No friends or family has gotten any home security recently or in the past few years as that goes. There isn't a rise in crime where I live either. This is just a scam outfit wanting to secure themselves on what you have, not protecting what you have.

My phone only rang once because I bought a Call Blocker. When I checked the screen at my convenience, it gave the caller's number, identified it as "SECURITY", and then said "Blocked". (Grin)

The Do Not Call service is limited in its effectiveness. My Call Blocker, however, is quite effective. Wanted calls get through; unwanted calls do not. I don't sell the things, but I really love mine!!!

PS to John: I, too, have been waiting for the volume of commercials to drop to the point they match the TV show they pay for. Hasn't happened yet!

Starts as a robocall for a no-cost security system because of 2 lies: that there's been a vast increase in crime where I live and because a neighbor or friend recommended I be called. I hit "1" to talk further and got "Joe," who asked me how I was. I told him, "I'm annoyed, Joe." He replied, "Yeah, a lot of people seem to be these days. Have a good day." and hung up. The DNC list is more gov't BS that doesn't work, just like the recently passed legislation that says commercials can't be louder than the show you're watching.

I used to be a collector...when the phone rings simply answer it and see who they want,believe me if you're not the person they are looking for the calls will stop...I believe the sol for pa is now 6yrs,maybe 7 but that doesn't mean they still can't try to collect on the debt,it just means they can't legally sue you or put it on your credit report...if it is you they wqnt andyou don't want anymore calls then simply send a letter telling them to stop calling you,send it certified,return receipt........if you truly are being harassed by them call the pa attorney generals office,ask for consumer affairs and they will send you a simple form to fill out,then their legal dept will contact the collection agencies legal dept qand you should get it resolved...there are also tons of lawyers out there who do nothing but sue collections companies.hell you don't even have t prove wat you're saying and the gaencies will pay !!!

As already discussed in this thread back in October, the DNC Registry does not apply.

Deb, skip trace calls which you ignore are annoying but don't strictly abuse your rights. The collector gets one contact to "obtain location" of the alleged debtor. You have not yet had contact. Not recording a message is unhelpful, I grant you, but this may be an abundance of caution on Monarch's part to avoid triggering a lawsuit over privacy.

You might want to start logging all calls from MRM to establish an annoyance pattern, but frankly "two or three" daily is considered borderline. My advice as ever in these "not me" cases is to send a cease-comm notice via USPS Certified with card. The FTC and many consumer watchdogs explain how to draft one.

I think we get the picture, JW. The FDCPA gives special attention to workplace calls. When you or the boss tells them to scram, they must obey. No one should be shamed into uncontested compliance with a debt buyer.

Fun fact about MRM: When still known as Academy Collection Service, this agency in 2008 was spanked for $2.25 million by the FTC for chronic violation of debtors' rights. This remains the highest fine ever handed to a debt collector. Shortly thereafter ACS rebranded as Monarch Recovery Management.

Peaches, the FDCPA bars calls which incur cost, including to mobile phones. Use that contact data to tell the agency just how much it's in the wrong.

I second New View's motion. Complaints to the Bar association and the AG of the collector's home state are also good moves. Don't forget Federal and state laws exist to help in direct confrontation. Collectors caught making blatant violations often settle out of court.

Call logging is good practice for any collection activity, for finding a behavior pattern and monitoring for violations. If the collector changes numbers like socks or munges CID or spoofs a number local to you, those little phone games soon won't fool you. Raising a Fair Debt defense on these terms can be subjective. The mandates against calling "with intent to harass or annoy" and collector misrepresentation are not rigidly defined, perhaps deliberately so. However, as one guideline, if you run out of fingers from one hand counting a day's calls, you might be near the actionable threshold.

Why not just keep a record of the dates and time of each call? Then, when you feel you've
been sufficiently harassed, report them to the Chief of Police in the city in which Monarch
or Academy Service.org is located. I have found the police to be extremely helpful in getting this kind of thing stopped, provided you have sufficient evidence to prove that they are harassing you with fraudulent representation of themselves and their desire to obtain information from you regarding your financial matters. They will likely turn to another
phone number and keep trying the same thing. Just keep reporting them.

I'm keeping records of dates and times of each call and will definitely report them when I've had enough of their scam.

Oh, alright. I see that "PLEASE READ" from yesterday is a reply to "Please Read" from 2.5 years ago. Confusing entry formatting there.

One other point is misleading, the writer's pat definition of a credit report. It does not exist to show outstanding debts to a consumer. Were that the function, the bureaus would not have made it so bloody hard for consumers to see them for so long. A credit report is mainly a risk assessment tool for lenders. You need to see yours periodically to be certain the risk of lending to you is not understated or misrepresented.

Indeed, fraudulent and distorted entries appear all the time which try to force people to pay what was never owed. Challenging those bad entries is even harder than reading your report used to be, but it can be done. A freshly enacted FCRA amendment now forces the bureaus to do more than rubber-stamp their often laughable account "verifications". At least on paper they must. Good thing they can be sued like the collectors for negligence and fraud.

No, no, and also NO .... You do NOT get mixed up with "FreeCreditReport", "FreeCreditScore", or any other brand for Experian's CIC Triple Advantage. They have been busted over and over for misleading people into becoming paid subscribers and preventing service cancellation. Everyone is entitled to one free annual report with no strings, directly from the top three bureaus, thanks to the FTC. See AnnualCreditReport-dot-com or FTC-dot-gov for more.

"Please Read" and "Jen" were less than complete on the issue of debt account age. A credit report is a valuable tool in credit repair and when collectors come calling, but not the last word on what a collector may chase you for. Simple derogatory entries vanish seven years after the last date of activity, but you must learn the Statute of Limitations for all categories of debt in your state to be certain a collector is unable to win a judgment in court. In some states SoL is less than seven years; others generously extend beyond seven.

It is also vital not to make verbal agreements which may inspire a collector to reset the SoL clock, and to be sure no one has made false entries on your credit report. It is true a collector has to be careful not to violate privacy provisions of the FDCPA, but the same law also mandates a certain "meaningful disclosure" of the collector. Some agencies have learned to use that conflict to create confusion and fright, conditions which may persuade an alleged debtor to fold before exercising her rights. Don't be a chump for chiselers like T&K. Learn your rights at FTC-dot-gov.

This is a valid debt collection law firm. What they do is they buy past-due accounts and debts from other companies and they are working for them to collect the amount owed. In other words, if they call and say "I am calling regarding your Palisades account" and you have no idea what they are talking about, it's most likely because Palisades purchased a debt from another creditor, such as Capital One or a medical bill. They will not and do not have to give you any information...this falls under the FDCPA laws. They can only give out information if you can verify who you are. Otherwise they are possibly giving out someone elses information. If you believe that you have no outstanding debts, the best thing you can do is go to freecreditreport.com and pull up your credit report. This is a valid document showing whether or not you owe any company money.

To "Bobert" and the many similarly confused respondents on this site: For the umpteenth time, the DNC registry is for telemarketers, meaning sales. Charities, debt collectors, political speech, and surveyors are all exempt as they are not included in the FTC definition of "telemarketing". This was made known to you when you registered your numbers. The exemptions can arguably be sales by another name, but that's the rule as written.

More recent entries here raise several issues. In short, if you are receiving misdirected or abusive calls from a third party debt collector, you may find relief in the provisions of the FDCPA, which regulates bad collector behavior and provides a private right of action. Turns out they are looking for the previous owner of this house and skip tracers just cross referenced the address to a new number, mine. I told them to stop calling and was advised it would take 24-48 hrs for the calls to stop. Customer service was courteous and compliant. Want the calls to stop? Just call them back.

Did they say they were a police officer or a fireman or a veteran? Active or Retired?

Did they say they were a charity or a non profit labor organization?

Did they try to guilt you in to giving?

Did they imply or infer that they were actual officers making the calls?

Did they use intimidation tactics? (if you felt intimidated then yes they used them)

Did they say the phrase “you not in trouble or anything” implying that you should think you might be?

Did they thank you for your past donation?

Did they imply a local connection?

The techniques these organizations employ are by their very nature, deceptive and illegal.

Call displayed as "Pennsylvania" on caller ID. Google Diane Carpet Cleaning and you'll see this company has already been fined for making calls to people on the No Call list. Appear to be located in the midwest but I rec'd the call in PA. It directs you to a customer service department that can answer questions, help you donate, or anything else related to the foundation. Also, there’s information on www.ffcf.org, you can contact them there with any questions or requests.
This Foundation is doing a lot of really great things for Fire Fighters nationwide and the people that call are trying to help them raise money so they can do even more good. The foundation helps with funding for volunteer fire departments, toward first aid and fire prevention education as well as other outreach programs.

Advanta Bank Corp., the small business credit card lender that last year settled “unfair and deceptive practices” charges with regulators over rate hikes imposed on small business customers, was seized by Utah banking regulators Friday.

“We just found them to be in an unsafe and unsound condition,” Michael Jones, chief examiner for the Utah Department of Financial Institutions, told me. “They needed additional capital because they were taking significant writedowns and losses on their [small business] credit card portfolio.” Advanta spokeswoman Amy Holderer declined to comment but said parent company Advanta Corp. would issue a statement in an 8-K filing today or tomorrow.

What does this mean for small business borrowers? When Utah regulators seized Advanta bank, the FDIC was named receiver and could not find a buyer for Advanta’s operations. For borrowers who owed money to Advanta Bank, “right now the FDIC is the owner of those loans,” Jones says.

Some Advanta borrowers have already had their debts sold to third-party debt collectors. Advanta’s seizure shouldn’t affect them. It’s unclear whether it will affect those whose debt is now owned by the FDIC.

Advanta issued exclusively small business credit cards. In 2007 the bank was the fifth-largest issuer of small business bank credit cards (which excludes American Express and Discover), with 1.3 million accounts and $14 billion in annual payment volume, according to The Nilson Report, a credit card industry newsletter. Business owners often use credit cards for convenience to cover every day expenses. Many also use them as a source of longer-term financing in lieu of bank loans or credit lines.

Many Advanta borrowers, hit by rate hikes, have been trying to negotiate lower payments and interest rates, and at least one group was seeking class action status for a lawsuit against the bank. The FDIC received 976 complaints about Advanta raising interest rates in the 18 months leading up to Jan. 2009. (Peruse the comments on this post and others for small business owners’ stories about their dealings with Advanta.)

Advanta stopped making new credit card loans and cut off credit to existing customers in May 2009. By that time, the bank had become notorious for repricing interest rates, sometimes to over 30%, on cards opened with 0% APRs or other low teaser rates. In July, Advanta settled with the FDIC over rate hikes and agreed to pay $35 million in restitution, without admitting nor denying wrongdoing. Advanta Bank’s parent company, Spring House (Pa.)-based Advanta Corp., filed bankruptcy under Chapter 11 in November.

In filings with regulators, Advanta reported $205 million in loan charge-offs in 2009. In December, the bank reported $1.62 billion in assets and $1.52 billion in liabilities.

Advanta’s seizure is unlikely to have much effect on the availability of credit for small businesses. Advanta cut off all new lending, including to existing customers, last year. The most significant consequence may be whether those borrowers trying to renegotiate their payments and write down their debts will have an easier time doing so now that the FDIC is their creditor.

Here's a solution I use for my cell phone: I add the number to my address book labeled SPAM. Every telemarketer call I get I add to the various locations for SPAM; work, cell, home, etc. When I fill that one up I make a new one; SPAM1, SPAM2, etc. I never answer a call with an out of state area code but go here and check the number first.

I don't use my precious expensive minutes and they get to listen to my answering service. Simple.

FireFighters Charitable Foundation does not have a very good rating (ZERO stars out of 4) on CharityNavigator.org. If I'm reading this correctly it says they spend 83% of their income on fundraising. Only 11% goes to the programs they offer and another 5.7% goes to administrative expensives. That's terrible. Compare them to the American Red Cross (or your local zoo for that matter), when it comes to how the money taken in is being spent. What's the point of spending nearly all the money taken in on fundraising? Who is getting the benefit of the fundraising?

I think I'll just give my money to my LOCAL volunteer firefighters.

I never answer incoming numbers that I am not familiar with (Caller ID). If the caller want to leave a message they can. I listen to it then do a search on the number. You can obtain Call blocker software for a modest price. It's well worth it.

You press 8 to have your number removed, or press 1 if you want to be connected to someone to talk about getting their supposed "small business credit" I just listened to the entire thing to try to report them since it is 100% illegal for ANY telemarketer to call your cell phone number. And just FYI, your cell number does NOT have to be added to the DoNotCall list in order for this to happen. And also, despite any emails you may get, the FTC will NEVER be "ABOUT TO RELEASE ALL CELL PHONE NUMBERS TO TELEMARKETERS"...It's just some stupid email that goes around every few months. Always check SNOPES.COM or Google the email info first before you forward it yourself.

This company calls me once per week...but I never picked up until today. I figured it was a telemarketing firm. And not to my surprise it was. A presentation begins about securing funds for your business so I press 1. I'm then directed to a rather direct associate who asks me how much I need. I say less than $100,000 may be $50,000. Now the guy just starts asking me all types of questions, name, phone, tax iD then he says your bank and routing number. I stop and ask "is there some type of fee for this program?" He quickly responds "There's a $399 fee." I respond "Well I don't have any info about your and I don't have $399 in my account right now." he cut's me off stating "Well you just asked me for $50,000 and you don't have $399 in your account? Come on!!!!" in a very upset and angry tone. I immediately hung up realizing this was a scam. Little did he know I just opened a brand new account for business transactions earlier but have money in several other accounts to pay the measly $399 fee. power windows and siding should be fined! i have called their main office over and over for the past 2 years now telling them i am not interested and take me off their lists and each time they say they do and they don't! they have a new person knocking on everyones door every other day! i have signs saying do not solicit and made one especially for them saying "i have told you, pws, over a dozen times i am not interested!" (and same thing for verizon fios since they were once a week all summer) and they STILL knock on the door! i was glad last month when someone actually called the police on them. doing that is illegal and every other day is annoying... of course now that they can't knock on everyones door, they are calling!
