Let's try that again ...

DENVER — Colorado Attorney General John Suthers announced today that his office has filed a lawsuit against Regent Asset Management Solutions, Inc., a Denver-based debt collection agency, and its CEO, Michael A Scata (DOB: 5/6/1954), on suspicion that they engaged in the unlicensed collection of debt in Colorado and violated Colorado consumer protection statutes.

Here's the start of a press release of interest from 01 Dec 2010:

November 18th, 2010 Resident47

Laura: The collector may be violating FDCPA depending on the nature of of its verbal threats. Don't be too shocked when your verbal cease-comm is ignored. As I have already said in this thread, it won't stick unless written.

Arnie and Jo: Collector calls to mobile phones are exempt under TCPA but banned under FDCPA, on the theory that collection activity should not be financed by alleged debtors. The people best able to directly help you are waiting in your mirror to exercise your Federal rights, AGAIN as I have already explained.

Tom: The laws already provide private right of action. I'm failing to see how pranking and posing as a collector would not lower someone to the fake payday loan thugs now running amok. One day such antics may irritate a collector enough to sue the smirk off your face.

I received a partially decipherable message from this number. From what I could make out I was being threatened that I'd better call them before 6PM CST 17 NOV as I had been negligent in not returning their previous messages. I was advised to call a Mr Freeman or his associate! So... I have just got off of a call with these fools. I advised them to remove my number from whichever list it is they found it on. They advised they were looking for someone else (completely different name). I advised them that if this had been an older person or a frail person who received a threatening message like that, they could have been very frightened. I advised the girl I spoke to to advise 'Mr Freeman' that he should really make sure he has the correct person before leaving voicemail messages. The girl said there's nothing wrong with what he does, he can say whatever he likes!
I said not on my phone line he can't and SHE hung up on me!
I am now apparently removed from their list!?! - which can take up to 24hours to show - so I may receive another call in the meantime!!! This is absolutely outrageous. ANGRY!!!

November 17th, 2010 Arnie

Had nasty calls each week for the last four weeks from this "Mr. Stanley" on my cell phone. I don't think that legal, but what can a person do? The regulating agencies have been no help, so not worth my time.

November 12th, 2010 Tom KS

Listen people... Have a great time with this.

They called my house two Sundays in a row. So I have taken the time out of my day to use my home phone and my cell phone, depending on where I am to make calls to their company.

IT rings once, then operator says "Please hold while you're being connected"

Then someone answers instantly...

At this point, I claim to be Michael Jordan, owner of Rocky Road Ice Cream Delivery CO. I explain to them how a Mr Stan Lowe has taken a personal account with my company and after several weeks of on time payments and deliveries from my company, his account is now in suspension due to late payment. They always put me on hold and either transfer me to a manager/ supervisor, as I continue to harass them, or they go speak to him and they come back nerved of these now confirmed false aligations.

Either way, it's a pleasing sense knowing that you've waistted their time and pissed several of the "assistants" off.

Give it a shot.

Do not cooperate, call them back. Try to sell them things, lie, phib, give them a hard time, pretend, make believe different situations and have a good time with it. The phone calls have stopped and I still make effort to call them multiple times each day.

Ah... A great feeling knowing they're feeling what they dish.

Comment on how it goes.

November 10th, 2010 jo MA

Why can't we stop this nonsense?????

November 9th, 2010 frank WA

This guy needs to stop.......NOW

Left a threatening message on my voicemail

November 8th, 2010 Grace Gunter AR

Tried to leave a message but mail box was full and would not accept any messages.
No one answered the phone.

Cannot get information to this person.

November 8th, 2010 MKA OH

Another threatening call. I am not the person they are looking for. I called and told their voice mail that. Today I filed a complaint with the FTC. It was easy and didn't require much info about me. I tried to call Mr. Stanley Lowe to inform him of the filed complaint, but his voicemail was full. Go to FTC scroll down and look for File a Complaint, you can check the form out again before you file it.

November 8th, 2010 Resident47 RI

This foolish collector sure has been busy today. It has been identified several times in this thread, and advice on how to respond has been given. There is really no point in consulting a forum like this if you won't take a little initiative.

November 8th, 2010 C.H.

Said he had left previous messages -- he didn't. Started talking (or recording started talking) before outgoing message was finished, indicating to me that it was a computer recording.

November 8th, 2010 Kim MO

This man called me and said his name was Mr. Stanley and that I needed to call him during his work hours? Who is this. Did not state his company and does not state his company when you call back during his office hours. Not sure what to do? Is thi spam? If I didn;t call him this week, my report would be advanced..IDK what that means. Can anyone help me?

November 8th, 2010 Florencia NM

I keep getting calls from this number. I believe that they are looking for the person who had my cell phone number before I did. I told them not to call me anymore, that I'm not that person, but they keep calling. It's been about 2 years that they've been calling. The caller says that they are from a "law office." From other sources, I found that they are actually a COLLECTION AGENCY. They could be legitimate, but obviously, they don't care if I told them that I am not the person that they are looking for.

November 8th, 2010 MH TN

The recorded message, very rude and threatening from a Mr. Stanlow(?) or return call to adminisrative
assistant during business hours Mon-Fri. Left on Sunday ll/7/10.

November 8th, 2010 Anonymous

Badcall from 877-591-7732.

November 8th, 2010 FH FL

unknown caller VM from a Mr. Stanley Lowe(computer generated voice) 2010-11-07 at 11:54 am Sunday..said if I did not call during the following week my file would be advanced. Did not state my name, what file he spoke of or what matter...methinks this is an idiot calling..on a Sunday yet!

November 6th, 2010 Resident47 RI

Sounds like "Mister Stanley" needs to "advance" his FDCPA compliance. The pattern of complaints indicate a dance on the edge of regulations, creating an impression of a lawsuit poised on a hair trigger.

"Anon" was only partly right. The FTC makes two demands of third party collectors which are sometimes in conflict. A collector must make "meaningful disclosure" of its identity yet respect the privacy of whoever is named on a debt account. Some collectors use recorded messages to create fear while concealing identity, and it is not clear from case law if this irritating practice is actually illegal. I do think this other pattern of falsely claiming multiple attempts at contact could be worked into a misrepresentation or fraudulent practice charge.

If you are receiving repeated, misdirected, and/or abusive calls from a third party debt collector, you may find relief in the provisions of the FDCPA, which regulates collector behavior and provides you simple tools for your own defense. It grants you control of how you are contacted, and collectors can be sued for their crimes. Learn your rights and first response tactics at FTC-dot-gov.

I have repeatedly received calls from this number since June 2010. Because they are recordings, vague (they never say what company they're calling from, the messages they leave are:'I have received a file from another party...'), and incredibly rude, I have never acted on them. I tried contacting the Federal Communications Commission to complain about this, they directed me to file a complaint with the Federal Trade Commission as they have jurisdiction over debt collection calls: 877-382-4357. The only reason why I know the name of the company who called (Regency Alliance) is from googling and looking up this number online.

November 1st, 2010 cc

Very unprofessional, aggressive, rude man leaving the message as a Mr. Stanley regarding a file that he received at his office and he tried numerous times to call back and no one has responded. They said they called lot's of times but they have never called before. They called my mom and she was worried sick! My mom suffers an axiety disorder and this would not have helped her. NOT Good at all. I wish these calls could be reported and they people behind the phone arrested.

October 31st, 2010 Anon NH

Received an automated message on my phone from Mr.Stanley. He mentioned a file that had "come across his desk" and wants to speak to me about it. He continued saying his intermediaries have reported to him that they have left many messages at my machine and I have failed, ignored and neglected to return their calls. He continued to state if I don't call back this week he will be forced to "advance" my file without my input. This was a very threatening message. It is illegal to threaten consumers. It is also illegal to neglect to inform the consumer they are a debt collection agency attempting to settle or collect a debt. I am going to call this "A**H**E and give him a piece of my mind. I do not take kindly to being threatened, and Mr. Stanly, myself, and the FTC will be speaking on Monday morning.

October 31st, 2010 K rodriques MA

I've had many calls saying that they are calling for Mr.Stanley.That he has my name mentioned in a file and wants to speak to me about it.
Today's call was more aggressive. Supposedly, Mr.Stanley himself, saying his intermediaries have reported to him that they have left many messages at my number and I have ignored them and didn't call back. If I don't call back this week he will be forced to "advance" my file without my input.

October 31st, 2010 Rod Downey

Received call from this number from a Mr. Stanely reporting a seriouse matter its a prank a call!!!

October 31st, 2010 V.M. NY

Very nasty. Threatening call. Said I'd better call him back on Monday or he would "start proceddings" against me. He never mentioned MY name.

October 31st, 2010 Verizon User

Just went thru old voice mails. it's oct 31st now. I got the message back in september. I never called them back, nothing's happened to me. My advice is just to let it be. They'll send you something in the mail if it's legit. They never said my name in the message.

October 31st, 2010 Larry

I received a phone message from a Mr. Gillbeck and Mr. Stanley whom stated we ignored all his associates calls....Unfortunatly my daughter whom got into financial problems used our phone number but hasn't lived in my home for 2 years. This company is in violation of the TCPA (telephone consumer protection act) as they fail to provided personal information that could be picked up by any party at the home. I suggest saving these messages as I am as you can get $500.00 to $1,500.00 per call. Once you get several of them, contact an attorney whom specializes in the fair debt and you could earn additional monies in these hard times......I been told that collection agencies whom use dialers don't care about having to pay these fines as most of them are still making monies on scaring people with the messages left....

October 21st, 2010 James OH

This place is Regent Asset Management Solutions. They are a collection agency. They do a horrible job of researching their information. If they called you, chances are they're looking for someone with the same name as you that has some outstanding debt.

October 18th, 2010 Katie TX

I got the same full of crap threatening message. I called back and finally got someone to identify the company....they are Regent Assett Managment Solutions.

October 18th, 2010 Mike CA

Left a message, very threatening, very obscure matter. Never answered. Called at 7:00PM Sunday Evening. Rude.

October 17th, 2010 Cynthia

Left unintelligible message -- obviously computer recorded -- and sounded threatening.

October 17th, 2010 Resident47 RI

National DNC doesn't apply to collectors, Jackl. That was made known to you when you registered. If the canned call reached a mobile phone, TCPA may help.

Clark: Don't let these thugs rattle you, that's just the reaction they want. You notice they are already lying to you regarding the number of contact attempts. Document each call and what they say. If they want your money badly enough they can dun you on paper this week as the law demands.

October 17th, 2010 Jackl NV

Robo dialer called and some recording came on. Never spoke to a live person. Reported it on the DO Not Call List

October 17th, 2010 Clark

Vary threating call that makes your heart skip a beat. Needs to be stopped before someone has a heart attack
We owe no bills but they really don't say we do. He does say they have been leaving many msg's in ref to this matter
but this is the first we got. I'm afraid if I were to call him back it's just a scam and he is going to try and
get info. from me that I don't want to give him since I do have a high credit score and don't want to compromise it.

October 17th, 2010 GDP AZ

Some dumb service is calling blind to flush out something. want left who the message is for. not going to respond, because if it truly was for me they would call directly and say my name.

October 16th, 2010 Resident47 RI

James, take some initiative and read what the FTC has to say like I've already suggested. The rules collectors must follow are right there, along with simple and enforceable first response tactics. You and QuietWatch will find that verbal DNC requests are always ignored.

October 16th, 2010 quietwatch VA

Likely a collection agency trying to find someone who had my phone number more than 8 years ago. It has happened many, many times over the years. I even know the name and real phone number of the person they're looking for now (did my own research just for fun). This is the problem with allowing these idiots to send canned calls - no way to stop it without calling them and going through a bunch of crap to get your number removed. And if you're even able to do so (not likely), your number WILL make its way back into their calling system.

October 15th, 2010 me myself 06 Netherlands

I am believing that even giving the name was too much information from these criminals on phones.

October 15th, 2010 me 06 Netherlands

I am believing that even giving the name was too much information from these criminals on phones.

October 15th, 2010 James OH

I just called them back and they asked if my name was:____ ___, which it is, and then they asked if the last 4 digits of my ss# were 2313. I said no and they told me they had the wrong guy and that they'd take my number off the list. Why can't they do some freakin' research before harassing people???

October 15th, 2010 James OH

So what is this place and how did they get my number? Should I call them back and tell them to stop calling?

October 15th, 2010 Resident47 RI

I see I should have mentioned that everyone hearing this "legal action" crap can turn it around and sue the collector under the FDCPA. Document and/or record those calls, people. Learn your rights at FTC-dot-gov.

October 15th, 2010 James OH

I got a call from this number and a recording from a guy who sounds like a prick told me to call the number back and ask for a "Mr. Jones." He said one of his associates has been trying to contact me, unsuccessfully, and that I must call him back before 5:00 PM or they will take legal action against me.

October 5th, 2010 Y M FL

October 4th, 2010 Resident47 RI

I believe the name is Regent Asset Management Solutions. See discussion under this close cousin number: 8775917730

The TCPA prohibits auto-dialed and canned calls to mobile phones, but collection industry lobby ACA International coaxed an exemption from the FCC in early 2008. However, on the FTC side, collectors are not supposed to incur mobile phone fees for a called party. This, you can imagine, leads to confusion in court cases.

October 4th, 2010 robert ME

Voice recording (ILLEGAL IIRC) telling me to call a "Mr Freeman" before 6pm or some type of legal "action" will be taken against me.

Came from REGENCY ASSET MANAGEMENT at 1-877 591 7732.

Called back after having the phone put down on me repeatedly, I got some women asking for Jeanette (???) told her i was there was no one her of that name, nor any woman of any name as i was gay! She couldn't handle the rejection and hung up.

Oh and if you *67 your number they can still tell what number you are calling from.
