There is much controversy over statute of limitations in all states. Even within the states, judges don't agree on the dates which really does a lot for the whole situation.

Most of the time, if you approach these bozos with a formal letter sent certified mail, return receipt requested and tell them to cease communications until they fully validate the debt, they will sell it to another bozo collector who will proceed to attempt to collect on it. When I say fully validate the debt, I mean specifically state in your letter for them to provide documents proving you actually signed a cardholder agreement or contract for the debt they are pursuing, copies of all documents they have on file pertaining to the alleged debt and authorization from the original creditor that they as a collection agency have the right to collect upon the alleged debt. Do not accept a copy of a statement as a validation of a debt, it is worthless. They will try and use this to shun you and satisfy the requirement but it does not. That is why you must specify in detail the documents (any and all) they have pertaining to the alleged debt. Yes, it's a pain but so are they and they are relentless. In some cases, if you do not challenge it, they may turn it over to an attorney within your state and attempt to file a judgment against you for the alleged debt. They can win if you do not fight it and having previous evidence that you have fought it is necessary if it does come to that point.

Know your rights as a consumer and act against those who violate them.

The following is directly from the Fair Debt Collection Practices Act:

§ 809. Validation of debts
15 USC 1692g
(a) Within five days after the initial communication with a
consumer in connection with the collection of any debt,
a debt collector shall, unless the following information is
contained in the initial communication or the consumer has
paid the debt, send the consumer a written notice contain-
ing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days
after receipt of the notice, disputes the validity of the
debt, or any portion thereof, the debt will be assumed
to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt col-
lector in writing within the thirty-day period that the
debt, or any portion thereof, is disputed, the debt col-
lector will obtain verification of the debt or a copy of
a judgment against the consumer and a copy of such
verification or judgment will be mailed to the consumer
by the debt collector; and
(5) a statement that, upon the consumer’s written request
within the thirty-day period, the debt collector will
provide the consumer with the name and address of the
original creditor, if different from the current creditor.
(b) If the consumer notifies the debt collector in writing within
the thirty-day period described in subsection (a) that the
debt, or any portion thereof, is disputed, or that the con-
sumer requests the name and address of the original credi-
tor, the debt collector shall cease collection of the debt,
or any disputed portion thereof, until the debt collector
obtains verification of the debt or any copy of a judgment,
or the name and address of the original creditor, and a copy
of such verification or judgment, or name and address of
the original creditor, is mailed to the consumer by the debt
collector. Collection activities and communications that
do not otherwise violate this title may continue during
the 30-day period referred to in subsection (a) unless the
consumer has notified the debt collector in writing that the
debt, or any portion of the debt, is disputed or that the con-
sumer requests the name and address of the original credi-
tor. Any collection activities and communication during the
30-day period may not overshadow or be inconsistent with
the disclosure of the consumer’s right to dispute the debt or
request the name and address of the original creditor.
(c) The failure of a consumer to dispute the validity of a debt
under this section may not be construed by any court as an
admission of liability by the consumer.
(d) A communication in the form of a formal pleading in a
civil action shall not be treated as an initial communication
for purposes of subsection (a).
(e) The sending or delivery of any form or notice which
does not relate to the collection of a debt and is expressly
required by the Internal Revenue Code of 1986, title V of
Gramm-Leach-Bliley Act, or any provision of Federal or
State law relating to notice of data security breach or priva-
cy, or any regulation prescribed under any such provision
of law, shall not be treated as an initial communication in
connection with debt collection for purposes of this sec-
tion

These folks are calling everyday, and today they asked for Debbie Martin. This is my husbands ex-wife. She has never lived in this household, nor had this phone number. I want to know how they got this number, and for what reason.

Message on answering machine said to call Anchor Receivables Management at 1-866-879-2116 about debt collections. Caller ID showed 757-321-6278.

Next day I called 321-6278, the automated system asked me to enter my telephone number. Terrance (floor manager)then picked up the call and asked me for my name and telephone #, which I gave. He said my wife owed on two accounts Wachovia and Bank of America. He listed four (4) amounts due, two (2) for each of the accounts.

I told him we do not have accounts with those organizations. I which Wachovia account, in wich state, was the account. Terrance said he could not provide any more information as I was not the account holder.

He could provide the amounts owed but not information about the account. RED FLAG #1

He said my wife would need to call and give him the last four (4) digits of her SSN. RED FLAG #2

We have never received a notice from either institution. Where is the paper trail?

they are looking for a J GilFrancisco using an automated service and there is an option to press 2 if you aren't that person,but that only prompts the machine to say have J gilfrancisco call us...I went on there website and there is no email contact listed so I posted a request for an investor package with the following note: You have been reported to the authorities, remove us from your call list, we are on the DO NOT CALL LIST AND WE HAVE NO RELATIONSHIP WITH YOU! Do not have an automated caller continue to call. J Gil Francisco is not in our household. Use your records to figure out our number and remove it immediately. This is Harassment!

I keep getting calls from these guys. They ask for someone I don't know. I have been getting these for a year. I was asked to get taken off of the calling list, and for about 6months they didn't call..now in the last 3 days I have recieved 6 or 7 calls from them. I finally got someone on the line and I chewed them out. *sigh* I hate these people.

They have called 15 times in 2 hours today. I answered the phone the last time and no one said anything. I just sat there for about a minute, still saying hello and no one ever responded so I hung up. They have been doing this for a while and I have no idea why. I called their 1-800 number to find out why they were calling and when I gave them my home phone number, they told me that they must have called the wrong number and that she would make sure my number was wiped from their database. That was a week ago and THEY ARE STILL CALLING! If you want to collect a debt, OPEN YOUR MOUTH WHEN SOMEONE SAYS HELLO!

Several calls with no message left. Recent incoming picked up and nobody would speak on from the other end. I placed several long distance calls and worked through the call response system to reach two different individuals on two of the attempts. The first person in customer service identified herself as Macy. And when I stopped providing her information when my SOC was reequested, she became hostile. The second person reached, Melanie Clanahan, claimed there was nobody under her supervision named Macy. However, she also indicated there were multiple divisions. Upon requests for information to contact the corporate legal department, Melanie became hostile also.

They were calling my cell every night but never spoke when we answered. Finally today someone left a message saying it was Anchors Management calling concerning collecting a debt for a guy I've never heard of and to please call them back at a number. So I called the number and told them they have been calling a wrong number for months and they said they'd delete it out of the call record for that debtor. Hopefully she was telling the truth and they'll stop calling. The number to call them back at is: 1-866-879-2116

Another call from Portfolio Recovery - a division of Anchors Receivable at 8:35 AM claimed that a medically-documented disability for which we have filed a disability claim and have been waiting a hearing for 2.5 years makes me a "lazy b*tch" Bank of America I love what they say in your name.

How do I stop them from calling?

  1. Ask the unwanted caller to stop calling and put you on their do not call list (they are legally required to comply).
  2. If your number is registered with the National Do Not Call Registry you can file a complaint with the FTC.
  3. Block them with a call blocker:
