This is CM Billing, a collection agency. In my boyfriend's case, it was for a Time Warner Cable bill from his old house that never got to him.
About sick and tired of this. They call and leave an automatied message that says "Please call Mr. Phelps office as soon as you can" UMMM Lets see HELL NO. They are not looking for me. They are looking for someone who does not even live in the same state as me.
They have been calling my 90 year old fathers number that he has had for over 40 years. Upon calling them they are looking for some other guy with the same last name. I just called them with my second attempt to stop them. Upon talking to the operator she says the best way is to send them a letter. So they will be getting a certified letter from me as well as a notice that each call received from them from now on will cost them $1,000.
Anyone got up a class action lawsuit against these guys? I'm gathering addresses for my State AG's office, the FTC, FCC and BBB. Hopefully something here has got to get this stopped.

This is a new phone number for our residence, Credit managment constantly calls our number trying to locate the people who had the number before us. I have spoken with several of their representatives and explained this is not a good number for the previous people. Credit Managament still calls and also uses a recording in regards to calling Mr. Phelps. When I tried to speak to a supervisor, she was belligerent and would not even let me speak. I tried to tell her I had spoken with other representatives and she told me I was mistaken. I have informed Ms. Terrance if the calls continue I WILL file harassment charges against this company. They seem to think they are the only one recording the conversation they are sadly mistaken.

They have called me twice, using their autodialer, to my cellphone. The first time, I told them it was a cellphone, and told them they are in violation of federal law. They said they didn't know, and will remove my number right away. They called me again since. I told them that I am going to file a complaint with the FCC.

This number is for Credit Management or CMI, a known debt collection agency that uses fraudulent identification to get you to call them back. Stating that Mr Phelps wants you to return his call is fraudulent, because, by law, they must state that they are a debt collection business when they contact you. Perhaps the reason they don't identify the company is that they want people to be caught off-guard when they call Mr Phelps back. Their use of automated dialing machines and recordings violates state and local laws in many jurisdictions. There is a multi-million dollar potential class action pool here if the right attorney gets on this. CMI WILL continue to leave messages on your phone until you call them back. When you call, you will never reach Mr. Phelps, but will speak to an agent who will tell you that your call is being taped and they will inform you of the supposed debt, which you will have a chance to challenge at that point. For your own protection, tell them that you are also taping the call. Get a recorder and keep records of whom you talked to and what was said. Problem started with a new cell phone # from T-Mobile. Now this "mr. Phelpes" calls like my mom, twice a day. A recording from this number left a message to call Mr. Phelps about collection of a debt. I called back and the representative said that I owed Time-Warner Cable money from an account closed a year ago. They had my name right but cited a street across town that I've never lived at. I haven't had any cable service since March of 2000. Indeed, I have had Dish satellite service since 2000 when I moved into my present home.
I notified the CMI representative that this was not my debt, that they were mistaken, and not to contact me again about this debt. I opened a case file about their contact with FTC and filed a complaint with Time-Warner cable. The cable company representative validated that I was not the person CMI was looking for by comparing the last four numbers of my SSN to accounts and closed accounts on the street cited by the CMI representative. The Time Warner representative was very nice and said his supervisor would contact CMI to correct the situation.
If CMI enters a harassment loop with me, I wouldn't mind leading a legal effort to acquire some of their money. I enjoy a good fight, particularly when I'm motivated by righteous indignation and they don't have a leg to stand on. They should get their facts straight before they contact innocent people claiming that they owe them money. That is fraud.

The no call list is to stop tele-market people. Not collection agency. As long as they don't call after a certain time of day, they are'nt breaking rules. But from the looks of all the people who don't owe any past due bills, I'd be leary of conducting any business with this company. Not all collection agency's are legit. Tell them you want to know the original company on the bill and that you'll only due business with the original company, not them. You do not trust them to handle your account correctly. Also, if you know you don't owe anything, check your credit report. You can get three per year free. It's always possible someone has stolen your identity; if so, be prepared to live in the ninth circle of hell until it's cleared up.

They have called me four times in approx four months. Today I called them from an internet phone (so I would have no caller ID), deliberately at midnight so they would be shut. Recorded message gave a website, which I checked out.
Having had a fraudster attempt this sort of thing in my native country, I then spoke to my bank and others about what to look for when identifying fraud. Based on this, I believe that these people are a bunch of crooks. I would not give them money, or personal information. Bear in mind also that the one comment on this board that claims they are above board (against a dozen saying they are not) may have been put here by someone involved with them.
How do I get these calls to stop? I am on the National Do Not Call registry.
The message says, "Please call Mr. Phelps. The number is 1-800-377-7789." Who is Mr. Phelps? GRRRR!!
Everytime I hear the recording call Mr. Phelps office, I think of the old Mission Impossible TV-show when they say, "Good Morning Mr. Phelps". I think that maybe they think its their 'mission' to bother me 5 times a day. Extremely Annoying.

I think they have you on a rotating list...I get a call twice a day for about 3days in a row, then nothing for a couple of weeks. Then it's back to "7789, that number is 800-377-7789, Please call Mr. Phelps office at 800-377-7789"
I ignore it everytime! I have perfect credit and nothing ever late! It is to the point where I want to change my number!! GRR
Same here just got a new cell.I dont know who they are.They should pay for my air time.
This collection agency has called every day on a bill that is 10+ years old and isn't even ours! They called and spoke to my husband and when they realized they were making absolutely no progress with him because he know's his legal rights, they actually said to him 'Ok then' and asked to speak to me! We've told them not to call back and they do. Over and over again.
Comes up Toll Free on Caller ID - Just says to call Mr. Phelps - Googled the number and it belongs to a collection agency. I don't owe any money but if I did, why would I call them back. Why can these companies call us with the no call list.
I get this call everyday and sometimes twice a day. The beginning of the message is always cut off and all I hear is the number. It always shows up unknown or the 877# on my caller ID. This is my cell phone so I do not answer calls I do not know.....

I just got a new cell phone this past weekend. Beginning this week, before anyone even had my new cell #, I started getting calls from this number. I don't have the time to sit there and talk to someone who I don't know, so I don't answer. Then, the next day, instead of calling, they have to send me a text message, which I don't like in the first place. I think that whoever is doing all of this calling, & apparently does not know how to update their information, should have to pay everyone's cell phone bills. I reported this number, & if I continue to get these calls, I will report this number to the authorities to have this matter taken care of.
Think about it people. If this so called person, Mr.Phelps needs your phone #, how did he or his agency get ahold of you in the 1st place. If they call again, which I'm sure they will, tell them "you must have my # because you rang my phone" and hang up.
Mr. Phelps! althougyu hold on for a representative, no one comes to the phone. The one time they did respond, I just happen to know that the person they were trying to reach had a phone nuber similiar to mine. I gave them the correct number and guess what? The pissants STILL call me! I think I'll take someone's advice and put them on speedial for ohh---30days around the clock.
Got a call from "Mr. Phelps 'Office" a.k.a. CMI a week after I got a new cellphone number. They were looking for presumably the previous owner of my number. It took 2 minutes to clear it up and they said they'd take me off their list.
They don't like it when you call them 140 times in a row if someone wants to feel better about their harassment, blow their phone up with calls.
This company is calling for an ex girlfriend of mine. They are calling about time warner cable $39.00. Real A-holes to you on the phone. took 20 calls back to them to get a response as to who they are looking for.
This number keeps showing up on my Caller ID and I never have a message on my machine. I am on the NO CALL LIST TOO!

We've gotten at least one call from this number every day for months (via our caller ID and/or answering machine).
I doubt it's a collection agency, since we don't owe anybody anything and have no credit issues.

Called my cell company, and they suggested contacting the BBB...who will want 5 USD just to send them a note to ask them to stop.

I have sued many telemarketers in the past under FCC guidelines. I am going to attempt to sue CMI and see if this takes care of it. I have made over $2000.00 in court winnings. Call the FCC and request a copy of the Telephone Consumer Protection Act and FCC Rules. If your state allows you to file suit against telemarketers that violate these rules you can sue in small claims court for up to $500 in damage.
Any time you get a call with an 1-800 callerID number it's probably a collection agency.

I told them that they were in violation of the THE FAIR DEBT COLLECTION PRACTICES ACT 806. Subsection 5- Harassment or abuseA debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section: (5) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number.
They are also involved in RICO/ fraud and extortion if you do not have a contract with them originally and they can not product the originall wet ink signed contract then accouting to the Uniform Commercial Code they are commiting fraud and extortion . A copy of a debt is only evidence of a debt. it does not give them attority to Harass you.

I have received calls daily from Mr. Phelps. I did reply, and requested information be sent as to what this is about which I have not received. I was told they made a mistake. They would clear the account. Now I get 2 bills from them, and the calls keep coming. I have excellent credit, and if I owed anyone money, I would have paid!! MAKE THEM STOP!
This is, I think, a collection agency...one without any regard (in my opinion) for honesty. They have called me two or three times to collect a debt I allegedly owe to Capital One Bank for an overdraft. I have never had, nor will I ever have, a checking account with Capital One Bank. I've set up a recording system on my home phone so the next time they call I'll have something to take to the District Attorney. Seems like some sort of fraud to me, if I understand correctly what they are wanting.
It is a legit collection agency. Found out there was an old bill mis-filed on my wife that we will now clear up. You might want to call the number to see if you do have something you should know about that could also be screwing your credit scores up. It's legit, lady I got was very nice and helpful to get me the information I needed.

800-377-7789 calls my personal cell very often. They always just ask for some one named "Miranda McCauly. I do not have any idea who this person is.
We have had to declare bankrupcty over a year ago. Now, I have two collection agencys who do not have a clue what is going on. This is getting annoying...
Mr Phelps office calls daily, sometimes more than once a day. My curiosity got the better of me and after reading Sylvia's note on this website I got up the nerve to call back and give my #. They asked me if a certain person resided here, (which they don't) and when I said no, they said they would log it as a wrong number. Here's hoping Mr Phelps doesn't call again.

This is a collection agency... often ppl just give out fake numbers resulting in "mr phelps office " calling for their bad credit...if you call and tell them your number, they wil ask you for the person they are looking for , if you are not that person simply ask them to quit calling.
