This number calls us 7-8 times a day. We picked it up finally at 815pm tonight and it was a very rude guy that was looking for my husband regarding his student loan. I'm authorized to speak on his behalf on the account, and always have been. I've always been the one that calls on his loan and takes care of his acct, and this man absolutely refused to speak to me! He interrupted me, cut me off and told me to get off the phone. I tracked down my husband and he proceeded to speak over my husband, telling him he's in default (which he isn't) and when my husband tried to stop him and tell him this, he yelled and hung up un us. Very rude, unprofessional, not accurate, and harassing!

www.qualityresources.com and entered it. The website shows a big blue square that you must click on to enter the site. Once into the site, I clicked onto the square that had the word contact on it. This brought up a screen with their contact info and had a link to remove your phone number from their call list. I just did this, so I don't know if I have been removed yet, but I feel better just doing it. (sorry about the message repeat)

I am not 100% sure, but this sounds like some kind of identity theft. I did co-sign a loan with AES but they cold called me out of the blue. The person caller mumbled quite a bit and I had a hard time understanding him. I asked him twice exactly why he was calling without a reasonable explanation. He continued to ask for personal information (date of birth, SS # was probably next). After I asked him a 3rd time he hung up.

Congress passed the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. §227, to curtail the use of automated dialers and prerecorded messages to cell phones without the permission of the consumer. Notwithstanding the passage of the TCPA, many businesses have harassed consumers by placing literally dozens and sometimes hundreds of telephone calls to cell phones.
On May 11, 2012, the United States Court of Appeals for the 7th Circuit issued an opinion in the case of Teresa Soppet v. Enhanced Recovery Company, LLC. In the litigation, the Plaintiffs sued a debt collector attempting to collect a telephone bill from a third party. Plaintiffs sued Defendant for Five Hundred Dollars ($500.00) per telephone call and One Thousand Five Hundred Dollars ($1,500.00) per telephone call if willful.
In response to the lawsuit, Enhanced Recovery Company asserted that it was not liable under the TCPA because it had consent from the party the debt collector intended to call — the actual customer of AT&T. In rejecting the argument of Enhanced Recovery Company, the 7th Circuit recognized that Plaintiffs are entitled to protection under the TCPA as they were the “called party” under the meaning of the TCPA.

TRS, if you had followed the link I provided only fifty minutes prior to your comment, you would not need to rely on belief in what's legal collector behavior. Define ''after hours'' .... Their call window ends at 21:00 in your time zone every night of the year, absent written instructions to the contrary. Not leaving a message? That's likely from the abundance of caution shared by many collection firms, which tend to violate privacy, therefore attract lawsuits, by leaving messages of any detail or lack thereof.

Spare me .... as if ''Kelly'' (aliased, I'm sure) herself would type the dunning letter and lick the envelope. If your name is on its debt account, ERS in fact is required by federal law to promptly send you mail now that you've been called.

The ''important business'' phrase is a common code for debt collection, used to prevent privacy breaches, a soft spot for consumer lawsuits. The prompting for personal identifiers is done for the same reason.

If ERS thinks you owe something, be sure to respond on real paper to that dunning with a dispute and validation request, adding your request to restrict or revoke consent to call again. If the account is not legally collectable, or it's simply not you they want, you're free to send a full cease-comm, cutting off all contact. Send all notices via USPS Certified with return card. The FTC and many consumer watchdogs explain how to draft them.

I began getting these phone calls Sept. 6th. I had contacted a bankruptcy attorney about a week before; I think it may be related, because I have had this number for years. I don't answer because I don't know anyone in that area code, but I was curious and called back receiving the same, "We are currently closed. Please, call back during business hours." as others have reported here. They never leave a message.

The combination of times called, never leaving a message, and no answer when I called back, prompted me to do the search leading to this site. It is informative, and helps me know what to expect when they call again; I am certain they will.

I would argue that doing ANYthing on Facebook is a mistake. The whole point of that site is to set up honeypots to encourage you to be loose and free with all your private data, so that Schmuckerberg can monetize it and you will be forever plagued with sales vultures.

As to online dating, I think the few sites which follow a sponsorship model (free to users) are by design more honest than the paid subscriber sites with their misleading national TV ad campaigns, narrowly populated mostly by newlywed "winners". Free sites lack both the "closing bell panic" of paid ones as their billing cycles end, and also the incentive to essentially sabotage your efforts through poor or unhelpful site coding. The paid ones will always blame you for having to stay active for months and years, not the way they wreck your content or make it hard to access or find ways to dull your profile "shine". Free sites tend to try harder to help the members, and at least one has a whole discussion forum devoted to profile critiques.

For that reason, even if you are on the do not call list, we are still authorized to make a call to you (or the references you leave) to make contact with you to help prevent this debt from going onto your credit report or going into default. Like every other "bill collector", there are some good some bad. If you get a call from a rude rep, call their supervisors and let them know and it will be handled appropriately.

What we try to due is help people as well as collect. If you can not make a payment, we explore other options. We wouldn't call so much if the phone was answered. Usually, if you do not have a loan with us and we call you, you were either a co-signer or an alternate contact for someone who has a loan out. We are legitamate. Most loan programs offer options to help if you can not make a payment. If AES is such an innocently bystanding ''loan servicer'', why are there so many recent complaints of behavior like that of a hostile junk debt collector? I'm seeing wrongful interest and fee gouging, rude treatment from the reps, and general jerking around of the alleged debtors. Anyone living in a state with decent collections or deceptive practice laws should rethink their responses to these goons.

Annoying I've asked Virgin Mobile to stop giving out my number to commercial organizations several times. I had to pay for the call and was put on hold for over 20 minutes. When I finally did get the operator to explain that they don't have the right to give out my number they just denied that they ever did. I might have believed them if the calls didn't start coming 2 minutes after I activated the phone the first time. Ffs I didn't even have a chance to give out my number by that time. So I've called them over 5 times about this same matter and nothing has been done about it. I'm also registered with the no call registry but they still call. Virgin Mobile care nothing about anything but what shakes their money maker. Anyone want a phone real cheap? I'd give it away

Well, FDCPA promoter, I've only been hitting all of your points in this thread since mid-October 2010. Several others before me had also referenced this federal law and corrected people on the misapplication of the DNC registry. Apparently it does no good. This thread will turn five years old as August begins, and we are answering the same easy questions over and over, which happens with a lot of collector threads on these boards.

Some -- not all -- come barreling in these sites with very common and valid complaints, and leave with nothing. You can tell that not a stitch of anything posted prior has been reviewed. They will return on other threads and make the same complaints again, never learning how to mount a proper defense against these debt industry bullies. They never wanted answers, only to kvetch and run. Apathy is so much easier, and really the sound advice to be found seems like too much work. For these people, at best, their peace and privacy will be forfeit. At worst they will be hauled into court to grimly submit to the costly demands of some robo-perjurer paper mill that broke eight or nine laws before suing to collect. For the do-nothings I've run out of sympathy.

For anyone still reading who wants a fighting chance, I'll adjust a few statements from the previous entry. The $1K statutory award is not easy to multiply. It's given per action, not violation. A rogue collector like ERS can call you names, make vulgar threats, and ring your phone 58 times a week, but (unfairly) you don't get to count a grand for each event. Possibly you can get other damages for distress, illness, and other reasons, but they need harder proof. The big payday awards which hit the news media nearly always come from extreme cases, like abuse heaped upon a disabled person or someone living on dog food.

I would agree that "done right" a victim could more modestly exceed the $1K award in settlement with a good Intent To Sue letter and copy of the legal complaint you would be ready to file. Note that I am not saying a lawyer is involved. It's your choice to fight alone or by proxy, but often the available "consumer" lawyers are out for a payday like your opposition. You may have violations but no professionals able or willing to fight for you. Fortunately the same internet which led you here can also lead you to sources of pro se warrior wisdom.

Making dud calls without disclosure of identity or reason is not an automatic violation. In January I'd already discussed why this can happen. Harassment in a legal sense may not be your sense or mine. You'll need to establish a pattern showing frequency, times, and any content of calls. This means keeping good records. Maybe they won't equal a violation, but they will help define what you're up against.

Attorneys general and the FTC are valid complaint venues which help the public good and may get the bad actors eventually fined and shut down. But understand that you must confront collection agencies directly if your goal is to halt or punish their mistreatment of your privacy and consumer rights. Regulators can help your case but they can't do everything for every person. It's your assets and your sanity at risk, and your job to guard them.

Maybe all you need are a few dollars for a single USPS Certified mailing, or maybe you'll need days of research to disentangle your mess. Either way a vigilant and defensive stance is never a waste. The bad collectors don't expect you to fight well, and most people don't, which is why their sloppy way of doing business is so effective. Your ignorance is their strength. Your lack of hope is their courage. Your resistance could change that.

For EVERYONE here. Take the time to review the Fair Debt Collection Practices Act. You will find that there are a number of violations of the act being perpitrated by this collection agency. One includes the calling of cellular phones costing the phone owner time on their phone which costs money. They are NOT to do this. Another is the making of Useless or Worthless calls. IE: Calling and not giving a proper reason for the call. This includes hanging up on answering machines and on the person who answers the phone. This can also be added to the harrassing calls violation. Done right each call can glean a nice $1.000.00 fine. Some calls can be labled under both the useless and harrassing because of Caller ID and failing to id themselves which can be a tidy $2,000.00 fine. Now for the REALLY good part.. There is enough here on this site to show that this debt collector is not only practicing these habits regularly but DELIBERATELY which a judge can add certain damages and penalties to. It has been alleged that some people who have taken steps to document such activities and to pursue action received as much as $16,000.00 in penalty awards against such blatant violators of their rights and they actually had the debts that the collector was trying to collect. Just think of what the victims of such practices can glean from a debt collector when they don't even owe the debt and are not the person the debt collector is trying to collect from but are still being treated as such??? All you have to do is STAND UP AND TAKE ACTION! File your complaints with your state attorney general's consumer protection divisions! Make them work for you! That is the only way to start getting these preditors under control! Oh.. And the Do Not Call Registry has NO legal binding on debt collectors. That is only against solicitors for services or products and even then it can only work against those who you can prove have violated your rights under the provisions of the DNCR. And the same goes there. If you want it to stop.. FILE YOUR COMPLAINTS! Don't just cry about it! List your experiences on the Who Called Us site so everone else who has been victimized by predatory callers of ALL types can know they are NOT alone! Then refer the legal eagles back to the site so they can see how many people are being victimized by such callers. THE LOUDER THE NOISE THE FASTER THE ACTION FOLKS!!!! Nuff Said???

I ordered by phone a Plaque removing spray for dogs from a company in Dallas called Exceptional Products, Inc.. I while waiting to receive the order by mail, I received 3 phone calls from QRI in CLearwater FL supposedly to verify my order, each time trying to sell me some 29.95 per month subscription after telling me I would receive $100 in gas voutures as thanks for my order. I declined each time. After receiving the order I called Exceptional Products to let them know that I will not be doing future business with a company that treats their customers in this manor. Mar, your comment needs rebuttal on two points. First, debt collectors are not selling anything, therefore are exempt from the DNC registry. There are a few cases where TCPA trips them up, but don't look there first for a payday.

Studying the laws is always good advice but sending people to Kevin Trudeau is not! That modern snake-oiler is the first and only person in history to be banned for life from selling any product on television. Stupidly, the ruling allowed book sales as a loophole, and faster than you can say "Natural Mega Memory Cures", the clown was back on the air hawking dubious advice books. I would wager there is not one "hidden wisdom" line in "Debt Cures" not already available freely through countless consumer defender sources.

Speaking of valid sources, if you are receiving repeated, misdirected, and/or abusive calls from a third party debt collector, you may find relief in the provisions of the FDCPA, the Federal law which regulates collector behavior. Learn your rights at FTC-dot-gov. See also your state laws for additional support.

Possibly if your mobile phone account is that obscure and in a special category, ERC already knew it was a mobile device prior to calling. That's key, since the FDCPA bans collection calls to those gadgets or in any manner which creates cost to the alleged debtor. Tell them straight out in writing your mobile phone is off limits. Document all calls for a potential suit.

Frank, I would concur that if need be you should always lowball a junk debt buyer, which typically purchases account bundles at 03 to 15% of the face value. But the first response is never "How do I pay", but "Prove I owe" ... something these agencies are rather slack about. If you'd rather pay 20% instead of zero percent, do it your way. Otherwise, use the laws to your advantage.

I had 4 min to call this local no.apparently. I live in Syd.Australia so my phone call got redirected to the U.S with a loud sista introducing herself as Donna Norris. She asked for my phone no in case we got "disconnected".She then spent a good half hour enticing me about MY vacation package to Orlando Florida,Disney World, Cruise to the Bahamas and Dayton..all this from $3899.00 down to $899.00 if I ACT NOW saving me a whopping $3000. Now this woman didn't let me speak much and carefully replied to my basic questions by script I imagine. Donna was doing a good job going thru all this with me on the web page with all these lovely pictures of beaches & cruise liners,buxom babes,etc

Called Vonage based upon a mailing for new service. The # was 1-888-275-8806. They claimed that I could not keep my land line number of 15 years and I had to take a new number. I told them I could not sign up to because of my children's school had the number. I continue to say NO. NO. to their sales pitch. I eventually hung up. At around 4:30 p.m. my phone range once no message was left. At 5:37 p.m. it rang again and I could hear noise of people talking and machinery, it was noisy. Then the voice of a child spoke and said "Hello Mom". This is recorded on my answering machine because I couldn't get to the fast enough. I don't have to tell you I was concerned one of my children was stranded somewhere or worse. When I checked the caller ID to find out where the call came from I found name unavailable and the number of 1-888-243-4357. I am pissed off to say the least. How dare this company Vonage use scare tactics between a parent and their child to get a person to call them. The customer service at Vonage had an East Indian accent and her name was Cy.

It's not exactly phishing when a collector does it. An ordinary scammer has no document to work from and creates a ruse. A collections rep has a few lines of account data, if not an entire credit report, on display during a live call. Debt accounts are traded in bundled portfolios, often with faulty data rolled in and no opportunity to cherry pick only those accounts with a solid chain of title. That's how wrong names and numbers propagate.

This is partly why Federal law exists to give you the means to challenge debt claims and control how you are contacted. So use it already!

I think 4.2 years of complaints should tell everyone to proceed with caution. The use of female British accents in collection calls seems to be a minor trend. Supposedly the human brain is wired to listen more attentively to females, and maybe the accent is meant to suggest authority. Anyways ....

The DNC registry is for telemarketers, meaning sales. Charities, debt collectors, political speech, and surveyors are all exempt. If you are receiving misdirected or abusive calls from a third party debt collector, you may find relief in the provisions of the FDCPA, which regulates bad collector behavior. Learn your rights at FTC-dot-gov. There are some controls on calls to mobile phones, particularly canned messages, the idea being that a collection call should not cost extra to receive.

Special Data Processing actually hires work at home agents and the actual company is garbage. On the good side, if your a meth head and need a job it's probably a good place to start. The reason is that, "these types of calls" are not covered by the Do Not Call list.
Specifically, we gave our information out when we purchased/ordered things from companies that then sell our information to "3rd parties offering goods and services we feel may be of interest to our customers."
This type of crap is buried in "privacy policy" statements (i.e. there is no privacy -- they are going to "share" our information).
The DNC list (and law) specifically allows this.
The tortured logic being that this is "different" than being blindly harrassed by telemarketers we didn't give our information to (grrrr...).
Also, this is why we get calls on our cell-phones (which is, up until now, illegal with cold-calling solicitations), as this was the phone number we provided when we purchased/ordered whatever in the first place.

I know this sucks, but at least WhoCalledUs allows us to share -- to know -- who the bad actors and phone numbers are. And, to help each other avoid being further harrassed and/or scammed.
Just knowing what's going on is helpful (e.g. your identity hasn't been stolen or hacked).

FYI, I haven't received any more calls since the 8th (on either this number, or 727-712-0382, both Quality Resources). So, this episode lasted two weeks (which is about what I experienced last year, when I went through the "Quality Resources experience" after an online software purchase).

Chele, show a little bit of intelligence here. There are a lot of easier ways to get a database of working phone numbers, including just getting it from the phone companies or just calling every number automatically and see which calls go through. The Do Not Call list cannot prevent everybody you don't know from calling you and never could because of the exemptions built into the law, including charities, political organizations, and companies with which you have an established business relationship. Also, it can't stop people who decide they are going to break the law from calling you. I remember before the DNC list law, we got about half a dozen calls a day from all sorts of places trying to sell us something. That's dwindled to practically nothing. So the DNC list is a very good thing, no matter what your half-brained theories are.

I also recently ordered a WaterJet, and the calls have started today (twice already). I see the name here of "Quality Resources" over in Clearwater, and I recognize them as the same outfit that bothered me in the past, after I had purchased some software online. If I recollect, "Plimus" was the outfit who processed the software purchase (Google "Plimus" when you have the time, LOL).
Do not give them any information, as they really have no business having your name, phone number and last four digits of your credit card number!
They use multiple phone numbers. Let them all ring and never answer them. In a couple weeks, they will stop calling.
If you think you can stop them by talking to them, you're insane!
Even picking-up the phone confirms to them they've reached an active phone number, which only makes them call all the more. If you accidently answer the phone, do not confirm that they have reached who they are asking for. Instead, ask them who's calling. They will persist. Confirm nothing! Tell them that you do not know "whoever they ask for," and to not call this number again. Tell them nothing!
Realize this... these people have been complained about, and reported to, every government agency, police department, phone company and consumer protection agency in the state of Florida -- for several years now -- and they're still in operation!
God help you if they get your full credit card number, and whatever missing identity information they still need, in order to clean you out. A**holes.

I have been receiving a lot of calls from QRI at 727-712-0152 over the past couple of weeks. I don't know who they are or how they got my number but they never leave a message. I will not answer the phone to a number I do not know. They call early in the morning, all day long, and late into the evening. This company needs to be stopped. I have put my number on the opt out option on their website so this better work or I will report them to the BBB.

I just opted out of the calls via their website this morning. Since then I got two no-answer calls. At 6:30PM, I got a call where they answered. The pushy female verified my address for the Shed-Vac I ordered; then, tried to sell me something for $1 for the first month. I didn't give her a chance to tell me what it was or how much it would cost monthly thereafter. I just insisted that I didn't want anything else added to my charge card. She just kept talking and, somehow, I snuck in the wish that she would take me off their phone list. She said, Okay, and thanked me for my order. Hope I never get calls from them again and I plan to chew out the bums that sold me the Shed-Vac for selling my info without my permission.

Whenever I keep getting phone calls from the same number, I answer it speaking a sentence from different languages. I know a little Japanese, Russian, Korean and Chinese. I spoke Chinese one time and the next time I got the call, the caller was speaking Vietnamese. I get a kick out of messing with their stupid minds. The longer you keep them on the phone, the less time they have to get an order out of you. Some of my friends tell them to 'wait while I get my wife', then the leave the phone and go watch TV or something.

I just received a call from QRI to let me know my purchase of the "fix-it" tape is on the way verifing address, & card # yes gave me 3 toll free # to cancel offers, said them so fast thinking you couldn't write them down, someway I was able to. So hopefully these so-called offers can be cancelled. I am on the DNC list, so not sure how they got thru. I am a widow on limited income, so DO NOT need their "offers"! IF I get another call as has been stated they may be sorry for making that call!

I find it interesting I started getting these calls too...shortly after I ordered the Instyler. I didn't answer the first 2 calls (no msg left), but did the 3rd & no one was on the line. If they call again I won't be surprised if they do use my first name since I used in the ordering process. How disappointing they'd sell my info especially after I marked I wasn't interested in special offers, etc, but then they didn't claim they wouldn't, did they? Losers.

I have a recycled Metro PCS number, and I receive about two calls a week from this number asking for a previous owner. I don't answer calls from numbers I don't know, they always leave a recorded message with an artificial woman's voice asking to speak with the former owner's name, along with other button options. I don't want to answer because I don't know if I'll get a human or this recorded message, I'm not in the mood to speak with someone and try to explain that I am not the person they are looking for. I have no idea what this is regarding or who this is on behalf of, that info is not in the message.

I have had them calling a few times a day, the only thing that keeps me from loosing it is that I don't really use my home phone and I only check for messages every couple weeks. I found the website of
QRI - Quality Resource, Inc. and here's the website, www.qualityresources.com it doesn't explain what they do, but there's a thing that they provide for you to take your phone number off their list, I don't know if it works yet but I'm giving it a shot. Good luck.

Received a phone call from (425)562-3215 at 5:20pm today. Recording asked if I was Jennifer and if so to press 1 because it was urgent. I did, heard someone typing on a keyboard for about 10 seconds and then was disconnected. I will admit, that I was in a bit of debt, but all has been cleared for at least 3 months and have not received a single call from any collector or credit card company in the same length of time, until today. All accounts in my name have been paid off and closed, except for my bank account and if there's ever a problem with that Chase calls me themselves.

On 6/10/10 I received a call at 3:50pm, 6:27 pm, 8:53 pm, all with no msg left.
then 6/11/10 12:16 pm, 3:34 pm, 4:43 pm, 7:18 pm. All with no messages.
Then I called the number back. I had just ordered a workout video online and they wanted to add discount coupons to my order for $1. They wanted to verify my address before they could send me my video. I told them that this was poor business and very creepy to have 7 missed calls from the same number in 2 days and no message. The guy spoke very robodic. and kept telling me the call was being recorded.

I got a call from this number today (they called 6 times yesterday when I wasn't home). I answered the call and got a woman trying to get me to confirm my home address. She stated that I recently made a purchase of a swivel sweeper. I told her I did not purchase a sweeper. She was very persistent, and said that I did and that it was on my credit card statement and she needed me to confirm my home address or contact their customer service. I told her no again and that I knew she was trying to run some type of scam on me and to take my number off her call list. I also told her if she called me again I would report her. This didn’t seem to bother her because she kept talking so I hung up. Time will tell if I get any more calls from them.

Also, my credit card was compromised a few days ago. I found out about it and canceled it. I’m not sure if this call was related to it or not. Interesting...

Just got that call again, this time I listened to the message a little more than last time: called from 4255623215 said to call 8004775451 this is who they are looking for justin simmer this is the company that called er solutions this is the chick with the foreign accent kelly smith. you'd think that since there are ways to find out if the company is calling cell phones that they would stop, because they aren't supposed to call people on cell phones. oh well, they are still going to be ignored.

I ordered Cami Secrets after seeing it advertised on a commercial. The company who sells this is Ontel Corp. (They also sell all sorts of As seen on TV products) It appears they sold my number to a third party - and now this third party is harrasing me. The calls come from 727-712-0152. This company and this company calls me eleven times a day! Last night they called at 7:03; 7:13; 7:35; 7:56; 8:13; 8:29; 8:44; and 8:58. This was only the calls in the evening - they called during the day too. This is ridiculous and needs to stop! I filed a complaint with the BBB (I got the idea from another poster here - thanks)- and found that this company name is Quality Resources and it is in Clearwater, Florida.
