P'd Off was correct, many states have some form of UCC or control of bad business practices. The critical flaw is when only ''the state attorney general can apply'' them. These often lack private right of action, creating an enforcement gap. You might have a tiger like Minnesota's Lori Swanson or former NY AG Cuomo, or you might have someone mainly engaged in working on his golf score. Point being, the attorney general is not *your* personal defender. Complaints or corporate abuses to the AG and regulators are great for putting them on public notice but may go nowhere in terms of private satisfaction.

I had failed to note a few enlightened states have their own FDCPA-like rules aimed at original creditors, such as California, Texas, and I think Wisconsin. They may have some blanket line about anything illegal such a collector does being a violation, and that would be a way to pull local deceptive practice statutes under one's case.

Concealment of CID or having a uselessly generic CID or verbally omitting a business name are likely to be rolled into adherence to privacy mandates in collections laws. Collectors do lose suits on those grounds but not consistently, as they face a constant dilemma of having to make proper disclosure *and* protect privacy, which are usually mutually exclusive.

The federal DNC is meant for sales calls and therefore exempts collection calls. ''Prior biz'' arguments again fall back on TCPA, which has limited but sometimes successful reach in damaging abusive collectors.

I might add that these issues are hardly academic. Sterling Jewelers manages to show up as plaintiff in my state's civil court calendar a few times a month.

I have taken a wandering look at some of the posts here. And going by my own experience with these idiots and the repeating story among the complaints here it is very clear that whoever this company is, they do not care about laws or the rights of the people they call. Especially the rights of folks like me who DO NOT have any account with any of the jewelry stores they represent. Now the particulars. FDCPA/TCPA whatever. There are also laws on the books in most states that the state attorney general can apply to abusive, negligent, and harrassing callers. Some fall under the discription of UNFAIR PRACTICES or DECEPTIVE PRACTICES which this company is hip deep in useing by using phone numbers from all over the country on a daily, or even several calls per day, to anyone they call. Hiding behind 800 Services or other no name listings is a blatant deceptive practice because they are hiding their true identity which is a violation of most every calling practices law on the books in most states. The problem is. As long as the victims of the calls cannot properly identify the caller to get a proper mailing address there is little we victims can do. Even when we don't have a business relationship with these idiots. All we can do is file complaints with any state or federal agency we can to make it clear that consumers are unhappy with the way businesses do certain types of business and that means they need to do something with legislation to address the issues. So. IF you DO NOT have any business with such companies file complaints against them for violation of the NDNCR and include in your note that you DO NOT have any kind of business relationship with the caller and that, dispite them being a collection department, will give cause for the authorities to contact them and tell them they are violating your rights and to stop calling you or else. Filing complaints with your state attorney general's consumer protection office will depend on what they have in place for dealing with such activities. In New Mexico they have Fair Practices Regulation laws that apply to such activities. There are also PRC offices in most states that may be able to help. I am presently working with the NM PRC over a cellular phone company's attempts to defraud us for services we never signed any contract for and they have sent two actual collection agencies after us for the false dept. As soon as they fail to show a signed contract the collection agency throws it back at them and stops all actions but they don't want to stop. They will wish they had. All over a false $105 bill for services we never asked for, signed for, or used. Now that should show the extent some idiots will go to over the US dollar!

I believe "Had Enough" and "R" are among the blind men trying to describe an elephant. Only some of their assertions are correct. The first critical question is about the nature of the caller. If Sterling Jewelers or one of its subsidiaries is performing in-house collections, especially if prior to charge-off, it is a "first party" collector as an original creditor. Therefore FDCPA DOES NOT APPLY. It would only if the account was assigned secretly to some third party collector, choosing illegally to borrow the OC's name.

What would readily apply are state laws on debt collection, which in a few corners are stronger than Federal. I don't know where H.E. gets the idea that "normal business" hours and days define some restriction on calls. "Normal" operating time is relative to each company. I suspect Federal and state laws have been confused. Under the FDCPA, debt collectors get a daily thirteen hour window and NO days are off limits, until otherwise notified by the call recipient. Sundays, Christmas, Arbor Day .... it's all good.

The only other defense platform might be found under TCPA, which hinges on the notion of consent to call and if the calls are canned, and like that. Now, I often advocate reading about the laws to get a grip on these issues, even if they don't apply to your problem. But you also have to understand them and perhaps study case law before going around making heated and faulty assertions about how they can help. Also the term you meant, H.E., was "bona fide".

OH! Also... Calls by a collection agency/office are only to be made DURING NORMAL BUSINESS HOURS on NORMAL BUSINESS DAYS! That means if their offices are normally closed on Sunday for example. They have NO LEGAL right to have a calling service or during closed hours employee or an automated dialer making these calls. This extends to the deceptive practices as well as violating the calling rules. For ALL here who have received these calls. This company, no matter who they are, is using a deceptive practice to harrang and harrass the people they are calling. According to the FDCPA the making of useless calls is a violation of the act as well as the making of calls in the manner they are doing is causing a phone to ring so as to annoy the persons at the number being called. They have called us from no less than 6 different numbers from 6 different office locations over the past few days and failed to leave any form of message on our answering machine. Our caller ID has shown several different names (which is also a violation of the act as it serves to hide the true identity of the caller). Now for the kicker... WE DO NOT HAVE ANY ACCOUNT WITH ANY JEWELERY COMPANY OF ANY KIND! That means they are calling the wrong number which is going to cost them about $2,000 per call if the FTC and NM State Attorney General allow the applications of the fine for both violations to be applied to EACH CALL. As for the R poster below.. YOU Need to go back and READ the FDCPA! The law clearly states the limitations on calling hours AND sets those limitations TO THE LOCATION OF THE PARTY BEING CALLED! Being that you appear to be defending them. Maybe you should take the time to contact them and have them come check out these complaints for themselves. MAYBE they will take a step back and at least start taking the time to MAKE SURE that they are calling the CORRECT NUMBER for the person they are trying to reach. AND they will learn that they do have a LEGAL requirement to properly identify themselves and the purpose of the call under the FDCPA as well as being prepared to answer certain questions the "Debtor" they are calling has a legal right to ask them in the process of making what is considered under the law as a "BONIFIED ATTEMPT TO CONTACT"... That is my two bits for you. As for the rest. Guess we will see what the LAW I have brought this to the attention of decides to do about it..

Have had about 5 messages on voice mail from 800-877-8194 over the past few days - "important call from your jewler". Answered the phone this morning and it was Shaw's Jewlers (so they said) and they were looking for my metally disabled sister-in-law who has never shopped at Shaws and doesn;t live with us. Wouldn't tell me what it was in reference to, and the caller (a woman) was fairly short with me. Wouldn't talk to me about details even after I said the person she was calling for couldn't speak for herself. She insisted on having the name of her guardian (I didn't give it), then said we could call the 800 number to verify. Haven't tried that yet, don't want to be ID'd on their caller ID. If it's a matter of identity theft, I'd like to get it cleared up. My sis-in-law doesn't even have a credit card! So... all this is just for others who may need to know. I have no idea what this is about, but it doesn't sound legit to me.

These people called me (for the first time) today asking for "Mr. John C Milligan" or something. He said that I was the operator I was speaking to 'just a minute ago' regarding my warranty and that he was sorry the line got cut off. I informed him that I applauded his company's attemptive marketing trick but that I would not fall for it. He laughed and hung up.

Then he called again 10 seconds later with the same bullshit story. I told him I was the person he was just talking to and he hung up in the middle of my sentense.

Then I called the # back and asked the operator 'Julie' to remove my number. She said they would. I asked if they had my neighbour and she said 'yes it comes up on the screen'. I asked her to confirm it and she just said good bye and hung up.

well for starters its an automated system that calls you so its not like a person is dialing your number its all random, secondly these calls you are getting is because you have an existing account with bank of America weather its checking, credit card, house loan, car loan if you do business with boa they have a right to call you based on existing relationship with business there's even a box that you can check on the website or with the materials the bank sends you that says if you don't check that box you can receive these calls. Influent also has a policy that they can only call you twice per day for that one program however your name and number might be on more than one program but influent has many facilities across the country so it may be more than one place calling you or it may be a different program there are supervisors on hand to assist you with any complaints you may have. Just be polite and courteous to the person calling and if they are doing there job proper they will be polite and courteous back to you hope this helps.

Wow, a lot of ignorant people here. This number belongs to Sterling Jewelers, which owns 12 different jewelry companies, including Kay and Jared. This number belongs to the collections department that collects on a single missed payment. If you think they're calling at odd hours, read up on the FDCPA, and realize they can call beyond "normal business hours" whatever that may mean to you. They're on an automatic dialer, so if you ask for no calls but you do owe them money, sucks to be you. If you don't owe them money, they're supposed to take the number out. Several of the collectors are boneheads and lacking in intelligence and won't look at the notes to see that there are several notations that it's a wrong number and to stop calling. If you don't have an account, it's possible someone with a similar name has one and 411 brought up your number to try and locate the missing person. Be nice and tell them you don't know them, remove the number, they'll usually do it after one or two calls, unless of course they're not doing their job.

They can't give details about why they're calling, they can't even say the words "debt" or "account" unless they verify they're speaking to the person they're trying to reach. Sucks but it's the law. Getting dead air? Again, it's the dialer. If the collectors are just sitting there and BSing with each other (which happens a lot unfortunately) the dialer keeps calling and the collectors doing their jobs can't keep up, so it gets a little behind and some people answer to have no one on the other end. Guess what? THEY HATE THE DIALER AS MUCH AS YOU DO. It's a crappy way to start a conversation and no one likes it, but it's the only way to handle massive amounts of accounts.

Don't believe me that it's a real company? Call the number on the back of your jeweler's card, the number for Credit Customer Service. The wait time's a little long but they can verify where you're calling into, why you're receiving a call and transfer you over so you can deal with them. Seriously. It's a debt collection department. They can call you as much as they want within legal guidelines, which are pretty darn wide. Read up on the FDCPA, and if you don't like it, write your congressperson and complain.

It was an auto dial from Sterling Collections, the rep for Kay Jewelers. I actually had an account with them, but closed it a year ago with a different phone number. I just got my new phone line recently and I called back confused after finding the listing on this site. The rep said it was for another person who apparently used to have this phone line before me. I was a bit weary about giving out my social, but according to all these posts it was harmless. The rep simply deleted my number from their call listing and that was that.

The calls are from the 30 Day Collections department of Sterling Jewelers. 30 Day meaning that the account has not been credited with a qualifying minimum payment within the previous statement period. Sterling is the parent company for: Jared, Kay, JB Robinson, Rogers, Osterman, Marks and Morgan, Goodman, and several other smaller regional Jewelers. When a payment has been secured, the calls will stop. If it is in fact a wrong #, just let them know to remove your name from their dialer system. Very simple.

They are calling because you (or someone at that number) is past due on their account. They call continuously because it is all on an auto dialer. The first person to answer their phone gets a rep. I did not take the call, and having read some of the other comments, it is a good thing that I didn't. I am not easily amused by
any unsolicited calls at almost one in the morning. But a call related to politics would have set me free verbally, and I don't care
what party it concerned. Whoever is making these calls should be mindful of time zones, at least.

I received this call from 800-877-8194 four to five times a day for two weeks saying "This is an important call from your jeweler". I have no jeweler. So one night I finally answered the phone to find out who these jerks were. It was Kay Jewelers! The women calling was rude and obnoxious. It was a collection service and they were hunting down a customer with an unpaid balance. But they had been calling me, the wrong person. I called customer service at 800-877-3616 and was told by them that I was being called because my name was "very similiar" to the person they were looking for!!! So I was being harassed by Kay's because I was guilty by having a similiar name. I asked them to close my account with them.

I have received numerous harassment calls a day from this number, or others, that start with the same: "This is an important call from your jeweler." I had the caller blocked through my land line telephone company in the early summer. The calls stopped until this last week, when they started to come in again. Being fed up, I called my land line telephone company and indicated that I paid serious money for blocking service and I wanted them to search the caller out. The calls only showed as "Incoming Call" on my caller ID. They said they couldn't help without a number. After checking the internet, I found that a "*57 trace" can be done through the local police department. It involves the police and the telephone providers legal departments to trace the perpertrater. It stopped for three to four days and now the 1-800-877-8194 number calls my phone but there is no message. The good side is that now I have a number and I can again block it. Anyone posting that this is a valid call for late accounts is full of it. If I should eventually learn the perpertraters, I intend to prosecute them fully.

They always ask for someone by name who is currently working there, but never give any details about why they are calling. TELEPORT COMMUNICATIONS BOSTON owns the 978-570-xxxx numbers. but i try to call since i found thier number via google and it says it is disconnected.

I am still looking for the 201-210-xxx numbers. Reply if you have any questions or anything to add to my research. Once I find out who these people are, I am submitting a lawsuit in my local small claims court. They called me 5+ times, and I am entitled to a little over $2500 for unsolicited calls to a cell phone.

They call you and if you pickup, they play an automated recording telling your automobile warranty has expired and it is the last call to remind you that you can get an extended coverage. I too have been receiving numberous call to both my cell and business lines in Washington. I found that the telemarketing is being done on behalf of Auto-One. Auto-One is located in Irvine, California. I placed a call to their main office 949-475-9500, where I asked to speak to either their legal counsel or David Tabb (President). I informed the women who the call was directed to that I was prepared to enter a formal compliant with the FCC regarding telemarketing to a cell phone. She asked me for my name and number. DO NOT provide your name. They already have your number, so provide your number and stated to have it removed from their telemarketing list immmediately. The Seattle Weekly (Seattle, WA) is investigating this. Remember ... it is illegal to 1) telemarket to a cell phone, and 2) illegal to telemarket to any phone number that has requested to be removed from the telemarketer's phone list. Hangin-up is only a band-aid on the issue. Flooding this company's main phone number with request for removal from list then lets Auto-One experience what consumers are experiencing. Also, DO NOT provide any of your contact information to any blog (such as this), you run the risk of some other entity phishing your information for their own purpose(s).

This number calls my work number at least 3-4 times a week. I am registered for the do-not call list and I am not sure how to make it stop. It consists of a pre-recorded message about a car warranty that is about to expire - I know of a a few people who are also suffering the burden of these automated calls on both their home and mobile phones.

If you will call the 800 number listed below, and tell this clown, (who states he works in the computer divison) that you are tired of it all, and ask for HIS number, (which although listed below as a cell number, has been disconnected, with no other info available) so you can interrupt HIS dinner or Saturday morning slumber, he seems to be willing to at least attempt to rectify the situation. Even though you, (and I) are on the do not call list, if/when you use any of Bank of America's websites, there is a small box that is already checked, which you need to uncheck, which states that you give permssion for their "chosen affiliates/business partners" to contact you. If you uncheck this, and after approx 3 business days you still receive calls, try calling Bank of America, and telling them that because of their relationships with businesses such as this you are closing all your accounts, the calls WILL cease very quickly--

This sounds like an automatic dialer in my opinion and is most likely a third party company selling on behalf of verizon. They are either not prepared for there calls or they are "dropping calls" which means they are just not answering because they want a little brake from the endless calls and sales thats are required. In rare cases since the sales department are spread out throughout all of north America it maybe be just a glitch and the call is not coming through properly.
Call up verizon ask to be put on the Do not call list, write down the date and time that you had requested this because sometimes if there is a system crash the ticket info would not go through.
Also if you have call block try using that since the number is consistent.
Dont bother with the national do not call list if you are verizon customer because that will not make a difference. Also I found this information based on the telemarketing calls.

The best thing as I mention is the Do not call list or the calls will continue.
Also correct me if I'm wrong but if you receive 3 calls or more from any company in a day then that is illegal.

---Just remember the DNC does not start until 30 days after your request because information needs to be passed from all the centers.----

I was prompted to use the automated system by pressing "1", and the only option was to enter a 10-digit account number from a statement. I continually receive calls, numerous times a day, from "Influent 614-652-2636", according to my caller id. They never leave a message, and there's always a busy signal when I tried to call the number back. I love Google, because I was able to find not only this website, but also www.influentinc.com Here you can find the address and main phone number for their headquarter location. According to the website, INFLUENT is a telemarking service for third party businesses who hire them to make outbound calls. Try calling 800-856-6768 and tell them to stop calling. I was actually able to speak to a live person and tell the girl to stop calling me. She took my information and told me they wouldn't call anymore. I hope they don't. I'm tired of seeing them on my caller id.

Last post :)...I cannot emphasize enough the importance of putting your "Do Not Call" request to Influent, Inc. in written letter form and mailing it via certified mail, return receipt requested to their corporate office. You will receive a green card (receipt) back proving that they received it. That constitutes notice. If you copy the letter you sent Influent to the consumer agencies/offices listed above, there will be record, and a paper trail, of your complaint(s). When submitting a complaint to these agencies, be polite. They are there to assist consumers. They are buried with complaints. When they receive a number of complaints on a particular company, ie a repeat offender, they will investigate it. Stick to the facts only, and give them as much information as possible so they can put your complaint in perspective, i.e., rude, confrontational employees deliberately calling back after you just hung up, how many times a day they call, time(s) of day called etc. If you send emails, or call, as Influent conveniently requests, they can potentially assert that you never called, emails can disappear and were "never received," you never told them to stop calling etc. Get the picture? Once you notify them in writing, legally, they must stop calling. Go after them folks. Complaining on a comment board will not stop the problem (Influent.)

Some gave my number and has a different address. I went to B.O.A today and they said my phone number is not in their system and if they were going to do telemarketing they'd do it at the branch. Oh yeah. Since I don't use my home phone for the most part and anyone who knows me that needs to talk to me knows my cell phone number. I put my fax machine on and after 1 ring


It's loud as hell and it feels good knowing these telemarketing scum get an ear full of fax tone. It has also made some people stop calling.

1 more thing I do when not using the fax machine. My answering machine has a spanish and a french option for the standard recording. Those come in handy too.

They did to me all the things they're doing to y'all. I just politely called their main number back that I got from the people on this website and asked the first person who answered the phone to police take me off their calling list and I haven't heard from them since. It's been over a month now.

I used to be a debt collector and I think this is a collection agency calling. They call me at least once a day and sometimes twice.

Called again today for 4th time even after I had a yelling match with guy from yesterday. (see my previous comment) Once again, I told them I was turning them in for calling.

Second time I spoke in spanish they hung up and never bothered me again.
You can use an english to spanish dicionary on the internet to translate any phrase you want..
I translated the phrase below.

Called last week and I reported them to Do Not Call website. Called today and I told him that I had reported them and would be reporting them again and I hung up. He called me right back and started berating me while I was telling him that I would report them again. I hung up without hearing what all he was loudly saying to me.

They call 3 days a week and don't leave a message on the answering machine or with anyone who answers the phone. They just say they'll call back later.
