inconvenient" or you "don't have time for this" is exactly what these scammers are counting on to continue their annoying, invasive, ILLEGAL phone calls. Only by taking meaningful action (recordings turned into transcripts, more on that later) with certain agencies will there be any consequences, i.e. HEAT, placed on these law-breakers. Advice: keep all original info for your records in a secure place for future court cases and never surrender them to ANYONE unless due process of law is followed to the letter. Private Security & Investigators hired by the crooks or the phone companies (when they are facing a civil suit for scam aiding-abetting/allowing a public nuisance) will sometimes appear as LEOs and pretend to have police powers (NOT) or court warrants to confiscate evidence from and intimidate law-abiding citizens who righteously file complaints. The crooks (and the phone corporations) know there is a lot a stake and will use underhanded means and methods to silence citizens (remember: don't have time for this s**t?) It's happened to me and I don't lay down to self-serving crooks or companies that enable the crooks or refuse to take responsible action.
Back to my sting, if you respond in english they tend to cut you off and move on. The pitch was Wisconsin lottery winnings that were mine if I was willing to allow use of my bank account to electronically transfer the funds then transfer them back and I get to keep half the winnings while they avoid ICE and taxes (yeah right, heard this one before) what they do is once they have your acct & routing # your acct is CLEANED OUT INSTANTLY. I was able to get the lady (Yeslie) to stay on for 10min, she claimed to be from Guatemala (speaks a certain slang that my employees identified as from that region) lives in the country/state illegally. I got her voice on digital file plus the background noise of what sounded like a very busy office (telemarket or boiler-room) all of which has been given to my state A.G. and the Wisconsin A.G. The reverse look-up gave some solid info: the landline was owned/registered to Ameritech-Wisconsin (SBC) Communications Corp, for more see above.
For those who squirm at the thought of recording a phone scam for this purpose and get lousy advice that one must not do this because it is illegal, get real. All bets are off when the individuals on the other end are intruding on you and your loved ones privacy while BREAKING THE LAW. I have received civil judgements in 6 filings/suits against these criminals that made it worth the time to report & pursue them, it also took away from them the one thing that matters; THEIR MONEY. Got a call on my mobile at 0014 Zulu (02 Sep 2010), rang through to voice mail, no message. Most likely a robo-dialer, originating from parts unknown, faking CallerID.
It's never a good idea to answer calls to your mobile from numbers you don't recognize. That will put you on the next generation of robo-dialer lists as a confirmed-to-be-live number. You will get more calls, from more BadGuys(TM). Even worse, is to call unknown numbers back, using any phone numher that you value to make the call. Some BadGuys(TM) are using ANI, which will reveal your true calling number, and that number will be added to the next generation of robo-dialer lists as a Curious George number. Don't assume, just because you heard a busy signal or "disconnect recording," that ANI was not used to trap your calling phone number. Calling back also exposes your number to financial and information attacks.
Research suspicious numbers via the web and/or your service provider. Be safe. Don't make yourself into just another "mark."

I use magicjack ..they dont even know what service they are calling into when they dial a number. They are stupid ..some services are fixed so there cant be any international calls ..so if I got charged somehow that would be illegal ..no there just woudlnt be any way for that to happen. With a service like vonage you can block incoming/outgoing internation calls. So if they get through I dont see how. No one can charge you that much money from inside us for 1 minute legally. I don't see how. ..if you could then everyone would be getting into a corrupted phone business charging 1,000 dollars a minute inside USA somewhere aka land of victimized corruption.

This is a scam machine, it calls different numbers and then gives a prerecorded message to press 5, for the small 1% of people who do hit 5 instead of hanging up, they get a huge phone bill in the mail a month later. I've even heard of someone falling for this and being charged 50,000 dollars, phone company didn't care they just wanted him to pay it.

Some crazy Chinese calling from "Wisconsin". Message in Spanish. It's not a real number. The calls are from online form China using software to insert a fake caller ID for a number that is not in service.

As others have said, there was some kind of loud noise in the background and then a recording in Spanish. It said to press '5' for help, but I hung up. I'm annoyed to get calls like this on my cell phone!
Just got a call today at 4:39pm on my cell phone, I answered it and heard some sort of applause noise like someone else said, and after that it was a recording in Spanish that I couldn't understand. Finally it just hung up on me.
Just got a call at 7:25pm...they left a message in Spanish. Tried calling back and message said that it was not a working number.
I could hear some one eating then put me go to message, I just hand up
Received call from this # yesterday around 5:30pm EST, picked up and heard some clapping noise (like applauses), I hang up immediately.
Then the call from the same # rang on my wife's cell, 20 minutes after.
Which was kinda strange, because my wife uses a private number which we only use to call inside the family, never gave to anyone.
So my guess is someone is probing numbers, preparing for some next scam.
If you get such a call - reject it or don't answer.

I called back, said this number has been disconnected I think it is a spam
called me and a prerecorded message in spanish said i won a prize... (which of course this is fake)... so i hung up... someone should find out who these people are.
They called at 3:27PM and it's just a recording in spanish. In the background it sounds like a call center. Called the number back and got a busy signal.

Received call from 414-962-9898 on my cell phone at 1:57 PM local time on Tuesday. I answered on second ring to hear nothing but silence. I tried return the call immediately and get a disconnected notice, then an announcement to seek further info on their site if I am trying to reach customer service. Says the number has been changed or disconnected. Interesting that a disconnected number calls outbound. Sounds like AT&T may also be victim of this scam if they can call outbound on a disconnected number.
I have a cell phone that is used for emergencies only. No one has the number except family, doctors, and hospitals. Call is a recording, in Spanish. I hung up, but I'm throughly disgusted with this crap. Even though solicitors are not supposed to call cell numbers, they do it anyway. I've had my cell number on the DNC list for several years for this one reason. It doesn't stop the scum!
Called at 1:00pm. no message. called the number back and it says it is disconnected.
Called my cell. Voice in Spanish, pre-recorded. After saying hello, I just listened. Call lasted 20 seconds before they hung up.

Didn't pick up as I was in a meeting. They called at 3.21pm (PST) & didn't leave a message. Kinda had me curious, I entered the number in Google Search which led me to this site.
This phone # called my cell.It sounded like a recording of spanish crap-Ola!
The caller called my Google Voice (formerly GrandCentral) phone number that I give out only to close friends. This number is not listed anywhere. They're just dialing randomly.

Call came through on son't cell phone. Call but does not respond. Nobody has our this # except AT&T, who were idiots when they listed it as the primary # on our account. Now we constantly get calls from out of state regarding solicitations even though we are on the DNC list. AT&T gets the blame for this one since all our other phones are never bothered.
