My brother died over a year ago and these idiots called today looking for him. Said he gave me as nearest relative. I know he died with a lot of bills, trying to survive cancer isn't cheap. I told these guys that he was dead. They wanted to know if I got any insurance money and they wanted a copy of the death certificate. I told thme to fu*k off and hung up and if they call again I'll report them under the fair debt collections act.

Portfolio recovery. Asked them to send me an invoice from the creditor and a signed contract between me and that creditor and all they send is their own little invoice. They like to talk over you while you are talking. If they are really representing a creditor it should be a simple thing to prove that I ever had an account with that creditor. They are able to do that yet but insist on calling after asking them to put everything in writing no more calls.

I read the Do Not Call registry info for Businesses* ... they Provide* this list to anyone that will pay for it! All they have to do is say they ARE a telemarketer, then they are "supposed to abide by the rules" and not call listed numbers..!!

The FBI in an story in this week's Wall Street Journal (featured at Yahoo!) tells about the 14 most dangerous spam/scam/phishing phone and e-mail contacts being made out there. If you get an e-mail from a cousin in Italy who needs 6000 euros to pay for a bone marrow transplant, and they need it sent to them right away, that's the kind of stuff that is going on out there. And if you get an e-mail presumably from an American G.I. overseas, be careful!

Ever since I changed my phone number to a local area code (where I live), 1-800-772-1413 and numerous other numbers reported to be Portfolio Recovery Associates have been calling. Mostly from the 800-772-1413 number. I know the person who had my number before me has collection calls, which I have let those people know that this is not that persons number anymore and they did quit calling. But this Portfolio never, ever leaves a message so I don't know who they are trying to reach.
I believe they are using the tactic used by lots of crooked companies. I think they have software that makes it appear that they are calling from a number belonging to someone else.

Buster, you're wrong on one point. PRA appears on my court calendar as a plaintiff throughout the year. I'm sure the numbers involved in junk debt discourage filing suit on an entire portfolio, but some people are chosen for special punishment. To rebut a second point, communication by USPS is unlikely to give away an address the agency does not already possess or cannot find. I've seen numerous instances of collectors automatically dunning a street address when only a person's PO box was used for billing.

Having personal and poor experience with your former employer, I won't argue with your skill for selective aggravation. Poking at the beehive is not a strategy for everyone, and I personally like my revenge wrapped in thousand dollar bills. The collectors' own calls can be turned against them as pointy weapons, which is half my point in promoting education in relevant state and federal laws.

The simple fact is that you don't have to say a thing on the phone. Nothing works better than just answering the phone and remaining silent...but, I know how to piss them off, so I use more degenerate methods. The law isn't going to do dick for you...and, writing them letters is a great way to give them your current residence. Just blow them off. Tell them you are "judgment proof." They are there for one reason...to get your money. Let them know that it comes at a cost. Insult anything about them that might set them off...gender, orientation, race, religion, nationality, family...get real down and dirty. There isn't a thing they can do about it...other than hang up. I love screwing with these people.

Hey everyone, with the help of my local police department in Tuscon, AZ, I've proceeded to trace the harassing phone calls down to a business in Belmont, Massachusetts. I've discovered information about the owner of the establishment via google and I'm in the process in filing a law suit against this guy. From my research I've discovered, his name is Chris Perron and it appears he's pissed off a lot of other people and business owners (according to negative feedback on his Merchant Circle account as well as other places). You guys can even see it for yourself, just type the guy's name (Chris Perron) and the business (Datboys Data Recovery) into a google search engine, you can see that guy has got some serious problems and definitely needs psychiatric help. So long story shot, if you have also been receiving death threats and harassment from this guy like I have then please contact me via email so I can link you with some references to put this creep to a stop and end the harassment. By the way everyone, Satan destroys his own!

A little history on Portfolio Recovery Associates:

In recent years they'd submitted many thousands of affidavits signed by one Martha Kunkle, assuring judges PRA had standing to sue and garnish the assets of as many citizens, swearing to present ''a true and correct accounting'' of their account balances. The only tiny nagging problem was Ms. Kunkle had DIED in 1995!

In 2009 PRA gave up fighting a Federal suit filed in Montana over these falsified documents. The ''robo-perjury'' was penned by employees of lender Providian, led by Kunkle's own surviving daughter. Portfolio Recovery, the buyer of the large bundle of Providian accounts they were suing for, tried claiming clean hands. In 2008 testimony in another case revealed that PRA's own legal reps ''sign as many as 200 affidavits a day''.

PRA began posting a huge profit increase last year, becoming a darling among investment journalists, and last summer hired a fresh gang of lawyers for its stable of lawbreakers. By the dozen they have won stealth judgments, meaning assets frozen before the alleged debtor knows what happened, and often against the poor and working class.

Following a damning Wall Street Joural article (''Dead Soul Is a Debt Collector'') about the Kunkle mess on the last day of 2010, PRA slapped up a softsoaping ''resolution center'' website In January 2011 and promptly spammed a bunch of consumer forums to promote it. PRA had just finished merging and rebranding its municipal debt collection subsidiaries and evidently was desperate to play spin doctor in any forum bearing complaints, possibly anticipating a fresh wave of hatred from people being hassled over parking tickets. The not-very-resolving website is of course misleading and faulty in many ways, designed in part to make people forget their rights. Another reason to stay on a paper trail.

Do not roll over for PRA or any collector, but don't ignore one either. The FDCPA grants each of us the private right of action, but it's powerless if we don't use it. Learn your rights at FTC-dot-gov.

This long thread carries a great deal of misinformation, as well as reckless contradictory advice as from Mr. ''Scam Alert'' in December 2010. (My reply is under 7579613544) whocalled.us

Here are a few debunkings:

- War dialing and call blocking is hardly an answer. PRA has invested in a huge volume of phone numbers to call from, and could resort to spoofing besides. This gets you into an arms race you will lose.

- Blasting whistles or air horns, prank return calls, and other obnoxious behavior are not valid countermeasures. They may in fact draw special attention to your case and accelerate the path to a lawsuit. *They* must be seen as desperate, *you* must be calm.

- PRA is not worried about its phone bill when it can clear thousands an hour on moldy junk debt. Find your civil court calendar and you'll see they have no problem paying legal fees to collect, either.

- The seven year FCRA time limit for reporting of accounts to the credit bureaus has NO bearing on the ability to collect debt. Each state has its own Statute of Limitations for different debt categories, the true legal ''shot clock''. The favorite game of all junk debt chasers is trying to get you to admit liability and/or send a payment to reset SoL. This is partly why early dispute of all debt claims of whatever age is critical.

- Collectors are frequently shy around phone message recorders to avoid lawsuits over privacy violations. It's not that they consider their calls unimportant, they prefer live calls, during which you'll likely perform the Identity Dance. They won't (or shouldn't) say much until the correct person answers.

- The DNC registry is for telemarketers, meaning sales, meaning all debt collectors are exempt. This fact was not kept secret from you when you registered your numbers. Attorneys general and the FTC are valid complaint venues which help the publc good but are not likely to grant personal justice. Understand that you must confront collection agencies directly if you dislike their treatment of your privacy and consumer rights.

Now for some friendly advice:

You don't have to sit still for lies and abuse from PRA or any other collection agency. There are state and federal laws to help you. You first want to get friendly with the federal FDCPA. It grants you control of how you are contacted, the right to dispute debt claims, and the means to sue at low cost.


Any of you who might be held liable for some debt should dispute the claim and request validation. Do so on paper, sent USPS Certified with return card to best preserve your rights. This automatically enacts a temporary gag order. You can't legally be bothered until your request is satisfied. In the same letter you can revoke some or all phone call permission, an order which survives until you say otherwise.

A likely reaction from a junk debt buyer like PRA, since the alleged debtor is making the agency do actual work for a jackpot, is to quietly sell the account. It may over time return like a bad penny from multiple agencies, but sending a prompt dispute each time can prevent a world of headaches. A collector may still decide to sue if the alleged debtor is thought to have adequate assets and/or a weak case. But junk debt suits are known to be the simplest to beat since the chain of title tends to dissolve as the accounts are traded. In fact, they are usually sold with a miserably paltry amount of data; they have more bluster than facts.

Irritated: The FCC can't do much for you. If you want complaint desks, the FTC and attorneys general are among the best choices. This will help ding PRA's reputation but is not likely to solve your own problem. You're even less likely to verbally convince PRA that it has the wrong party.

Since you're not the target of the skip trace, send PRA a cease-comm notice via USPS Certified with return card. The FTC and many consumer watchdogs explain how to draft one. Also mention that a mobile phone is being jingled. This sets the legal trap in two ways if PRA is dumb enough to try calling again.

011-800-772-1413 (Foreign Coded technology to bypass your Caller ID Block) Okay. Here's some info. on Portfolio Recovery. They are persistent and have oodles of phone numbers. Some numbers have US area codes. Some calls actually ID them as Portfolio Recovery. A lot of calls do not have any ID except the area code and a phone number. This 800-772-1413 has been getting through call-blocking efforts. AT&T explained that the actual number being used by these scum is 011-800-772-1413. The 011 is out of the US and is a roundabout way of coming through as a US caller. BECAUSE PORTFOLIO USES 13 NUMBERS INSTEAD OF 10 NUMBERS IT CANNOT BE BLOCKED BY AT&T. I don't know if any phone provider can successfully block it or any other numbers they use with a foreign prefixing code. AT&T had to look it up for me because only the 800-772-1413 showed in my Caller ID window. The only defense is to let it ring and not call-back. Truthfully, every phone number not known personally should be Googled before answering and never returned to the caller. Portfolio does not care if you are the one they're looking for. They'll keep calling. God help you if you are a relative or have the same surname! Remember, they have lots of people in lots of areas with lots of phone numbers at their disposal. If you have satisfied the debt, it still makes no difference. They will get you to give information and go after the excused portion. Any information or acknowledgment from you is noted and they step-up their efforts. (Save every piece of paper you have on satisfied debts. It will give you some peace, because they WILL KEEP CALLING.) If everyone wises up and refuses to answer any unknown caller, perhaps some of the collectors, scammers and sales boiler-rooms will cease to exist. Technology has given us the power to refuse intrusion. Use it. (BTW there are multiple collectors, scammers and boiler-room operations using Foreign Prefixing to avoid discovery. It seems to be rampant. I Google everything. Everyone is a potential target.) Check out all the "Caller Information" sites like this one. The stories will make you strong.

I had been receiving several calls from 716-462-4329 over about a month period. Not knowing the number and being at work I did not answer. Unfortunate for me, I did answer once, BIG MISTAKE! The gentlemen (I use the word loosely) on the line asked for a person other than myself at which time I told him I was not that person nor did I know them. Relentless is an understatement and rude, he continued to harrass me as to whether I knew that person and if not why would they have my number for them (??? really?) I finally did get very frustrated and told him that under no such circumstances to ever call my number again and hung up. After calming, I called the number myself to find out who they were and to inform them of the rudeness of one of their employees and to make sure my number was off their list. Apparently, these people call anyone listed in the phone book with the first initial that matches the person they are calling. Called this morning very early before the allowed time for calls. Wanted someone I do not know. I think they pass around your numbers to other debt collectors because I get several calls from different debt collectors looking for the same people. Having problems with irritating callers on your cellphone? Try checking out your phone's Settings.

There may be a Setting for Restricting Calls. If so, you may be able to set your Outcoming to All, so that you can call whoever, and restrict your Incoming to Contacts only, so that you're only receiving calls from people who you want to speak to. Just a thought.

Oh, and by the way, if you do restrict Incoming to Contacts only, you won't know when non-Contacts are calling. They'll think that they're irritating the hell out of you, even though they're really not, and, if you want to, you can always still pick up messages from them when you check your voicemail.

I have had numerous calls from these scammers...yep, they buy old/un-collectable debts........months go by, then all of a sudden they start up again because of their "portofolio" cycle. They can get away with it by using different phone numbers. I actually dealt with them(a real person) and asked for them to send me something in the mail that proves I owe this debt. We have been receiving calls from ARM and an associated company in Panama City, Panama for about two years. They are attempting to reach someone named XXX and no one here has that name. These calls started when we moved into a new area and got a new phone number. We continuously tell them there is no one here by that name, to stop calling, and to remove our phone number from their call list. No joy. We have recorded their calls, logged the times and dates, contacted the local police, the state attorney general, the phone provider, etc. Still no luck. Finally, we got names and numbers of senior executives at ARM, and have contacted them. We will probably attempt a certified letter to stop, again I expect no luck. HOWEVER, we do have the home addresses of the senior executives and they are not that far from us. The US legal system is ineffective and is forcing us into additional aggressive action.

This company is also calling from 7163321897. They called me this morning threatening to deduct monies from my wages. They told me that it was over $2000 for a credit card. I never remember having a credit card that even had a credit limit that high. I wsa a victim of ID fraud, my mother took cards out in my name. This is probably the remnants of one of those. He refused to pay and told them he would send a letter to them. It's odd we never received notice from Verizon about a bill. We canceled our Verizon account two or three years ago. This scammer has called twice today, once on each phone line. It appears that they are running some kind of debt collection scam. (I know that it is some kind of scam because I have no debts.) The first caller gave the name of the company but refused to give her name or the address of the company. They then called again 3 minutes later. The second caller gave the name and P.O. box address of the company but refused to give her name or title or the physical address of the company. She then connected me (after a long delay) to someone claiming to be "Justin Miller", "Vice President of Operations" for "Portfolio Recovery Associates". (This is apparently a lie since the company website lists someone else as the Vice president of Operations. But they are already lying to you even before you pick up the phone, because they are purposely hiding their caller ID information. I have the cheapest service available, and my Caller ID info always shows up when I call someone.) Since he is apparently lying about his title, he may very well be lying about what company he works for as well. He identified the second caller as "Brittany". He claimed that they had no idea what numbers they were calling because they place two million calls each day, but after about 10 minutes of arguing with him, he magically came up both of my phone numbers and promised to "take them off his list". (I never requested to be on his "list" in the first place. This is like asking an email spammer to take you off his list. It doesn't make any more sense for telephone spammers.) He doesn't understand the concept of the FTC Do Not Call list (http://donotcall.gov), and doesn't know anything about the Fair Debt Collection Practices Act, which prohibits harassing calls to people whom they are not trying to collect a debt from. He eventually claimed that Lexis-Nexis informed him that I was "associated" with the person that they were looking for. He refused to say what that "association" was, just that it could be friend, relative, or co-worker. After filing Do Not Call list complaints and a Fair Debt Collection Practices Act complaint with the Federal Trade Commission (http://www.ftc.gov), I checked that there is such a company registered with the Maryland Commissioner of Financial Regulation with a valid Maryland Debt Collector's license. It is license number 4363 and doesn't expire until next February 27. If they call again I will file an Investigation Request with the state (http://www.dllr.state.md.us/finance/consumers/comphow.shtml). The State of Maryland lists them as Portfolio Recovery Associates LLC, 120 Corporate Boulevard, Suite 100, Norfolk, VA 23502. Their web site is www.portfoliorecovery.com I also sent a certified letter to Lexis-Nexis ordering them to remove any information about me, since they are obviously giving out false information. I realize that debt collectors are desperate these days, but this one apparently is willing to have a debt-collection scammer for a client, and is stupid enough not to bother with even five seconds for a simple web search which would have at the very least made them very suspicious that they have a wrong number. The scammer refers the fake debt to a debt collector, then sits back and waits. He is not even bothered about only recovering 30% or 50% or whatever, since for him it is pure profit. This "Justin Miller" seems to think that there is no problem with working with scammers or with calling two million wrong numbers each day. If I were looking for a debt collector, I would go to a professional, and not waste my time with these people. They're never going to recover any money for you by calling random telephone numbers, or by obtaining wrong numbers from unreliable sources of information and not bothering to verify them.

Today someone finally left a message ... for a previous tenant, and I mean previous by 10 years! I now make it a practice to let all calls go to the answering machine from unfamiliar callers. These people are relentless low lifes. They call as much as 6 times a day, weekends included anywhere from 8AM to 9:30PM and never leave a message. Maybe someday they will take the hint. They apparently have the ability to trace from cell phones, since they were initially calling my WORK (company-issued) cell phone & are now calling my Home Phone number. The ONLY way these same people could have gotten my home phone number was by looking me up based on my NEW work cell phone (with which I promptly recieved several calls a day from them starting from the day it was issued to me). The more complaints the better, that will cause the FTC to investigate and possibly charge/fine this company. This company is back-tracking to home phone numbers using previously used cell or phony phone numbers. They are basically calling to harrass based purely on a guess.

There was a thing om Opray, that said these theives can legally change that date, everytime they contact you, thus prolonging that 7 years to 20 years or more. They said the best thing to do, is do NOT answer the phone, and have zero contact with them, so that 7 year status remains, just 7 years. If you write them a letter to cease calling, they can legally change that date, and keep contacting you.

Portfolio Recovery....you cannot get rid of them. You must learn to deal with them. I have a separate contact name in my phone. Each time I receive a call from them, and I determine by checking the net to see if it is them, I add the new number to this contact in my phone. I have set this contact up to use a specific ring tone of "Silent", so I do not have to receive their calls. It is a rare occurrence when they ever leave a message. The debts they are trying to collect on are from 1993, well beyond the 7 years. Just pulled a credit report and they are not reporting on my credit report. So, the only issue I have with them is the contact phone calls. Having them on a silent ring seems to have resolved that issue.

Debt consolidation co can be just as bad if not worse than the dirty collectors...hello you are paying someone else to avoid collection calls...you can do that for free...not to mention most debt consolidation co charge you a fee each month and then get a percentage of whatever theyh "save" you...again you can negotiate this on your own, for free
3. if you have debt stay in contact with the creditor and try to pay something whenever you can...then your account is less likely to end up in a collection company
4. medical bills...go to that provider and ask for charity...lots of drs have $ allotted for those in need
5. there are good collectors everywhere and bad collectors everywhere...just like in life regardless of career when you scream and yell and curse at someone it tends to bring out the worst in them and you

I have had bill collectors calling me about a roommate who hasn't lived at my number for more than 2 years. I don't know if that is why these people are calling; in the part of the message where they are supposed to identify who they are calling for, nothing is said, so it's really ridiculous. But I have something to say to those people that "proudly" work for this company...

Those of you employees that are commenting here yelling at us that if we paid our bills you wouldn't be calling, you should read these comments a little more carefully. Most of the complaints here are NOT from those that don't pay their bills, but from people you are calling that don’t have any idea who you are looking for, or don't owe the bill at all. Others are saying that they have tried to follow protocol to satisfy the debt, but that you are using illegal practices against them and not allowing them to at least verify the debt is theirs. Perhaps if you followed the FDCPA, you would be able to collect more efficiently.

It would seem from reading a majority of the complaints by others here that Bay Area Credit is using unethical practices to collect the debts. Debts I would imagine are un-collectable at this point, just junk debts that they have bought for pennies on the dollar. This is a common practice for debt that is too old to collect on. The original creditor/collector can’t because the statute of limitations is up. They sell them to unethical collectors. Once you acknowledge that a debt is yours, and/or start paying on it, it starts the statute of limitations over again and treats it like it is a new debt. Every state has a SOL. If you think they are collecting for something that is several years old, check your state’s SOL. Most are 5-7 years. After that, it should be off your credit report and can’t be collected on, no matter what you are told by the collector (this does not include government debts or child support). And collectors can NEVER EVER EVER threaten you with anything regarding the debt. This includes jail. They can't even threaten a lawsuit unless they intend on going through with it. And they CANNOT suggest that they work for a law office in any way unless they actually do. But don't let a law office scare you. That is just another collection tactic. Law offices are bound by the same laws that everyone else is. And if you think about it, they have to come to your state to sue you. Think how much it would cost for them to send someone to your state to go to court. In most cases, it's not even worth it.

Collectors like BAC are working a numbers game. For every hundred people they harass, maybe 10% get scared and it works. Do this enough, and they make more than what they spend buying this junk debt.

Folks, please read your right concerning these people. Each offense is worth up to $1000 according to the FTC. Make them pay. It will put them out of business and stop creditors from using practices deemed unfit by the government.

And furthermore, Bay Area Credit, some states do not allow the collection of debts from out of state companies. In order to collect a debt in that state, you MUST have a license to do so. I live in such a state and will be checking with the Secretary of State to see if you are so licensed. I suggest you all check your state’s statutes to see if your state is one.

I’m sorry this is so long, but I get tired of abusive collectors getting on these boards and abusing us even more. Especially abusing those of us that have no debts, those of us that have deceased family they are trying to collect from, or calling wrong numbers and harassing people that shouldn’t even be called.

I've posted the critical FDCPA stuff below for all your viewing pleasure...

"The Act prohibits certain types of "abusive and deceptive" conduct when attempting to collect debts, including the following:

Hours for phone contact: contacting consumers by telephone outside of the hours of 8:00 a.m. to 9:00 p.m. local time[2]

Failure to cease communication upon request: communicating with consumers in any way (other than litigation) after receiving written notice that said consumer wishes no further communication or refuses to pay the alleged debt, with certain exceptions, including advising that collection efforts are being terminated or that the collector intends to file a lawsuit or pursue other remedies where permitted[3]

Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously: with intent to annoy, abuse, or harass any person at the called number.[4]

Communicating with consumer after request for validation: communicating with the consumer or the pursuing collection efforts by the debt collector after receipt of a consumer's written request for verification of a debt (or for the name and address of the original creditor on a debt) and before the debt collector mails the consumer the requested verification or original creditor's name and address[7]

Misrepresentation or deceit: misrepresenting the debt or using deception to collect the debt, including a debt collector's misrepresentation that he or she is an attorney or law enforcement officer[8]

Publishing the consumer's name or address on a "bad debt" list[9]

Seeking unjustified amounts, which would include demanding any amounts not permitted under an applicable contract or as provided under applicable law[10]

Threatening arrest or legal action that is either not permitted or not actually contemplated[11]

Abusive or profane language used in the course of communication related to the debt[12]

Communication with third parties: revealing or discussing the nature of debts with third parties (other than the consumer's spouse or attorney) or threatening such action[13]

Contact by embarrassing media, such as communicating with a consumer regarding a debt by post card, or using any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business [14][15]

Reporting false information on a consumer's credit report or threatening to do so in the process of collection[16]

Further, the FDCPA requires debt collectors to:

Identify themselves and notify the consumer, in every communication, that the communication is from a debt collector, and in the initial communication that any information obtained will be used to effect collection of the debt[17]

Give the name and address of the original creditor (company to which the debt was originally payable) upon the consumer's written request made within 30 days of receipt of the §1692g notice;[18]

Notify the consumer of their right to dispute the debt, in part or in full, with the debt collector. This so-called 30-day "§1692g" notice is required to be sent by debt collectors within five days of the initial communication with the consumer, though in 2006 the definition of "initial communication" was amended to exclude "a formal pleading in a civil action" for purposes of triggering the §1692g notice, [19] complicating the matter where the debt collector is an attorney or law firm. The consumer's receipt of this notice starts the clock running on the 30-day right to demand verification of the debt from the debt collector. [20]

Provide verification of the debt[21] If a consumer sends a written dispute or request for verification within 30 days of receiving the §1692g notice, then the debt collector must either mail the consumer the requested verification information or cease collection efforts altogether. Such asserted disputes must also be reported by the creditor to any credit bureau that reports the debt. Consumers may still dispute a debt verbally or after the thirty-day period has elapsed, but doing so waives the right to compel the debt collector to produce verification of the debt. Verification should include at a minimum the amount owed and the name and address of the original creditor. [22]

File a lawsuit in a proper venue - a debt collector may file a lawsuit, if at all, only in a place where the consumer lives or signed the contract[23]

This should not be understood to be an exhaustive list either of prohibited or required conduct.”

Finally, today, I took an extension number from this website and talked with a woman named Jaycee. She asked for my mailing address and the last four of my husband's social. When I told her my husband's full name - she said "Oh, we've got the wrong XXXX." I asked what this was about. She said she couldn't tell me - it was a private matter. I said their business had been calling my house for over a month leaving these nasty messages for anyone at my house to hear and I deserved to know why they continually called my home. She said "That was the number that came in" I asked from where - and she said she couldn't tell me that - it was private." I told her she involved me when she started calling my home. She said that the didn't like the way that I was talking to her - and I told her I didn't like the way the continually harassed and left these messages on my answering machine making it sound like my husband wasn't paying his debts. She said she would remove our number, but I'm not sure that's going to happen... If you dial any any four numbers for an extension - you can probably talk to a person.
