I have gotten collections calls on this line for Mr Anderson before. They stop when I tell them this is no longer his number.

A message to the specialist that works for this company, I get an average of three calls a day for someone named Tabitha. This number started calling me a few weeks ago. They call at odd hours (night, weekends, and once at 5:00 in the morning) so I haven't answered until today. They ask for me, I say "speaking", then they ask for my social security number. I ask who they are and what this is about, all they will tell me is that they are RPM Financial "we're a financial institution" and that is all they can tell me until I give them my social security number to verify who I am. So I ask again what this is about, I'm not going to give my info to someone cause they say I should and the dude gets an attitude and tells me that he needs me to verify who I am and tells me to call him back when I can figure out my social security number.

To Tired: What they are doing is a Federal Law violation (not the DNC list either). Skip tracers (which is what these clowns are) may not call a business more than 1 time for any person. The fines can total $50,000.00 and you have the right to sue them in civil court for up to $100,000.00 plus costs. Step 1: Go online and secure the forms from the Federal Trade Commission and file a formal complaint. Step 2: Trace the call to the company/individual and send a letter stating you now consider "them" a "hostile agent" for whomever their customer is and you will notify said customer of their behavior and sue them along with the skip tracer. The "hostile agent" embedded in a letter tells everyone concerned that an attorney is now involved and usually stops future calls. They also don't want their customer threatened, especially if it turns out you are not the party they are seeking or related to them in any way. This idiot really messed up and you have the upper hand. Good luck.

Tired, you're not helpless as an employer. In fact, you get special mention in the FDCPA. As I discussed here in February, hostile skip tracing is common from this industry. Part of the scthick is to insist you're a liar until you either give yourself up or open the broom closet where the alleged debtor is supposedly hiding.

That sort of hounding with layers of cursing and abuse is illegal. You've a cause of action to spank RPM and the individual reps in court. The next official-type links will start you on your homework.

Verbal demands are totally useless against your attack dogs, so you need to move to a paper trail as I've also discussed before. Save copies of all phone calls if you have a recording system and take copious notes every time you have an encounter. You are gathering evidence which you will need badly.

I am an employer and this company has called so many times for an ex-employee I have almost lost my mind. I have told them to not call. I have explained she no longer works here. I was told that he will quit calling if I tell him the truth and give him her phone #. I have no contact with the former employee & her unpaid debts are not my concern. My concern is running a business and to stop getting harassing phone calls. This "man" has cussed me out, borderline threatened me, & is out of control. MD, just because a few people have pushed through TCPA claims does not mean everyone can win them. That law was written for sales callers, a fact which has been upheld many times over in recent years. Historically to use TCPA against a debt collector you have to hit the privacy breach issue square on the head, and a clear excess of calls also helps. The FDCPA already bans calls made knowingly to mobile devices when they incur cost, but this is another angle which has seen inconsistent rulings. The real issue is that technology has gotten years ahead of consumer laws.

As to your other points, the FTC remains the dominant regulator of debt collectors, while the FCC has very little input. Kevin Trudeau is a known thief and cheap hustler who is only hawking dubious self help books because he's been banned from selling everything else.

Debt itself does not ''expire'', but it does become difficult to collect as it ages, moreso once the Statute of Limitations has run. SoL is determined both by state law and by one of four account categories. SoL periods range anywhere from three to *fifteen* years. The SoL sets a ''shot clock'' for litigation to collect on an account, a clock which devious collectors try to trick people into winding back. The clock begins to run typically when a debtor defaults. At times the actual date is not so easy to determine.

A debt account can be collected or litigated either until the end of human time or it's discharged by court order. Expired SoL provides a killer defense which the alleged debtor must raise if sued. The threat of suit over sufficiently aged debt creates a FDCPA violation, thus another defense or a cause of action if the alleged debtor wants to be a plaintiff. Ditto for those two states which have a Statute of Repose, which makes collection illegal once SoL expires.

Congress passed the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. §227, to curtail the use of automated dialers and prerecorded messages to cell phones without the permission of the consumer. Notwithstanding the passage of the TCPA, many businesses have harassed consumers by placing literally dozens and sometimes hundreds of telephone calls to cell phones.
On May 11, 2012, the United States Court of Appeals for the 7th Circuit issued an opinion in the case of Teresa Soppet v. Enhanced Recovery Company, LLC. In the litigation, the Plaintiffs sued a debt collector attempting to collect a telephone bill from a third party. Plaintiffs sued Defendant for Five Hundred Dollars ($500.00) per telephone call and One Thousand Five Hundred Dollars ($1,500.00) per telephone call if willful.
In response to the lawsuit, Enhanced Recovery Company asserted that it was not liable under the TCPA because it had consent from the party the debt collector intended to call — the actual customer of AT&T. In rejecting the argument of Enhanced Recovery Company, the 7th Circuit recognized that Plaintiffs are entitled to protection under the TCPA as they were the “called party” under the meaning of the TCPA.

The initial advice you need is found in my 20 March remarks, a mere three comments behind yours. Lawbreaking debt collectors absolutely love to torture people at the workplace to create false shame and hope to get pressure applied. The PoE calls also send a tacit message that ''we know you have money for us since you have a job''.

Impatient managers must be made to understand a few things and not punish their staff for some intruder's hostile collection activity:
- Usually the agency knows perfectly well how to reach the targeted person at home but chooses not to, under a pretense of skip tracing, which is illegal.
- These are not ''personal'' calls in the sense that employees invite or control them.
- Anyone at the workplace can tell the collection reps to stop calling there for whatever employee and/or indicate that such calls are ''inconvenient'' or not permitted. By law, the agency must stop. (Some will refuse to cease, and must be clamped under a Cert-Mailed demand.)

The alleged debtor has broader power to restrict or ban all calls to all places, as discussed in my prior comment here.

Says they are looking for a courtney savage. I do not know anyone by that name and there are other numbers that are similar or really close to this number. The last four are usually the same except the last number usually changes. (between 7111,7114,7112) It varies with the last four or slightly changes. If I pick it up it if you are not this person push one if you are push two. I have done it twice and still keep calling and wants you to stay on the line no matter what. It is annoying.

There are other identifiers which work as well as SSN, but you are not required to answer or cooperate on the phone, much as the bullying attitude you were given might suggest otherwise. You are not required to ''settle'' anything before you see real proof on real paper, either.

If RPM thinks you owe something, you were owed a dunning letter promptly after that initial phone chat. Be sure to respond on paper with a dispute and validation request, adding that you either restrict or revoke consent to call again. Given the industry's documented need to break laws to get at your assets, you should dispute even if you agree slightly with its claim.

If the account is not legally collectable, or it's simply not you they want, you're free to send a full cease-comm, cutting off all contact. Send all notices via USPS Certified with return card. The FTC and many consumer watchdogs explain how to draft them. Pay close attention to all communication and document it well. If those contacts yield legal violations, you may collect from *them* through a judge or arbitrator. Your closely timed calls could, for instance, be part of a pattern of annoyance or harassment which is violative.

Ive had multiple calls from this number. Answered twice with no answer and then a click sound before call was ended. The rest I didn't answer and no Voicemail left. Called the number back and was informed it was RPM in an attempt to collect a bad debt they had purchased. They would not give me the information as to who it was for what it was without first giving them my full name and social. I refused and was asked if I would just like to pay my bill to settle the debt. Which is funny because I used a different number to call back and never gave them any information. Upon telling them to either explain what it was about or stop calling me, I was hung up on. Called back and asked for a supervisor, whom I was told I was speaking to. Basically had the same experience except that instead of just hanging up, I was told to please call back when I am ready to settle my debt and have a nice day. Then hung up on.

Ridiculous! How is this legal? I have had one debt in my life and settled it in 2010, so it can't be mine, but can't seem to stop them from calling. Have received two calls this evening about 5mins apart too.

Any time they answer with This Is Mister You know it is a Junk Debt Collector. The "DEbt" isn't sold untill the original creditor has sucked all the insurance claim, tax swduction etc untill it has been virtually sayisfied. It has been sold and transferred around to paper companies so many times the details are lost and it is worthless, It is sold then to the bottom feeders who harass you untill you give them some money at which time the Statutes of Limitations start over and they have you. Some times if the claim is large enough they go to court and have a civil court judgment turn pennies into 100 dollar bills by judging you owe the fradulent amount they claim. They don't want to collect this what they want is to bundle this with some of the other hundreds they file each month in every city as asset backed securities. Backed by ajudgment against someone who possibly has left town was judgment proof or what ever. This house of cards will come like the motrgage crisis tumbling down. County Civil Courts are complacent coconspiritors!

Joanne and many others: You don't need a valid debt or a derogatory trade line on your credit reports to be hassled by debt collectors. They call third parties to alleged debtors all the time for permitted skip tracing purposes, or often pretending it's a trace to annoy and shame an intended target whose location is already known. Runaway skip tracing is arguably the most common problem the debt industry creates.

To a ''not me'' case I always recommend putting the agency on notice, just as you would if you were the target and the debt claim was invalid. Send a cease-comm notice via USPS Certified with return card. The FTC and many consumer watchdogs explain how to draft one. This will set a legal landmine, as such a notice is ignored at their peril. This can also help pull the agency under the shadow of TCPA, which carries treble damages for ''willful'' violation.

Don't let chest-thumpers like ''Specialist'' from June 2009 fool you. Nine out of ten those skip trace calls are not accidents. The collection rep is not your best friend and not your financial advisor. A ''50% sale'' is a common offer across the industry, and no bargain for you when the agency paid maybe 08% of face value for the entire debt portfolio. Not to mention ''settlement'' offers have to be arranged with exacting care to keep scofflaw collectors from welching on their deals and/or reselling ''forgiven'' portions. What's more, collection agencies cannot simply park a bad trade line on your credit bureau reports the way a hunter sets a bear trap. When they pull, it must be for a good reason, and what they report must be accurate.

That rep's whole rant is straight from the industry songbook, in which the constant refrain is that everyone he talks to is a cheating liar deserving of punishment. Then suddenly he's your pal when you drop your healthy skepticism, handing over his phone extension to secure more commissions. He wants you to ask "How do I pay" before you demand "Prove I owe"! Kay was correct in July 2010. Hassling her mom was a privacy violation under FDCPA. So was the rep's hostility when being told the debt claim was invalid. Sounds like others in this thread have suffered abandoned and misdirected calls. RPM is known for sloppy skip tracing and hounding the wrong people who just happen to have a slightly similar name or number to the actual target.

What Martha encountered in the same month was a shy tiptoe around privacy regs, a common industry reaction. Realistically the rep could divulge a business name without breaking the alleged debtor's privacy, but it's such a sore spot for lawsuits that many agencies prefer an air of mystery .... which I suspect they find helpful in scaring payments from the innocent.

If you know for sure a collector has nothing valid on you, write a cease-comm notice. If you're not sure, draft a notice on paper disputing whatever claim and requesting validation. In the latter case you need to be sent a prompt dunning letter anyway, the lack of which is itself a federal violation. Send either notice via USPS Certified with card. The FTC and many consumer watchdogs explain how and why to draft these letters. If you don't take the exchange to a paper trail it will never exist legally, capische?

I'd also note that collector calls to mobile devices are also FDCPA violations, IF you notify the collector. Get a nice enough pile of lawbreaking and you can handily win the $1K statutory fine per action. You might in some cases also ding the agency under TCPA at $500 a pop for canned calls.

Finally - they called and someone was there. It seems the company is Receivables Performance Management. What are they - a collection agency. They told me of a bill with Verizon that was not valid and wanted to collect on it. When I asked for their company name and address, so I could submit a letter for them to stop calling, the guys just asked are you going to pay this bill or not. I again asked for the name of the company and the address and he then said his supervisor was telling him to get off the line because I was not going to pay the bill. They are located at 1930 220th Street SE Suite 101, Bothell WA 98021-8410 and are also using a PO Box 768 with the same City, State & Zip address, too. The Founder is Howard L. George and he runs a website: //ReceivablesPerformance.com for gathering Clients to keep them in business. They do use a Demon Dialer of some sort to "Hunt Down" targets who may answer their phone which is why you rarely get a live person on the calling end when you answer.

To combat these types, there are a few tactics. First, when you answer your phone, be sure you are NOT doing something important (especially driving) and wait for the live person to get on the line as this may take a while. Say hello politely several times so the Caller will FEEL comfortable they are talking to someone who is "Civil" enough to deal with. When they do respond as a live person, your FIRST QUESTION will always be: WHO ARE YOU TRYING TO CALL, PLEASE? without yelling at them. DO NOT TELL THEM WHO YOU ARE, they called you looking for someone so find out who they are looking for, first. 9 times out of ten, they will have the wrong number but you MUST inform them that you have had your phone number for so many months or that it is a relatively NEW number for you so that these people will FEEL you are telling them the truth and not someone trying to hide from debt collection practices. If you are NOT the person they are looking for, DO NOT lead them to believe that you may know that person, either. It is NOT your responsibility to be contacting someone else for them. If they continue calling you, inform them that if they continue to keep calling you (especially on your cellphone), you will treat this as harrassment and will report them to the phone company (forget about the police for now). The phone company has a legal department who handles this problem.

The Second Step: If you ARE the person they are trying to contact, YOU MUST ASK them politely to tell you what address they have on file for you. Do not give them any new information about you no matter how they TRY to coherse into doing so. If the address IS correct AND it is a CURRENT address that they can reach you at; YOU MUST tell them to send EVERYTHING IN WRITING to you at that address on record. Ask them to sign their letter to you. Never, NEVER, handle transactions over the phone such as giving them additional information, especially where you bank at or give them credit card numbers, or where you work, etc.

When they call again, wait for the live person (again) to inform them you are waiting for their wirtten demands in the mail BEFORE you can respond any further BECAUSE YOU ARE REQUIRED TO VERIFY THEIR CLAIM FIRST before proceeding any further. You are still letting them know that you are a reasonable & civil person to deal with, so politely excuse yourself until you have THEIR documentation in your hands. If RPM rebuts with excuses to continue before you have a reasonable amount of time to validate their claim, you may politely let them know that you know HOW to reach MR. GEORGE and his company and to please be careful with what (the Caller) says for you may have to use that against (the Caller) at at later time. This type of caution usually stops them from proceeding unless they are trying to upset you. It's an attempt to get you to lose control which you already have over them. You can also inform them that this call may be TRANSCRIBED (not recorded) in case you need it for a later date. You want them to hang up on YOU, not the other way around. This is how You maintain control over them.

Third: When you actually have their written demand for payment, hopefully you will have their name and best of all, their signature as well; now is the time to do your research on verifying IF the debt is genuine. There are all sorts of information on the web for fighting for your rights. Use them. Check to see if the Statute Of Limitations had expired. Check websites for help on writing proper letters such as legal Demands to Validate Debt. Most importantly, always write (never communicate over the phone) with the intent to use the U.S. Mails with the Certified Delivery WITH a "Return Receipt" mailed back to you at YOUR address. It is much better to use their (RPM's) PO Box address because it is difficult for the RPM Rep to skip signing the delivery receipt when it is at the Post Office for pick up.

When you use the Mails, you maintain your protection and have evidence to use against them when it comes time to prosecute them for violating the laws. And they will be breaking many laws. Do your own research for yourself, do not shrug it off because knowledge is power! It will build your confidence when someone else tried to use bully tactics on you again. Read, read, read, write, write, write. Use the laws, it will stop them EVEN IF YOU DID HAVE A DEBT. The most satisfying part of all this is when you win your case and the actual valid debt amount is awarded on your behalf.

Now, go out there as an American Citizen and know the Law.

We get calls from these people as well. They will call for a couple of days, never let the phone ring more than two or three times; it's gone to voicemail once but no message was left. Then we will hear nothing from them for several days and then the cycle starts all over again. I see someone says they are a collections company for verizon. Yes, I have verizon however my bill is paid up each month, and is paid automatically through verizons system so I KNOW it gets paid! Besides, in the past, when I was overdue with verizon they would call me directly, or send me a text on my cell phone, not through some debt collection service. I own no businesses, so I knew this was probably a scam. It gave me this number: 800-618-6705 and asked that I called back immediately. So I did. It rang and rang and rang, and rang some more. Then I could hear the line switch... like the call had been forwarded to another line. After two rings, I think Latisha answered. I said that I got a message that didn't explain what it was about, and I asked who she was. She said she was from RPM, and asked if the number I was calling from (my cell phone) was the number they called. Yes. Then she said she was looking for a woman whose name I'd never heard before. I told her that she was not the owner of this phone number. Latisha told me she'd remove my number from her account, and that was it. If you google the number (and some variations: 7111, 7113, etc), you will find multiple comments about attempted fraud that this "collection agency" has allegedly committed. They never asked for my own information, but I wasn't going to give it even if they did.

Are you being hounded by a debt collector for an old debt you thought was written off years ago? If so, it is likely you are being contacted by a scavenger debt collector, which is a company that purchases older, mostly uncollectible debt for a tiny fraction of its value. Scavenger debt collectors are notorious for using illegal and unethical methods to collect "time-barred" debt.

You do not have to pay debt that is considered too old by your state. Every state has laws governing the time in which a person or entity can file suit to collect a debt. Generally, a creditor or debt collector gives up his right to file suit to collect a debt after a period of six years from the time the debt was written off (or the date of last activity on your credit report), but various states allow anywhere from 2 to 15 years to collect delinquent debt (see statutes of limitation table below).

The purpose of these statutes of limitation is to bring some measure of fairness to the debtor so that he / she (1) will not have to worry about being sued for the rest of their lives; and (2) so that the debtor can properly defend himself with fresh evidence and witnesses, if any.

About 200 of the last 750 calls I have received have are these scam calls. Now that might not sound too bad till you consider I have been looking for work and have been talking to 5-10 recruiters every day so about 400 the calls where job related. So if I was not dealing with recruiters well over half my calls would be these scam calls. Time and time again I look the number up on these boards and find the number has been used by multiple scams so you can only assume it is spoofed.

You cannot permanently block these kind of callers because they just keep changing the number they claim to be calling from. It is time to stop complaining on these boards and start screaming at your representatives to shut down companies offering spoofing services and make the phone companies block the signal that overrides the true caller ID. Those that want to block their ID fine (though currently that is illegal for solicitors to do), those calls go directly to my voice mail but this spoofing has to stop NOW or your phone will be as bad as your email WITHOUT spam filters. From what I can see most of the other phone providers do not even offer blocking. Can you imagine if your email provider did not have spam filters? If you do not have call blocking about all I can suggest is not answering any of the following caller IDs:
TOLL FREE CALL
SALES DEPT
PRIVATE SUITE
Unavailable/Anonymous/ blank
and any number from the 954 area code ( not sure why but seems to be a fav for scammers)

That will filter at least 50% of these calls. Personally I only answer calls now from my area code or numbers I recognize. I am sure it is only a matter of time though till they start spoofing numbers local to where they are calling.

Any legit company is NOT going to hide behind another number so you SHOULD assume they are a scam if they are doing so. From what I have been reading many of them are ID theft scams. Before calling anyone back, you do not know, Google the number. Odds are you will many complains about that number. If not then and ONLY then call them back. If we have learned anything from spam you NEVER contact them to ask them to not do it again. That just confirms you got the message they sent and increases the value of your info to them and who they will sell it to next. Again personally I have a rule that I will not buy anything from a company that cold calls me. Especially since I am on the do-not-call list. Also any legit company will leave a message not call back continuously. Especially after you tell them you are not interested. That kind of hard sell is a BIG red flag.

Now go look up your congressmen and senators and start screaming about how the do-not-call list has been made useless by spoofing!

Receivables Performance Management is a bottom-feeding collection agency. They are trying to collect a debt that I paid off 7 years ago. I just never answer the phone because they will eventually go away. All they want you to do is pick up once and then they try to scheme you into verifying the debt is yours and valid. Then they will harass you for a while. Pretty pathetic.

Looks like the phone number has changed hands over the last couple of years. I just received a call from this number, and it was a recorded message about a diabetes survey. They ask you to press 1 to take part in the survey... then at the very end of the message, they then give you the option to press 2 to decline. The after a brief pause, a recoding comes on and says your number has been removed. I hope so... My phone rings all day long, while nobody that I know actually has this number!! It's all wrong numbers and surveys, even "Important Auto Warranty Announcements!"

I've been getting calls from RPM at the most annoying times. I didn't even know what it was about. I, finally, was available to answer and when I picked up, I was hung up on. I called back and a young lady answered claiming that I owe Cingular 100 and some odd dollars. I had PREPAID phone service with Cingular that I canceled over 6 months ago when I switched cell phone companies. It struck me odd that she asked me if a certain address was mine and when I said no, she never asked me for my current address, but said she was just calling to let me know that they'll be sending out a letter, after I told her that I do not owe this money. Since when do you need to call before you send a letter and wouldn't you want my actual address...and why is this the first time that I'm hearing about a bill when I had automatic payments set-up for years?! Sounds like a scam to me. I'm ready for war!

Here is the company's name, address and a toll free customer service phone number. Unfortunately I have had financial troubles and was late on a utility bill and received a letter from this company regarding the late bill. I don't know how they expected to get in contact with me since whenever they called my phone only rang once and a message was never left. The only reason I knew who they were was because of the letter that was sent to me.
Hope this info can help all of you that are being unfairly harassed by this company.

Have had similar experience although this was 1st contact from them -- all they wanted was my personal information, which I refuse to give over the phone. When questioned, they would not reveal why they were calling other than was for "Verizon." I have never had Verizon and live in FL currently with all bills current. Only reason answered the phone was because was 703 area code which I used to live in over 10 years ago. My only suspicion is that it's related to my former fiance's cell phone that was with Verizon and I paid one time for him. When the agent became abusive, I hung up, but suspect will get further calls from them. As someone who works in a supervisory capacity in a call center, will have not hesitation in future in yanking their chain if they continue.........I can rattle an agent's confidence in a heartbeat and will have no hesitation in doing so.

I have been reciecung these calls as early as 6 in-the-I-can't-believe-anyone-is-calling-this-early AM. I am not nice in the morning( if is isn't an emergency) and was told that I needed an attitude adjustment and that I was rude to tell the guy off for calling so early. At the moment I am getting two to three calls a day and I usually don't make it to the phone before they hang up. What do they expect when a mom has sick children and they want mom to hold them. Hi everyone... Since I used to be a bill collector, I did some research on this company. Yes, it is a collection agency, but what they do is contract out their services to ALL DIFFERENT kinds of business's that need the 'expertice' of a professional collection agency. Receivablesperf might be calling 1 person on an MCI account and might be calling another person on a Wells Fargo account. It just depends.
Just so you know, if you answer, they have to ask for the person who's name is supposedly on their account, then they HAVE to identify themselves by giving you their name and the company their calling from and the company they represent. In order for them to verify they are speaking to the correct person, they CAN ask you to give the "LAST 4 ONLY" of your SS# (but ONLY AFTER they I.D. themselves). NEVER GIVE YOUR WHOLE SS# out anyone for any reason at anytime!!!
If you find that you do not owe the bill, tell them you want them to cease and desist. If you do know you owe this bill, tell them you will only work DIRECTLY with the original creditor.
At that time, get the original creditors number and make comtact with them directly. Trust me, in todays economy, the original creditor will be happy to work out a payment plan with you... (but BEFORE you send in ONE PAYMENT) GET THE TERMS OF THE AGREEMENT IN WRITING FIRST!!!!!).
